A RESOLUTION APPROVING A SPECIAL REVIEW USE FOR THE UPGRADE
OF AN EXISTING 69KV TRANSMISSION LINE ACROSS PORTIONS
OF SECTION 1, SECTION 2 AND SECTION 12, T5S, R82W OF THE
6TH PM, TOWN OF AVON, EAGLE COUNTY, COLORADO TO A 115KV
TRANSMISSION LINE
WHEREAS, Holy Cross Electric Association, Inc. has
submitted an application for a Special Review Use to allow the
upgrade of that portion of an existing 69KV transmission line
located within the Town of Avon to a 115KV transmission line.
The centerline of said transmission line being more fully
described as:
Commencing at the Center of the SE 1/4 of Sections
Township 5 South, Range 82 West of the 6th P.M.;
thence N00007'06"W 422.87 feet along the 1/6th
line to the true point of beginning of this permit;
thence 589034135"E 340.18 feet; thence N60018124"E
733.10 feet; thence N69033129"E 2310.46 feet;
thence 567016130"E 1231.79 feet; thence S50026'11"E
2364.99 feet; thence S59057118"E 671.37 feet to the
East section line of Section 1 being the end of
this permit section from which the northeast
corner of Section 1, Township 5 South, Range 82 West
of the 6th P.M. bears 500015'58"E 609.01 feet
along the section line; and
WHEREAS, the Planning and Zoning Commission has held
a public hearing on said Special Review Use application and has
determined that the proposed use complies with all requirements
imposed by the Zoning Code, is consistent with the objectives
and purposes of this Zoning Code and the applicable zoning
district, and is designed to be compatible with surrounding land
uses and uses in the area; and
WHEREAS, the Town Council of the Town of Avon, Colorado
has reviewed the proceedings of the Planning and Zoning Commission
and the information presented at the public hearing; and
WHEREAS, the Town Council concurs with findings and
recommendations of the Planning and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED, that the Town Council
of the Town of Avon, Colorado hereby approves the Special Review
Use for the upgrade of the existing 69KV transmission line to
a 115KV transmission line, subject to:
1. That a reasonable and mutually agreeable landscape
plan for Lot 10, Block 1, Benchmark at Beaver
Creek (Metcalf Road Substation Site) be approved
by the Town of Avon and all construction
completed within a six month period;
2. That no existing access roads be enlarged and
no new access roads be constructed under
this Special Review Use;
3. That no land be disturbed until a revegetation
plan has been reviewed and approved by the
Town of Avon;
4. That the two structures shown in revised
locations be installed at the same location
as existing structures to avoid interference
with future road construction in accordance
with previously approved plans;
5. Any design or location changes which may be
required within the Town boundaries as a
result of the Eagle County review and approval
process be resubmitted to the Town Df Avon
for review and approval; and
6. That the existing access road to the transmission
line north of Nottingham Road and West of Metcalf
Road from lots 20 and 21, Block 1, Benchmark
at Beaver Creek, to the second set of structures,
be removed and revegetated.

SUBJECT: Resolution No. 87-3-Special Review Use Electric
Transmission Line Upgrade
The Council tabled this request at its meeting of January
27, 1987, at the request of the applicant, Holy Cross
Electric Association. They requested this action so they
could negotiate a conflict with Mr. William Nottingham,
concerning the alignment of their transmission line across
his property. These negotiations have resulted ina slight
realignment of the transmission line where it crosses the
Town's easterly boundary. The transmission line has also been
adjusted slightly where it leaves the substation.
At their meeting of April 14, 1987, the Eagle County
Commissioners approved a Special Use Permit to construct
the 115KV transmission line between Avon and Eagle-Vail.
Now that the route of the transmission line has been finalized,
Holy Cross Electric is requesting the Avon Town Council approve
their Special Review Use.
At their meeting of May 19, 1987, the Planning and Zoning Commission
approved a landscape plan for the Beaver Creek Substation on
Metcalf Road. Holy Cross Electric proposes to relandscape
the substation, install a new screening material in the security
fence, abandon a drive and entrance on the west side of the
substation and construct a new drive and entrance on the north
side. A large berm will also be constructed north of the new
drive to help screen the substation from Metcalf Road.
Resolution No. 87-3 has been amended to reflect the revised legal
description for the transmission line easement.
If the Town Council concurs with the Planning and Zoning Commission's
action and recommendations, appropriate action would be adoption
of Resolution No. 87-3.

