A RESOLUTION ESTABLISHING A HISTORIC PRESERVATION ADVISORY
COMMITTEE FOR THE PURPOSE OF PROMOTING HISTORICAL
PRESERVATION FOR THE TOWN OF AVON, EAGLE COUNTY COLORADO
WHEREAS, the town of Avon would like to appoint a Historic Preservation Advisory
Committee (the "Committee") to help promote public health, safety and welfare through
the protection and preservation of the Town's historic and cultural heritage, as
represented by designated landmarks
WHEREAS, the mission of the Committee will be to protect and enhance the Town's
welfare and economy through the preservation of historical attractions for local residents,
tourists and visitors to the Town, expand public awareness, appreciation and knowledge
of the Town's unique local history, and foster widespread appreciation of and respect for
Avon's historic and cultural heritage
WHEREAS, it is important for the Town to maintain its unique character by recognizing,
preserving and renewing Avon's legacy for present and future generations
WHEREAS, a landmark is defined as a property or structure that is worthy of
rehabilitation, restoration, or preservation because of its historic and architectural
significance
WHEREAS, the Avon Town Council (the "Council") established a Heritage Fund in the
Capital Improvement Projects Budget to appropriate funds used for matching grants from
the private sector in order to preserve historic landmarks
WHEREAS, the benefits of landmark designation include the waiver of building permit
fees, relocation assistance if necessary through the grant program or any other benefits
recommended by the committee and approved by the Council
WHEREAS, the Avon Town Council will appoint a Historic Preservation Advisory
Committee for the purpose of recommending landmarks to the Council for historic
preservation and possible matching fund grants and such other purposes as the Council
shall determine.
WHEREAS, the Committee will consist of five (5) registered electors or property owners
in Avon to serve in 2-year terms
WHEREAS, the Committee will create criteria for landmark designation based upon how
old the property or structure is, a demonstration of strong public benefit and community
support and other characteristics to be defined by the committee
WHEREAS, the Committee will recommend nominations for designation to the Council
and make other such recommendations as requested by the Council.
WHEREAS, the Avon Town Council may by resolution designate historical landmarks
within the boundaries of the town of Avon or outside of Avon if Council deems it
significantly important to .Avon's history and a collaborative effort is established with the
governing entity where the landmark is located
WHEREAS,, once a landmark designation is made, in order to retain the designation, it
shall be maintained to receive reasonable care, maintenance and upkeep appropriate for
the preservation, protection, enhancement, rehabilitation, reconstruction, perpetuation or
use
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF AVON COLORADO, that historic preservation is an important component of the
overall vitality and enhancement of Avon as it moves into the future and we therefore
establish the Avon Historic Preservation Advisory Committee. Avon is proud of its
history and will preserve its heritage.

Re: Historic Preservation Advisory Committee
Summary: Town Council tabled Resolution No. 13-05, "A resolution establishing a
historic preservation committee..." at its April 266' meeting, asking staff to be generic on
landmark designation criteria and incentives, rather relying on the committee to establish
them. Council also asked staff to discuss why landmark designation is important to all parties,
discuss a mission for the committee, allow property owners to be selected for the committee
and to allow structures outside of Avon to be nominated if they are considered significantly
important to our town.
An advisory board be established via resolution pursuant to the Avon Code, Section 11.2 (a)
"Council may create any Boards and Commissions including Advisory and Appeal Boards.
Advisory boards may be created by resolution."
Background: The notion of a historical preservation committee arose from the recent
work on the Nottingham Water Wheel on the Eagle River south of Canyon Run. Staff was
very involved with a citizens' group headed by Jeannette Hix aimed at restoring the wheel.
The process started with Jeannette doing some research at the library where she found a 1980
Eagle Valley Enterprise article about the wheel with a fuzzy picture of how it originally
appeared. The next step for the group included cleaning up the area and applying for a
historical designation through the Colorado Historical Society.
Avon owns the land the water wheel sits on and no special permit was required to begin work.
Norman Wood, Bob Reed and I met with the group the week before the clean-up to discuss
what could be removed. Saturday, September 25, 2004 was the clean-up/clearing out for the
water wheel and many citizens showed up to aid the effort. The town provided the heavy
equipment and labor to haul away several loads of undergrowth and debris.
Regarding the historical dedication, Jeannette submitted a preliminary application and pictures
in early August 2004 to the Colorado Historical Society. The CHS representative said since
the water wheel is in disrepair, and the photos did not reveal enough of the water wheel, they
were unable to determine if all the parts to the water wheel are present, and if the water wheel
is worthy of a nomination for historical recognition.
Instead, Jeannette submitted an application for an archeological grant, which would allow the
group to hire someone to evaluate the water wheel. After the evaluation, the Historical
Society can better determine the possibility of a nomination. The nomination would be for
industrial significance.
It turns out if the town applied for the archaeological grant, there would be a smaller chance of
the grantor requiring matching funds. Avon did apply for the grant in lieu of the private group
to help aid the process and we are currently waiting for a decision from the Historical Society.
Discussion: Staff recommends the following criteria to designate a historical landmark
and will rely on the appointed committee to establish more specific criteria: how old the
property or structure is and a demonstration of strong public benefit and community support
Previous Action: At the budget retreat last year, Council authorized to dedicate
$25K into a Heritage Fund out of Capital projects with the caveat that the money would be
used to match private donations.
