Call to Order The meeting was called to order at 6:00 p.m. II. Roll Call All Commissioners were present. III. Additions and Amendments to the Agenda None IV. Conflicts of Interest Commissioner Macik had a conflict with Item VII, Lot 67/68, Block 1, Benchmark at Beaver Creek. V. Consent Agenda A. Approval of the November 6, 2001 Planning & Zoning Commission Meeting Minutes B. Approval of the November 20, 2001 Planning & Zoning Commission Meeting Minutes Commissioner Sipes moved to approve the Consent Agenda. Commissioner Wolfe seconded the motion. The motion carried unanimously with Commissioners Klein and McClinton abstaining from Item A and Commissioners Klein, Sipes and Evans abstaining from Item B. VI. PUD - Public Hearing A. Resolution No. 01 -22 Lot 25, Block 2, Wildridge Subdivision Project Type: Down Zoning from Fourplex to Two Single Family Units Applicant: Stephen Kaloz Address: 2900 June Creek Trail Tambi Katieb said the applicant is seeking a PUD amendment in order to create two single family lots; removing two development rights from the lot currently zoned for four units. The applicant has stated the proposed single family lots would be identical in their development standards to the RSF zone district in terms of building height, lot coverage and setbacks. Accompanying the PUD will be an amended Final Plat to create the new lot. We intend to take the plat to Council with the PUD. Staff recommends approval of the PUD amendment with two conditions. However, we request the Commission table the PUD application to the next meeting so the plat can be brought to Council at the same time. Michael Hazard, representative for the applicant, said he would like to address Staffs condition that the access easement must be a minimum of 25 feet and that the driveway shall not encroach into the setbacks. He would like to see this addressed at Design Review and not at the PUD amendment. The drawings were submitted to illustrate how a 4,000 sq. ft. home could fit on the site and what the access would be in terms of location. He did not have a problem with the 25 -foot access easement; but said there is an issue with the utility easement. It would be best to handle the driveway location later at Design Review. In regards to the 10 -foot side setbacks, he said he looked at the most current regulations and they call for 20 -foot rear, 25 -foot front and 7.5 -foot side setbacks for single family and duplex. He said it is a corner lot so we have two front yard setbacks. He would like to look at a 20 or 15 -foot front yard setback on June Creek. It is a typical 50 -foot right of way. He did not think the impact of less than the 25 -foot setback would be that negative. Ruth Borne, Director of Community Development, said the Wildridge PUD requires 10- foot side setbacks; our Zoning Code requires 7.5, so the 10 -foot governs in Wildridge. Because it is a PUD amendment, you may modify this requirement. Commissioner Sipes asked when it is a corner lot, are both sides considered front yard setbacks. Chairman Evans said yes. Chairman Evans stated he was in favor of the down zoning to the two single family homes. But, trying to prove a hardship to change the 25 -foot front yard setbacks on either street would be very difficult and he would find it difficult to support. He said he would be willing to support the 7.5 -foot side yard setbacks. We have acknowledged them in the past in Wildridge. Chairman Evans opened the Public Hearing. There were no comments from the public. The Public Hearing was closed. Commissioner Sipes moved to table the application. Commissioner Klein seconded the motion. The motion carried unanimously. VII. SPECIAL REVIEW USE - Public Hearing Applicant Has Requested to Table A. Lot 67/68, Block 1, Benchmark at Beaver Creek Project Type: Automobile Gas Station & Convenience Store Applicant: TAB Associates Owner: Coultier Properties Address: 40 Nottingham Road Chairman Evans opened the Public Hearing. Commissioner Sipes moved to table the application for a Special Review Use for Lots 67/68, Block 1, Benchmark at Beaver Creek. Commissioner McClinton seconded the motion. The motion carried unanimously with Commissioner Macik abstaining. VIII. OTHER BUSINESS A. Staff Approvals: Review given by Eric Johnson 1. Sign Permits - None IX. ADJOURN Commissioner Sipes moved to adjourn the meeting. Commissioner Macik seconded the motion. The motion passed unanimously.