Dear Mr. Grange:
The Board of County Commissioners, at their meeting of
April 14, 1987, approved your application fora special use
permit to construct a 115KV sub-tranmission line between
Avon and Eagle-Vail. The Board of County Commissioners placed
the following conditions on the special use permit:-
1. The applicant must provide Eagle County with a
written statement from the United States Forest Service
which grants the applicant permission to-proceed with
the county permit on National Forest land.
2. The mitigation defined in the United States Forest
Service Environmental Assessment must be-implemented.
3. The applicant must provide Eagle County with a signed
copy of the agreement with the Nottingham Ranch Co.
This letter will be followed with an executed Special Use
Permit. If you have any questions or want to discuss this matter
further, please call or write.

Norm Wood stated that Holy.Cross Electric Association applied for
a Special Review Use to the Planning and Zoning Commission for an
upgrade of an existing line and that that line was recommended for
approval, but was also subject to a condition that if there were
any-changes that would result in the location or design that may
be required within the Town boundaries as a result of the Eagle
County review and approval process that it be resubmitted to the Town
of Avon for review and approval.
Mr. Wood stated that following todays hearing before the Eagle County
Commissioners, she Commissioners directed that this line be looked
at that was beyond the Town boundary. He stated that until that was
resolved, Holy Cross has requested that this item be tabled. This
matter should be clarified by the next meeting.
The Council requested that a representative be available at the next
meeting to address some concerns that the Council had.
Councilman Watkins move to to le Resolution No. 87-3. The motion was
seconded by Councilwoman Harrison and was unanimously carried.
The Town Attorney stated that the Town had been served with a Third
Party complaint on a-law suit pending in the US District Court, which
has been pending since August. He stated that NOTICE was given to
CIRSA insurance carrier. There was a question as to whether CIRSA
would cover the claim. CIRSA is not a claims rude coverage carrier,
but is a coverage of Errors and omissions. and damage occuring during
the policy.
Mr. Dunn felt that the occurance was when the suit was filed in Federal
Court against PPL by Magnet Bank, but CIRSA was not convenienced. He
then reviewed some of the history of PPL's claim with the Council.
He stated he would proceed, if that was the Council's desire, to
defend the Town and also defend Tyree and Associates, which were
acting as the Town's inspector. He stated that he would file a
Motion or answer of whatever seems appropriate on behalf of both the
Town and Tyree & Associates, and would seek to recover attorney fees.
Mr. Dunn stated that FSLIC's Motion to dismiss the whole suit would
be heard January 29, 1987.
Next on the agenda was an update report on the Singletree Golf Course.
The Town Manager stated that he had talked to the Town Manager of Vail,
Ron Phillips. He stated that basically, he would offer to the Town of
Avon, that if the Town wanted to participate in the debt service of the .
Golf Course, $1:: ' for a round. The Town could buy into this sy~z-
and reserve time, and not be treated the same as the Vail Lodging
Community. If there was profit shown on the'Golf Course, then' the
figure would be reduced accordingly. Mr. James stated that he would
look into other alternatives if the Council desired.
This matter would be discussed at a scheduled work session.

Special Review Use
Electric Transmission Line Upgrade
Holy Cross Electric Association, Inc., has applied for Special Review Use
approval to upgrade the existing 69KV transmission line between the substation
on Metcalf Road and the substation in Eagle-Vail. The upgraded transmission
line would follow essentially the same alignment as the existing 69KV line.
The proposed upgrade primarily consists of replacing the existing wood support
structures with steel structures and replacing the existing conductors with
larger conductors. The existing two pole structures will be replaced with a
single steel pole approximately 18 feet taller than the existing structures.
The existing three pole structures will be replaced with a three pole steel
structure approximately 5 feet taller than the existing structures. The
proposed steel structures would be galvanized with a non-reflective color
finish designed to minimize visual impacts.
The Planning and Zoning Commission has held a public hearing on this Special
Review Use application. Following the public hearing the Commission approved
the Special Review Use and recommended Town Council approval.
If the Town Council concurs with the Planning and Zoning Commission action
and recommendations, appropriate action would be adoption of Resolution No. 87-3.
RECOMMENDED ACTION:
1. Adopt Resolution 87-3.

