A RESOLUTION APPROVING PRELIMINARY SUBDIVISION PLAN FOR DRY
CREEK P.U.D., A RESUBDIVISION OF LOT 44, BLOCK 2, WILDRIDGE, TOWN OF
AVON, EAGLE COUNTY, COLORADO
WHEREAS, Blue Bird Meadow, LLC has applied for a Subdivision Variance and Preliminary
Plan approval for the Dry Creek P.U.D. a Resubdivision of Lot 44, Block 2, Wildridge, Town of
Avon, Eagle County, Colorado in conjunction with an application for a PUD Amendment; and
WHEREAS, said Preliminary Subdivision Plan provides for the resubdivision of one existing
four-plex lot into three single family lots with access by easement from an existing public street;
and
WHEREAS, said Variance application to allow the creation of two lots that do not have a
frontage width of at least 25 feet on a dedicated street as required by Section 16.40.330 of the
Avon Municipal Code was approved by Council Resolution No.05-30, Series of 2005 at a
regular meeting of the Avon Town Council on July 26, 2005; and
WHEREAS, said application for a PUD Amendment for Lot 44, Block 2, Wildridge was
reviewed by the Planning and Zoning Commission of the Town of Avon; and
WHEREAS, following a public hearing and said review of the proposed PUD Amendment, the
Planning and Zoning Commission recommended Town Council approval of the proposed PUD
Amendment; and
WHEREAS, following a public hearing and review of the proposed PUD Amendment, the
Town Council has confirmed the recommendation for approval by the Planning and Zoning
Commission and has approved the Proposed PUD Amendment by the adoption of Ordinance
Number 05-09; and
WHEREAS, the Proposed Preliminary Subdivision Plan is in conformance with the Proposed
PUD Amendment; and
WHEREAS, the proposed Preliminary Subdivision Plan in conjunction with the approved
Variance and subject to specific conditions is in general conformance with the Subdivision
Regulations of the Town of Avon; and
WHEREAS, The Town Council finds that the proposed subdivision conforms to applicable
zoning regulations and it takes into consideration:
(1) The Comprehensive Plan;
(2) For Planned Unit Developments, the relevant Planned Unit Master Plan
and the Comprehensive Plan as reflected in the approval of that Planned
Unit Development;
(3) Physical suitability of lots proposed for subdivision; and
(4) Compatibility with surrounding land uses.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF AVON, COLORADO, that the Town hereby finds and determines that the Proposed
Preliminary Subdivision Plan for Dry Creek P.U.D., A Resubdivision of Lot 44, Block 2,
Wildridge, Town of Avon, Eagle County, Colorado is hereby approved subject to compliance
with the following conditions prior to approval of Final Plat:
1) Completion of technical corrections as identified by Town Staff.
2) The submission of acceptable, recorded access easements on Lot 45, Block 2,
Wildridge, Town of Avon, Eagle County, Colorado.
3) The submission of an acceptable recorded agreement for construction, use,
maintenance and snow removal for access easements on Lot 45, Block 2,
Wildridge, Town of Avon, Eagle County, Colorado.
4) The submission and recording of acceptable covenants and by-laws addressing the
construction, use and maintenance of the common access, utility and drainage
easement across Lots 1, 2 and 3.
5) Increase the width of the access, utility and drainage easement across Lots 1, 2,
and 3 to a minimum of 35 feet to provide adequate width for access and drainage
construction and maintenance within the easement.
6) The submission of an acceptable grading and drainage plan showing proposed
drainage facilities.
7) The submission of acceptable access driveway sections complete with asphalt and
shoulder widths and material thickness.
8) The submission of utility plans, approved by the appropriate utility company for
water, sewer, electric, gas, telephone and cable TV for providing service to each
lot.
9) The submission of an acceptable revegetation/landscape plan for disturbed areas
10) All grading, drainage and utility plans shall be signed and sealed by a professional
engineer registered in the State of Colorado.

Eagle County, Colorado - (2510 Old Trail Road)
Summary: Blue Bird Meadow, LLC has submitted an application for a
Subdivision Variance and Preliminary Subdivision Plan approval in conjunction with a PUD
Amendment Application for Lot 44, Block 2, Wildridge. The proposed PUD Amendment
and Subdivision would convert a four-plex lot to three single-family lots. The proposed lots
would be accessed from Old Trail Road by a proposed common access easement extending
across the adjacent Lot 45. Two of the proposed Lots do not have the minimum twenty five
feet of frontage on a public street as required by the subdivision regulations. A variance
approving this condition was approved at the July 26, 2005 Council Meeting by Resolution
No. 05-30.
Following a public hearing, the Planning and Zoning Commission adopted Resolution No.
05-07 recommending approval of the proposed Dry Creek P.U.D. application at their July 5,
2005 meeting subject to: (1) widen driveway to 20 feet to accommodate the Eagle River Fire
Department concerns, (2) reduce the maximum home size(s) from 5,000 square feet to 4,500
square feet for Lot 3 and 4,000 square feet for Lots I and 2, and (3) provide a minimum of
four parking spaces for each residence. Town Council approved Ordinance No. 05-09, An
Ordinance Approving an Amendment to the Wildridge Planned Unit Development (PUD) for
Lot 44, Block 2, Wildridge, Town of Avon, Eagle County, Colorado, on first reading at the
July 26, 2005 meeting.
The proposed Preliminary Subdivision Plan Application should be considered in conjunction
with final action on the proposed Dry Creek P.U.D. application. We recommend Council
table action on this Resolution following presentations of the application and then take action
following final action on the proposed Dry Creek P.U.D.

The attached Resolution No. 05-31 approving the Preliminary Subdivision Plan is based upon
the recommendation of the Planning and Zoning Commission with respect to proposed
M.D., and assumes Town Council approval of Ordinance No. 05-09 on second reading.
Final action on the Subdivision Variance and Preliminary Plan should correspond-with
final action on the Proposed P.U.D. If Ordinance No. 05-09 is approved on second reading,
this Resolution should be approved accordingly. If Ordinance No. 05-09 is not approved on
second reading and PUD approval is denied, this Resolution should be amended accordingly,
prior to approval, to reflect the Council's action to deny approval of the'Preliminary
Subdivision Plan Application. (A Draft of an Amended Resolution for denial of the
Preliminary Subdivision Plan is attached for consideration if that is the desired direction of
Council.)
Discussion: The Preliminary Subdivision Plan and Application for Dry
Creek P.U.D., A Resubdivision of Lot 44, Block 2, Wildridge has been reviewed by Town
staff and with the previous approval of subdivision variance by-Resolution No. 05-30, was
found to be in general conformance with the Town's, Subdivision Regulations subject to the
conditions in attached Resolution No. 05-30. The recommendation for approval is based
upon compliance with the following conditions prior to approval of Final Plat:
1) Completion of technical corrections as identified by Town Staff.
2) The submission of acceptable, recorded'access easements on Lot 45, Block 2,
Wildridge; Town of Avon, Eagle County, Colorado.
3) The submission of an acceptable recorded agreement for construction, use,

Creek P.U.D., A Resubdivision of Lot 44, Block 2, Wildridge, Town of Avon, Eagle County,
Colorado prior to approval.

(2) For Planned Unit Developments, the relevant Planned Unit Master Plan
and the Comprehensive Plan as reflected in the approval of that Planned
Unit Development;
