A RESOLUTION APPROVING THE FINAL PLAT, LAKESIDE
SUBDIVISION, A RESUBDIVISION OF LAKESIDE TERRACE TOWNHOMES,
BENCHMARK AT BEAVER_ CREEK, TOWN OF AVON, EAGLE COUNTY,
COLORADO
WHEREAS, Deutsch, Spillane & Reutzel, P.C., has submitted a Final Plat for Lakeside
Subdivision, A Resubdivision of Lakeside Terrace Townhomes, Benchmark at Beaver
Creek, Town of Avon, Eagle County, Colorado; and
WHEREAS, the Final Plat has been reviewed by the Town. Staff, and
WHEREAS, the Final Plat was found to be substantially in' conformance with Title 16 of
the Avon Municipal Code; and
WHEREAS, the proposed subdivision complies with the requirements for consideration
as a Final Plat.
NOW, THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF AVON, that the Final Plat, Lakeside Subdivision a Resubdivision of
Lakeside Terrace Townhomes, Benchmark at Beaver Creek, Town of Avon, Eagle
County, Colorado, is hereby approved by the Town of Avon subject to:
1. The completion of technical corrections as identified by Town Staff.
ADOPTED THIS 2 4 th DAY OF June 91997.

Re: Final Plat for Lakeside Subdivision (the "Property')
Deer Mr. Mayor:
The undersigned as legal representative of the owners of the Property, hereby
respectfully requests an extension from the Town of Avon until December 15, 1997 in
which to record the final plat for the Property.
The Property was platted June 24, 1997. During the same period, my clients were
pugsuing a PUD for the Property to allow for time share ownership of units within the
de4elopment The PUD was approved on August I2, 1997. Thereafter, my clients began
processing the final plat for signature. The timing of obtaining the signatures was
complicated by the necessity of obtaining the consent of the mortgagees, which after
cogsiderable delay was obtained. The final plat with all necessary signatures was
sul,imitted to the Town in early November and is awaiting final review from the staff prior
to recording.
The delay in submitting the final plat mylar falls squarely with the
owper/applicant. It was our intent to move the two processes (the final plat and the PUD)
togFther, and the fact that the final plat was approved 1'/2 months before the PUD was
approved started the clock running on the final plat earlier than we anticipated. An
extension until December 15, 1997 would be greatly appreciated and will allow the
necessary time for staff to finalize its review.