The following action was taken with regard to the above mentioned item:
The Commission adopted Resolution 87-4, recommending Council approve the
Special Review Use for Holy Cross for a power line upgrade from 69KV to 115KV,
from the electrical substation on Metcalf Road, easterly to the Town boundary,
to an electrical substation in Eagle-Vail.
The Commission found that the Special Review Use complied with Section 17.20.020,
Granting of a Special Review Use, and Section 17.20.040, Special Review Criteria.
On the same item, the Commission approved a letter drafted to Susie Vaughn of
the Eagle County Planning Department regarding the Holy Cross power line
upgrade regarding the power line beyond the Town boundaries.
This Special Review Use request will be forwarded to Town Council for action
and consideration at their meeting on January 27, 1987.

INTRODUCTION:
Holy Cross Electric Association, Inc. has applied for Special Review Use approval
to-upgrade an existing electric transmission line from 69KV to 115KV. This
existing transmission line runs from the electrical substation on Metcalf Toad
easterly to the Town boundary and then beyond the Torn boundary to an electrical
substation in Eagle-Vail. The line proposed for upgrade is the southerly line
of the two existing-lines.
The proposed alignment generally follows the same alignment as the existing line.
The plans submitted with the application indicate a relocation of only two
support structures. The existing wooden support structures will be replaced
with steel support structures. Support structures on tangent sections will
consist of single steel poles, and structures at angle points will consist of
three steel poles. The typical tangent section structures are shown as 70 feet
tall which is 18 feet taller than the existing two pole structures. The typical
angle point structures are shorn as 57 feet tall which is 5 feet taller than the
existing three pole structures.
Steel structures are to be galvanized with a color finish designed to minimize
visual impact. A sample is to be presented at the meeting for evaluation.
Conductors are to have a non-reflective surface to minimize visual impact
between support structures.
STAFF COMMENTS:
Plans submitted with the application have been-reviewed primarily to evaluate
visual impacts of the proposed upgrade. Based upon this review, Staff feels the
visual impact of the proposed upgrade will not increase significantly. In some
areas the impact may be reduced somewhat by the use of single pole structures
in place of the current two pole structures. Alternate locations were also
considered in this review and it does not appear that the visual impact of the
project would be reduced significantly within the Town boundaries through
relocation of the line.
The plans were also reviewed for compatibility with the Wildwood and Buck Creek
Road plans. It appears that the two revised structure locations may conflict
with the approved roadway plans. The existing structures are shown as being
located outside the roadway construction limits and the proposed structure
locations appear to be within the construction limits.

Other items which should be adc:_-_z:,ed in the review of this application include
the possible expansion of existing access roads or construction of new access roads
required for construction of the project. These should be prohibited or treated
as a separate review process. Revegetation of all disturbed areas is also very
critical due to the erosion potential of this project. .These particular items
become especially critical in view of the applicants past performance in
related areas:
A landscape plan for the substation on Metcalf Road was approved by the
Design Review Board in October of 1980. The resultant landscaping does not
fully conform with the approved plan, and the subsequent results resemble an
excess excavation disposal site rather than a landscape project.
A Special Review Use for the upgrade of an existing transmission line
between the Wolcott Substation and the Metcalf Road Substation was approved
in March of 1983. One of the conditions of that approval was:
"That the existing access road to the existing transmission line
which is visible from Metcalf Road be removed and revegetated
after the proposed line is installed within the Town of Avon".
Installation of the proposed line is complete. No visible effort to remove the
access road and revegetate the area has been made.
The location of the project beyond the Town boundaries is not a part of
this application. This is not to say that this is not an area of concern.
The most visible portion of the line is located east of the existing Town
boundary.. However, this area does have potential for future annexation and
development as well as being highly visible from the main entryway to the Town.
Approval for this portion of the project will be by Eagle County rather than
the Town of Avon. It would be appropriate for the Town to express its concerns
regarding the line location through this area and request that Eagle County take
this into consideration in the review of the project.
STAFF RECOMMENDATIONS:
Staff recommends approval of the Special Review Use application subject to the
following conditions:
1. That the existing access road to the existing transmission line which is
visible from Metcalf Road be removed and revegetated as required by the
Special Review Use approved March 22, 1983;

