SERIES OF 1987
A RESOLUTION APPROVING FINAL PLAT OF MOUNTAIN CENTER, A
RESUBDIVISION OF LOTS 26 AND 27, BLOCK 1, TOWN OF AVON,
EAGLE COUNTY, COLORADO, AND FINAL SUBDIVISION PLAT AMENDMENT
NO. 4, BENCHMARK AT BEAVER CREEK
WHEREAS, Vail Building Arts Associates, a Colorado
Limited Partnership and Colorow at Squaw Creek, A Colorado
General Partnership have submitted a Final Plat of Mountain
Center, a Resubdivision of Lots 26 and 27, Block 1, Town of
Avon, Eagle County, Colorado, and Final Subdivision Plat
Amendment No. 4, Benchmark at Beaver Creek; and
WHEREAS, The Final Plat has been reviewed by
Town Staff and Town Attorney; and
WHEREAS, The Final Plat was found to be substantially
in accord with the Subdivision Regulations of the Town of
Avon; and
WHEREAS, the proposed subdivision generally complies
with the requirements for consideration as a minor subdivision.
NOW, THEREFORE, BE IT RESOLVED, by the Town Council of
the Town of Avon, that this Final Plat of Mountain Center is
hereby approved as a minor subdivision by the Town of Avon
subject to:
1. Receipt of a letter from Upper Eagle Valley
Sanitation District agreeing to the vacation of
the utility easement along the common line between
Lots 26 and 27;
2. The completion and execution of all Certificates
in a manner satisfactory to the Town Attorney prior
to filing with the Clerk and Recorder of Eagle
County.

Vail Building Arts Associates and Colorow at Squaw Creek have
submitted a Final Plat for Mountain Center, a Resubdivision
of lots 26 and 27, Block 1, Benchmark at Beaver Creek. The
Plat vacates the common lot line and utility easement between
lots 26 and 27.
The Plat has been reviewed by Town Staff and was found to be
in general conformance with Town of Avon Subdivision Regulations
for a minor subdivision. Resolution No. 87-10 approves the
Final Plat for Mountain Center, a Resubdivision of lots 26 and
27, Block 1, Town of Avon, Eagle County, Colorado, and Final
Subdivision Plat Amendment No. 4, Benchmark at Beaver Creek,
subject to:
1. Receipt of a letter from Holy Cross Electric
Association agreeing to the vacation of the
utility easement along the common line between
lots 26 and 27.
2. The completion and execution of all Certificates
in a manner satisfactory to the Town Attorney
prior to filing with the Clerk and Recorder of
Eagle County.
RECOMMENDED ACTION:
1. Approve Resolution No. 87-10, Series of 1987.

Re: Submittal of Final Plat for Minor Subdivision, Mountain Center
Dear Patricia:
Enclosed, please find twelve copies of the above referenced Final
Plat, Affidavits from most of the affected utility companies and a
check for 860.00. It is requested that this project be heard at
the April 28 Avon Town Council Meeting.
The sole purpose of this Minor Subdivision is to vacate the Lot
line and associated Utility and Drainage Easement common to Lots 26
and 27, so that a_conmercial condominium complex may be constructed
on the site without restrictions imposed by the Lot line and
Easement.
It is my understanding that this submittal is complete, with the
possible exception of Affidavits from remaining utility companies.
Please contact me if additional data is required, or if I may be of
further assistance.

Reference is made to the attached affidavit concerning a utility
easement between Lots 26 &-27, Block 1, Benchmark at Beaver Creek.
Subdivision.
Holy Cross Electric has no ob?ection to vacating the easement and
has executed the attached affidavit. However, Upper Eagle Valley
Water & Sanitation has an underground secondary voltage service
line buried in the easement. The line is owned and maintained by
them. Prior-to easement-vacation, provision must be made for
relocating this line.

A RESOLUTION FROM THE TOWN OF AVON PLANNING AND ZONING COMMISSION
RECOMMENDING THE AVON TOWN COUNCIL APPROVE A SPECIAL REVIEW USE
TO ALLOW AUTOMOTIVE REPAIR (BODY SHOP) ON
LOT 36, BLOCK 1, BENCHMARK AT BEAVER CREEK
WHEREAS, Thomas A. Backhus has filed application with
the Town of Avon for approval of a Special Review Use to allow
Automotive Repair (Body Shop) on Lot 36, Block 1, Benchmark at
Beaver Creek; and
WHEREAS, Lot 36, Block 1, Benchmark at Beaver Creek is
zoned IC (Industrial and Commercial) in which automotive or other
vehicular sales and repair shops may be approved as a Special
Review Use; and
WHEREAS, a public hearing has been held by the Planning
and Zoning Commission of the Town of Avon, pursuant to notices
required by law, at which the applicant and the public were given
an opportunity to express their opinions and present certain
information and reports regarding the proposed Special Reivew Use;
and
WHEREAS, following such public hearing and consideration
of such information as presented, the Planning and Zoning
Commission finds as follows:
1. The proposed use otherwise complies with all
requirements imposed by the zoning code;
2. The proposed use is consistent with the objectives,
and purposes of the zoning code and the applicable
zoning district;
3. The proposed use is designed to be compatible with
surrounding land uses and uses in the area.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND
ZONING COMMISSION OF THE TOWN OF AVON, COLORADO, THAT:
The Planning and Zoning Commission of the Town of Avon,
',olorado hereby approves and recommends the Town Council of.the
Town of Avon, Colorado approve a Special Review Use to allow
Automotive Repair (Body Shop) on Lot 36, Block 1, Benchmark at
Beaver Creek, subject to:
1. No wrecked or damaged vehicles will be parked
on-site unless they are confined to the designated,
storage yard for the project.
