A RESOLUTION APPROVING A MODIFICATION OF APPENDIX A AND ARTICLE
II - DEFINITIONS IN THE 2005 RULES AND REGULATIONS FOR WATER &
SEWER SERVICE FOR THE TOWN OF AVON, EAGLE COUNTY, COLORADO.
WHEREAS, Eagle River Water and Sanitation District as operating managers for the Upper
Eagle Regional Water Authority has requested approval of a Modification of Appendix A and
Article II - Definitions in the 2005 Water Service Rules and Regulations; and
WHEREAS, the proposed Modification of Appendix A and Article II - Definitions in the Rules
and Regulations are made so that "Common Space" which is currently exempt from tap fees
under certain circumstances will now be subject to tap fees, and to create a definition for
"Circulation Space" which will be exempt from tap fees; and
WHEREAS, the proposed Modification of Appendix A and Article II - Definitions does not
materially change the current Rules and Regulations or Service Fee Rate Structure.
NOW, THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF AVON, that APPENDIX A, TOWN OF AVON, SCHEDULE OF FEES AND CHARGES
EFFECTIVE: JANUARY 1, 2005 and ARTICLE II - DEFINITIONS, REGULATIONS FOR
WATER AND SEWER SERVICE as hereto attached, is hereby approved by the Town of Avon.

APPENDIX A
TOWN OF AVON
SCHEDULE OF FEES AND CHARGES
EFFECTIVE: January 1, 2005
1. Residential Water- Tap Fee
Residential Unit:
Town of Avon Water Tap Fee is $4,000 per unit up to 3,000 square feet, plus $2.00 per
square foot thereafter, plus $2.00 per square foot for a private swimming pool. Floor area
is calculated on the gross square foot measurement to include the outside walls,
unfinished areas, mechanical rooms, and basements over five (5) feet high, excluding
garages, attics and, in a multi-unit or mixed-use facility, circulation space. Customer
shall be required to obtain a letter from an Architect or Engineer certifying the size of the
building using the District's definition of square footage. (Minimum $4,000)
Efficiency Unit:
Town of Avon Water Tap Fee is $2,000 per Efficiency Unit. An Efficiency Unit is a
single room with a bathroom and a cooking facility. "Cooking Facility" is an-
arrangement within a residential unit which provides, but is not limited to, the following
features;,refrigeration capability, hot plate, electrical frying pan, toaster oven, crock pot,
counter top burners, stove or microwave; and facilities -for washing and cleaning.
Accommodation Unit:
Town of Avon Water Tap Fee is $1,400 per Accommodation Unit. An Accommodation
Unit is a room with or without a bathroom, but without a cooking facility with private
access to a central corridor or the outside.
Expansion or Remodel of Existing Residential Units:
Any additions to an existing residential unit will be assessed a tap fee for the additional
square footage over 3,000 square feet based on the tap fee calculations shown above.
2. Commercial Use
Commercial use may be on a separate master meter.or, for mixed uses, may be on the
same meter as the Residential/Hotel units, if the customer provides the District with'an
Engineer's or Architect's assessment of the meter size necessary to serve the commercial
and irrigation fixtures involved. The Town of Avon will consider this assessment in the
District's determination of appropriate meter size. The meter size is determined by the
fixture count assessment according to the Uniform Plumbing Code

ARTICLE II - DEFINITIONS
Unless the context specifically indicates otherwise, the meaning of the terms used herein shall be
as follows:
2.1 Accommodation Unit .
"Accommodation Unit" is one habitable room intended primarily for sleeping purposes
and without a cooking facility. Examples of an accommodation unit area hotel room,
hotel suite, hostel room, bed and breakfast room, or a lock=offwithout a cooking facility.
2.2 Basement
The lowest area within a structure, either partially-or entirely below finish grade with a
finished floor, and intended for continuous habitation.
2.3 Board
"Board" and 'Board of Directors" are the elected or appointed Board of Directors of the
District who has responsibility for policy and management oversight of the water and/or
sewer systems.
2,4 Circulation Space
"Circulation Space" is that space in a multi-unit or mixed-use facility that provides
ingress and egress to residential units located in the facility. Examples of Circulation
Space are hallways, stairways, and elevators not located within Residential Units,
Accommodation Units, or Efficiency Units. Where Circulation Space passes through an
entryway. or lobby, such space shall be deemed to be- a corridor no more than ten (10), feet
in width, or the width of any hallway such corridor leads to, except where a greater width
is required for ingress and egress by a building or fire code.
2.5 Commercial and/or Industrial Unit
"Commercial and/or Industrial Unit" is any structure or facility that is used to engage in a
business, commerce, manufacturing, marketing, and/or sale of products and services of
any kind.
2.6 Connection
2.6.1 Sewer
A sewer connection is defined as a pipe that allows a continuous flow of sewage
from a structure into a District main. -

