A RESOLUTION APPROVING FINAL PLAT OF THE COMMUNITY SHOPPING CENTER,
A RESUBDIVISION OF LOTS 23 AND 75, BLOCK 2, BENCHMARK AT
BEAVER CREEK SUBDIVISION, AMENDMENT NO. 6, TOWN OF AVON
WHEREAS, Palmer Szymanski Investments, a Colorado General
Partnership has submitted a Final Plat of the Community Shopping
Center, a Resubdivision of Lots 23 and 75, Block 2, Benchmark
at Beaver Creek Subdivision, Amendment No. 6, Town of Avon, Eagle
County, Colorado; and
WHEREAS, the Final Plat has been reviewed by Town Staff
and Town Attorney; and
WHEREAS, the Final Plat was found to be substantially
in accord with the Subdivision Regulations of the Town of Avon;
and
WHEREAS, the proposed subdivision generally complies
with the requirements for consideration as a minor subdivision.
NOW, THEREFORE, BE IT RESOLVED, by the Town Council
of the Town of Avon, that this Final Plat of the Community
Shopping Center is hereby approved as a minor subdivision by the
Town of Avon subject to:
1. Receipt of letters from the appropriate utilities,
including water and sewer, approving of the utility
easement vacation;
2. Review and approval of plat Certificates and
Restrictive Covenants for conformance with Town
Regulations and related agreements by the Town
Attorney.

Final Subdivision Plat - Community Shopping Center
A Resubdivision of Lot 23 and 75, Block 2,
Benchmark at Beaver Creek Subdivision,
Amendment No. 6
Palmer Szymanski Investments, a Colorado General Partnership, has submitted
a Final Subdivision Plat for the Community Shopping Center, a Resubdivision
of Lots 23 and 75, Block 2, Benchmark at Beaver Creek Subdivision, Amendment
No. 6. The plat vacates the existing common lot line and utility easement
between Lots 23 and 75, and establishes a new lot line between the newly
created Tract A and Tract B.
The plat has been reviewed by Town Staff and was found to be in general
conformance with Town of Avon Subdivision Regulations for a minor subdivision.
Resolution 87-15 approves the Final Subdivision Plat for the Community
Shopping Center, a Resubdivision of Lots 23 and 75, Block 2, Benchmark at
Beaver Creek Subdivision, Amendment No. 6, Town of Avon, Eagle County, Colorado,
subject to:
1. Receipt of letters from the appropriate utilities, including water and
sewer, approving of the utility easement vacation; and
2. Review and approval of plat certificates and Restrictive Covenants for
conformance with Town Regulations and related development agreements by
the Town Attorney.
RECOMMENDED ACTION:
1. Public Hearing;

A RESOLUTION FROM THE TOWN OF AVON PLANNING AND ZONING COMMISSION
RECOMMENDING THE AVON TOWN COUNCIL APPROVE A SPECIAL REVIEW USE TO
ALLOW GENERAL COMMERCIAL OFFICES AND PERSONAL SERVICE OUTLETS IN THE
r MOUNTAIN CENTER PROJECT, LOCATED ON LOT 26/27, BLOCK 1, BENCHMARK AT
BEAVER CREEK.
WHEREAS, Vail Building Arts Associates, a Colorado limited
partnership, has filed application with the Town of Avon for approval
of a Special Review Use to allow General Commercial offices and
Personal Service outlets in the Mountain Center project, located on
Lot 26/27, Block 1, Benchmark at Beaver Creek; and
WHEREAS, Lot 26/27, Block 1,.Benchmark at Beaver Creek is
zoned IC (Industrial and Commercial) in which general commercial
offices and personal service outlets may be approved as a Special
Review Use; and
WHEREAS, a.public hearing has been held by the Planning and
Zoning'Commission of the Town of Avon, pursuant to notices required by
law, at which the applicant and the public were given an opportunity to
express their opinions and present certain information and reports
regarding the proposed Special Review Use; and
WHEREAS, following such public hearing and consideration of
such information as presented, the Planning and Zoning Commission finds
as follows:
1. The proposed use otherwise complies with all
requirements imposed by the zoning code;
2. The proposed use is consistent with the objectives
and purposes of the zoning code and the applicable
zoning district;
3. The proposed use is designed to be compatible with
surrounding land uses and uses in the area.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE TOWN OF AVON, COLORADO, THAT:
The Planning and Zoning Commission of the Town of Avon,
Colorado, hereby approves and recommends the Town Council of the
Town of Avon, Colorado, approve a Special Review Use to allow General
Commercial offices and Personal Service outlets in the Mountain Center
Project, located on Lot 26/27, Block 1, Benchmark at Beaver Creek,
subject to:
1. All general commercial office and personal service
outlet uses shall be reviewed and approved by the
Town of Avon Zoning Administrator prior to their
occupancy of the building. No use will be approved
for which the parking requirements for a fully
occupied project would exceed the available on-site
parking. Parking requirements for all uses shall
be calculated in accordance with Chapter 17.24 of
the Avon Municipal Code.
