RESOLUTION 03-55
SERIES OF 2003
A RESOLUTION ORDERING A SPECIAL ASSESSMENT AGAINST
TRACT J, BENCHMARK AT BEAVER CREEK
WHEREAS, The Building Official of the Town of Avon, based upon inspection by
Monroe & Newell Engineers, Inc, determined that the building or structure, consisting of a bridge
and abutments, located on Tract J, Benchmark at Beaver Creek, in the Town of Avon, was
dangerous; and
WHEREAS, NOTICE AND ORDER OF THE BUILDING OFFICIAL was served
on the owner of the property on August 29, 2003; and
WHEREAS, compliance with the order has not been had, and no appeal was
properly and timely filed; and
WHEREAS, the Director of Public Works was ordered to proceed with demolition
of the structure by private contract under his supervision; and
Clerk; and
WHEREAS, the report of the Director of Public Works was filed with the Town
WHEREAS, the itemized and total cost of the work was as follows:

Total $26,864.89; and
WHEREAS, notice of a hearing on the report of the Director of Public Works and
any protest or objections thereto has been given; and
WHEREAS, a hearing was held the 9th day of December, 2003, on the report of the
Director of Public Works and any protests or objections thereto in connection with demolition of
the structure; and
WHEREAS, the names and addresses of the persons entitled to notice of the hearing
are as follows:
Grand Eagle Investment Corp.
1453 Birch Street
Denver CO 80220; and
WHEREAS, no written protests or objections were filed by any person interested in
or affected by the proposed charge prior to the time set for the hearing;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the
Town of Avon, Colorado:
1. The correctness of the charge and the report, as submitted by the Director
of Public Works, are confirmed.
2. The charge, in the amount of $26,864.89, is confirmed and assessed
against Tract J, Benchmark at Beaver Creek, Town of Avon, County of Eagle and State of
Colorado, and certified to the County Treasurer Qf Eagle County for collection.