2.18 Mixed-Use Facility
A "Mixed-Use Facility" is a building containing one or more Residential Units,
Accommodation Units, or Efficiency Units and one or more Commercial Units.
2.19 Multi-Unit Facility
A "Multi-Unit Facility" is a building containing two or more Residential Units,
Accommodation Units, or Efficiency Units.
2.20 Permission to Connect
Permission to Connect is the written permission to connect to or to enlarge the connection
to the water or sewer systems of the District pursuant to the Rules and Regulations.
Permission may be granted by the General Manager, Regulations Administrator or
authorized District representative.
2.21 Pollutant Discharge Regulations
"Pollutant Discharge Regulations" are additional regulations adopted as part of these
Rules and Regulations pertaining specifically to limits on direct and indirect
contributions of toxic or hazardous substances to the wastewater collection and treatment
system of-the District. Compliance by customers is mandatory in accordance with
applicable State and Federal laws.
2.22 Pretreatment Facilities
"Pretreatment Facilities" are structures, devices,' or equipment owned and operated by a
customer for the purpose of treating or removing any substances in the waste discharge
which would be harmful to the District's sewer mains or to the sewage treatment works.
This reduction or alteration can be obtained by physical, chemical, or biological
processes; by process changes; or by other means, except by diluting the concentration of
the pollutants unless, allowed by an applicable Pretreatment Standard.
2.23 Private Main
"Private Main" is any sewer interceptor, collection line, or main line, or any water
distribution line or'main line that is connected to the District -system but not owned or
maintained by, the District;; Private Mains have not been accepted by the District.
Generally, lines are designated as private if they do not conform to the specifications as
enumerated in the Rules and Regulations or construction "standards. Lines, may be
considered private if it is -not in the.best interest of the District to accept the mains
because of special and/or mitigating circumstances; or if the title of th&mains cannot be
transferred free and clear to the District.

Summary: The Upper Eagle Regional Water Authority (UERWA) has requested that
the Town and each of the Member Districts adopt the change in the 2005 Rules and
Regulations (Appendix A and Associated Definitions) as approved by the Board of Directors
as of January 1, 2005. Resolution No. 05-21, Exhibit A, has been drafted in response to that
request made in the form of a Memorandum from UERWA, Exhibit B.
The proposed modifications appear to be more of a housekeeping nature with minimal overall
impact. As such we recommend approval of Resolution No. 05-21, series of 2005, A
Resolution Approving a Modification of Appendix A and Article II - Definitions in the 2005
Rules and Regulations for Water & Sewer Service for the town of Avon, Eagle County,
Colorado.

Changes to 2005 Rules and Regulations and rate changes within the Appendices were approved
by the Upper Eagle Regional Water Authority Board of Directors as of January 1, 1005. I
believe that the individual Metropolitan Districts should be aware of and adopt the minor
changes that was approved by the Board since then in the individual appendices. I have attached
copies of both the proposed and approved appendices for your review - changes are noted in red.
The Board approved changes to the Rules and Regulations of the Authority implementing an
exception to tap fees for "circulation space" that serves residential units in multi-unit or mixed-
use facilities, and removing the exception for "common space".
The following changes have been made to the Rules and Regulations
The method of calculating floor area described in Appendix A for each entity has been
changed to, "Floor area is calculated on the gross square foot measurement to include the
outside walls, unfinished areas, mechanical rooms, and basements over five feet high,
excluding garages, attics and, in a multi-unit or mixed use facility, circulation space."
The definition of "Common Space" has been removed from page 4 of the Rules and
Regulations.
The definition of "Residential Floor Area" has been removed from page 8 of the Rules
and Regulations.
A definition has been added for "floor area". "Floor area is calculated on the gross square

2.23 Private Main
"Private Main" is any sewer interceptor, collection line, or main line, or any water
distribution line or main line that is connected to the District system but not owned or
maintained by the District; Private Mains have not been accepted by the District.
Generally, lines are designated as private if they do not conform to the specifications as
enumerated in the Rules and Regulations or construction standards. Lines may be
considered private if it is not in the best interest of the District to accept the mains
because of special and/or mitigating circumstances; or if the title of the mains cannot be
transferred free and clear to the District.

TOWN OF AVON
SCHEDULE OF FEES AND CHARGES
EFFECTIVE: JANUARY , 2002
1. Residential Water Tap Fee
Residential Unit:
Town of Avon Water Tap Fee is $4,000 per unit up to 3,000 square feet, plus $2.00 per
square foot thereafter, plus $2.00 per square foot for a private swimming pool. AFea is

Customer shall be required to obtain a letter from an Architect or Engineer certifying the
size of the building using the District's definition of square footage. (Minimum $4,000)
Efficiency Unit:
Town of Avon Water Tap Fee is $2,000 per Efficiency Unit. An Efficiency Unit is a
single room with a bathroom and a cooking facility. "Cooking Facility" is an
arrangement within a residential unit which provides, but is not limited to, the following
features; refrigeration capability; hot plate, electrical frying pan, toaster oven, crock pot,
counter top burners, stove or microwave; and facilities for washing and cleaning.
Accommodation Unit:
Town of Avon Water Tap Fee is $1,400 per Accommodation Unit. An Accommodation
Unit is a room with or without a bathroom, but without a cooking facility with private
access to a central corridor or the outside.
Expansion or Remodel of Existing Residential Units:
Any additions to an existing residential unit will be assessed a tap fee for the additional
square footage over 3,000 square feet based on the tap fee calculations shown above.
2. Commercial Use
Commercial use may be on a separate master meter or, for mixed uses, may be on the
same meter as the Residential/Hotel units, if the customer provides the District with an
Engineer's or Architect's assessment of the meter size necessary to serve the commercial
and irrigation fixtures involved. The Town of Avon will consider this assessment in the
District's determination of appropriate meter size. The meter size is determined by the
fixture count assessment according to the Uniform Plumbing Code
