A RESOLUTION REVERSING THE PLANNING AND ZONING
COMMISSION DECISION TO DENY FINAL APPROVAL TO
THE BEAVER VIEW PROJECTS LOCATED ON LOTS 3 AND 6,
BLOCK 5, WILDRIDGE SUBDIVISION AND THEREFORE
GRANTING APPROVAL FOR THE PROPOSED PROJECT
AS SUBMITTED TO THE TOWN OF AVON JULY 12, 1988
WHEREAS, Otterman and Associates submitted an application
to the Town of Avon referred to as Beaver View East and Beaver View
West for review by the Planning and Zoning Commission per the Town
of Avon Planning and Zoning Commission Design Procedures, Rules, and
Regulations; and
WHEREAS, the application was denied final approval at the
regularly scheduled meeting of the Planning and Zoning Commission
July 19, 1988; and
WHEREAS, Otterman and Associates has appealed the Planning
and Zoning Commission decision to the Town Council in accordance
with the Town of Avon Planning and Zoning Commission Design Procedures,
Rules, and Regulations; and
WHEREAS, the Town Council has reviewed the submitted
documents and hearing record regarding the application and the Planning
Commission decision; and
WHEREAS, the Town Council has determined that the project
design has addressed the Design Considerations and has the following
findings:
- The project design minimizes site impacts to adjacent
properties; and
- The proposed improvements are compatible with site
topography; and

- The visual appearance of the proposed improvements
as viewed from adjacent and neighboring properties
and public ways is compatible with existing and
potential development in the area; and
- The proposed unit sizes and unit mix are compatible
with existing and potential development in the
vicinity.
NOW, THEREFORE, BE IT RESOLVED, the Avon Town Council
hereby finds the proposed project is in conformance with the above
named Design Considerations and Approval Criteria for Fractionalized
Projects and generally finds the project to be a desirable
development in the Town of Avon and disapproves the Planning and
Zoning Commission decision and thereby grants Final Design Review
approval for the Beaver View projects located on Lots 3 and 6,
Block 5, Wildridge Subdivision as submitted to the Town of Avon,
July, 1988, for Final Design Review consideration, subject to the
following conditions:
- Inclusion of laundry rooms.
- Inclusion of inside amenities that would be in the
form of at least one unit on each project that ties
to an outside recreation area of value.
Inclusion of a designated manager's unit.

Appeal of Planning and Zoning Commission Decision to
Deny Final Design Review Approval to Beaver View East
and Beaver View West
As directed by the Town Council and the Town Attorney, I have
prepared a Resolution approving the appeal by Otterman and
Associates and conditioning it with the following:
Inclusion of laundry rooms
Inclusion of designated manager's unit
Consideration of useable open space