2. That a revised landscape plan fo; 10, Block 1, Benchmark at Beaver
Creek (Metcalf Road Substation) be approved by the Town of Avon and all
construction completed prior to issuance of a construction permit for
the transmission line upgrade as per this Special Review Use application;
3. That no existing access roads be modified and no new access roads be
constructed;'
4. That no land be disturbed until a revegetation plan 'has been reviewed
and approved by the Town of Avon;
5. That the two structures shown in revised location be installed in the
same location as existing structures to avoid interference with future
road construction in accordance with approved plans;
6.. Any changes with the Town boundary which may be required as a result of
.,the Eagle County review and approval process be resubmitted to the Town
of Avon for review and approval.
Resolution No. 87-4 is attached for your consideration. If the Commission
concurs with the Staff Recommendations, the corresponding action can be taken
by the adoption of Resolution No. 87-4. If the Commission does not concur with
Staff Recommendations, the Resolution can be modified accordingly.
In addition, Staff also recommends that -a letter be addressed to the Eagle County
Planning Department expressing concerns regarding the transmission line
location outside the current town boundaries. A suggested letter is attached
for your consideration.
RECOMMENDED ACTION:
1.. Introduce application;
2. Presentation by applicant;
3. Public Hearing;
4. Commission action on Resolution No. 87-4.

INTRODUCTION:
At-the Planning and Zoning Commission meeting of January 20, 1987, the Commission
adopted Resolution 87-4, recommending Council approval of a Special Review Use to
allow Holy Cross Electric Association, Inc. to upgrade an existing 69 KV power
line to 115 KV. The Special' Review Use was approved by the 'Planning and Zoning
Commission subject to several conditions. In this review, we are dealing with
condition No. 1 which reads "That a resonable and mutually agreeable landscape
plan for Lot 10, Block 1, Benchmark at Beaver Creek be approved by the Town of
Avon and all construction completed within a six month period".
Town Staff has worked closely with representatives from Holy Cross Electric and
we have arrived at what-we feel, is a mutually agreeable plan for the substation.
Improvements include:
1. Replacing the slats in the-fence with a new colored plastic material;
2. Relocating parts of the existing security fence to accommodate truck
traffic within the yard; -
3. Closing one drive and entrance on the west side of the substation, and
adding a drive and entrance on the north side of the substation;
4. A large berm is proposed along the north side of the property;
5. Numerous trees and shrubs are planned along Metcalf Road;
6. Most of the existing rocks that were previously placed for landscaping
will be removed.
Staff feels that the plan is acceptable. The Town has made a commitment to
maintain the landscaping, but we do. not feel that sod, irrigation, etc. is
appropriate. The grass and plantings have been planned in such a way that they
can be maintained easily by the Town crews. Staff recommends approval of this
landscape plan.
Holy Cross Electric is also requesting approval of a long-term plan for the
substation which addresses further expansion of the substation to the east.
This does not constitute a large addition to the substation, but it will require
construction of a retaining wall and some regrading.

RE: Relandscaping of Beaver Creek Substation
Dear Mr. Wright:
Attached are drawings showing Holy Cross Electric's plans to
relandscape the Beaver Creek Substation, as required by the Town
of Avon Planning Commission.
Since this plan is a condition of our special review use for
upgrading the existing 69 KV line to 115 KV between Beaver Creek
and Dowd Junction, we must condition performing the work upon
receiving approval of that special review use. If we can receive
all the required approvals and permits in a timely manner, we
will proceed with the relandscaping during this construction
season.
Our work will include but not be limited to, plantings,
construction of berms, relocating the upper driveway and portions
of the substation security fence, and replacing the slatting in
the fence with a new colored plastic material.
The long range plan for grading and land use within the
substation shall be a part of this approval. The retaining wall,
which is a part of the long range plan, shall be designed by a
professional engineer at the time of construction and shall be of
sufficient strength to withstand the anticipated loads.
Construction shall be of poured concrete with a sacked finish on
all exposed wall sections. Construction of the long range plan
is anticipated within fifteen (15) years.
