A RESOLUTION ESTABLISHING FEES AND POLICY FOR OUT OF DISTRICT FIRE
SERVICES
WHEREAS, the Town of Avon provides fire protection to the greater region through
intergovernmental agreement; and
WHEREAS, that certain portions of Eagle County are unincorporated or do not exist
within a boundary of a fire protection district; and
WHEREAS, that the Town of Avon is the nearest agency with facilities to combat fire
in those unincorporated areas; and
WHEREAS, that no revenue is received from those certain portions of unincorporated
Eagle County through ad valorem taxes; and
WHEREAS, it is the desire of the Town Council of the Town of Avon to recover the cost
of providing certain emergency services to areas outside of its jurisdiction; and
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE TOWN COUNCIL OF
THE TOWN OF AVON:
1. Fire protection services will be offered to out of district property owners at a rate
equivalent to 5.0 mills against the assessed valuation of the property.
2. That the fee will be offered on an annual basis in the first-month of each calendar
year; notifying those owners via mail.
3. Property owners not paying the fee are not guaranteed a response.
4. The Fire Chief of the Town of Avon may exercise discretion in responding to
non-paid properties, considering first the needs and security of the Town and
contracted Metropolitan Districts.
5. If it becomes necessary to respond outside of the contracted service area in order
to prevent catastrophe or conflagration, the Town will invoice the property owner
for the actual costs of suppression and costs of collection.
RESOLVE, further:
1. The Fire Chief of the Town of Avon is authorized to invoice responses to
emergency medical, hazardous materials, automobile accidents and other requests
for assistance that are from properties or areas outside of the contracted area.
2. Citizens who reside in or own property in the Town or one of the entities
contracting for service will not be billed for services rendered outside of the
contracted area.
3. A fee schedule for responses to emergency medical, automobile accidents,
hazardous materials, or other calls other than for structural and wildland fire is
established as follows:

Materials
• A dispatch, materials and equipment fee of $35.00 charged for any non-contracted response.
• Replenishment of materials are billed at cost plus 15%.
Tools and equipment damaged or destroyed are billed at cost to replace or repair plus 15%.
