A RESOLUTION APPROVING FINAL PLAT OF THE YACHT CLUB,
LOCATED IN THE NW 1/4 OF THE SE 1/4 OF SECTION 12,
T5S, R82 W OF THE 6TH P.M., TOWN OF AVON, EAGLE COUNTY,
COLORADO
WHEREAS, the Roupp Group,a Colorado General Partnership,
has submitted a Final Plat of the Yacht Club, located.in.the
NW 1/4 of.the SE 1/4 of Section 12, T5S, R82 W of the 6TH P.M.,'
Town of Avon, Eagle County,-Colorado; and
WHEREAS, the Final Plat has been reviewed by Town Staff,
and Town Attorney; and
WHEREAS, the Final Plat was found to be substantially
in accord with the Subdivision Regulations of the Town of Avon;
And
WHEREAS, the proposed subdivision generally complies
with the requirements for consideration as a minor subdivision.
NOW, THEREFORE, BE IT RESOLVED, by the Town Council of
the Town of Avon, that this Final Plat of the Yacht Club is
hereby approved as a minor subdivision by the Town of Avon
subject to:
1. The completion and execution of all Certificates
in a manner satisfactory to the Town.Attorney
prior to filing with the Clerk and Recorder of
Eagle County.
2. Execution of a subdividers agreement providing for
public use of Tract A and outlining conditions for
Transfer of Tract A to the Town of Avon.

SUBJECT: The Yacht Club - Final Plat
Resolution No. 86-17
The Roupp Group, a Colorado General Partnership has submitted
a Final Plat for the Yacht Club. The proposed subdivision is
for the White property which was included in the Selby/White
Annexation. The submittal included a topographic map of the
area, drainage report, soils and geology report, letters from
the various utility companies stating that the required utility
services are available to the subdivision and a letter from the
Eagle River Fire Protection Districts stating there is fire
protection for the area.
This submittal generally meets requirements for consideration
as a minor subdivision. Staff review of the maps and reports
did not reveal any conditions indicating the subdivision will
create hazards or lots which will not contain safe, adequate
building sites. The Final Plat conforms with the zone district
boundaries established by ordinance 86-20.
RECOMMENDED ACTION:
1. Adopt Resolution 86-17 approving the Final Plat of the
Yacht Club as a minor subdivision.

With regard to questions and comments raised at the August_ 26-
Town Council meeting about the subdivision.and zoning for The
Yacht.Club, I thought that I might offer. some points of clari-
fication which may be helpful and assist you with regard.to
same.
First may I state that The'Roupp Group appreciates the oppor=
tunity to develop a project in Avon that we feel is,-unique and
striking in its architecture and will enhance the,,Lentire.valley.
We have spent considerable time and effort to devel<p-buildings. -
that,work with a very delicate and difficult. site:`,Furthermore
we are very concerned about.densities and heightstcf the project
understanding that when a project of this size and scope is
built we all have to live with it.
With that in mind we have worked diligently with Norman'Wood and
the Planning and zoning Commission and-based upon their'recom-
mendations have written a new ordinance which pinpoints building
heights and the mass of the project. Our building does meet the
standard ordinance as written, with an average height of 47 feet
when measured every twenty lineal feel- of wall then averaged.
The current ordinance would feasibly allowa building 500 feet
long with a uniform height not to exceed sixty feet. We felt
that the new ordinance would force any developer to be creative
in their design.. In our particular situation it has created a
building mass that does have some-towers which are 68 feet.above
the street, but the bulk of the project being*a.low profile
linear.-building which is 10 to 12 feet above street level. This
approach has allowed The Roupp.Group "to soften any impact a pro-
ject of this size would-have on surrounding properties. We have
spoken with adjacent property owners and have come to the conclu-
sion that they agree with our approach.

As to the densities involved, the Selby/White property when
annexed to the Town of Avon was also given conceptual appro-
val for up to eighty-one thousand square feet of building and
44 residential development rights. This equates to an average
of 20 units per acre. This was consistent with conceptual
approvals given for the Folsom property and Nottingham Asso-
ciates. Eagle Bend has been given formal approval for a mixed-
use project with twenty units per acre density. When The Yacht
Club subdivision was originally presented to the Avon Planning
and Zoning Commission, the plat was done as a single lot sub-
division with 2.29 net developable acres. We had asked for 31
development rights, feeling that this was less than what had
originally conceptually been approved. Based off staff recom-
mendations we changed our plat to three lot subdivision allow-
ing for Tract A, a 1.91 acre parcel to be dedicated to the Town
of Avon as open space; Lot 1, 1.28 acres with 20 residential
development rights; and Lot 2, .37 acres with eight residential
development rights which may not be fractionalized. After com-
plying with these staff recommendations, The Roupp Group was
given unanimous approval by the Planning and Zoning Commission
for the three lot subdivision, proposed densities, heights and
uses.
It is our feeling that the requested densities, heights and uses
are more than consistent with all surrounding properties and
that the densities on The Yacht Club, in reality are much less,
thirteen units per acre.
The Roupp Group would like to arrange for future dedication of
Tract A when the Town of Avon is ready or has the desire. Fur-
thermore we are prepared to maintain the property for the bene-
fit of the Town and the public.

In closing I would like to thank the Mayor and Council for their
consideration of both our project and this letter. I would assure
you that we are not speculating on ground and that with your ap-
proval we intend to go forward with this project first thing in
the spring, with anticipated buildout of The Yacht Club by January
of 1988.
