A RESOLUTION APPROVING A PRELIMINARY PLAT FOR THE FALCON POINTE
LODGE, LOT 45, A REPLAT AND RESUBDIVISION OF LOTS 45 AND 46, BLOCK
2, TOWN OF AVON, EAGLE COUNTY, COLORADO, AND FINAL SUBDIVISION,
AMENDMENT No. 4 - BENCHMARK AT BEAVER CREEK
WHEREAS, ALV Venture, a Colorado Limited Partnership, has
submitted a Preliminary Plat for Falcon Pointe Lodge, Lot 45, A
Replat and Resubdivision of Lots 45 and 46, Block 2, Town of Avon,
Eagle County, Colorado, and Final Subdivision Plat - Amendment No.
4, Benchmark at Beaver Creek; and
WHEREAS, the Preliminary Plat has been reviewed by the Town
Staff and the Town Attorney and found to be substantially in accord
with the Subdivision regulations for the Town of Avon, and is
recommended for approval.
NOW, THEREFORE, BE IT RESOLVED, by the Town Council of the
Town of Avon, that this Preliminary Plat is hereby approved subject
to:
1. The Condominium Declarations, By-Laws, and Articles of
Incorporation be submitted for review and approval by
the Town Attorney prior to submittal or Final Plat; and
2. Review and approval of an
Agreement prior to submittal of

SUBJECT: Preliminary Plat, Falcon Pointe Lodge; Resolution No. 86-4
The Preliminary Plat for Falcon Pointe Lodge - Time Share has been
reviewed by Town staff and found to be in general conformance with
Town regulations. Appropriate fees have been paid and the required
notices of public hearing have been mailed and posted.
Condominium Declarations, By-Laws and Articles of Incorporation have
not been submitted at this time. These should be submitted prior
to completion of Final Plat to allow adequate time for review. A
review of the Subdivision Agreement is not compl&te at
this time. Details in this Agreement should also be resolved prior
to submittal of Final Plat.
Resolution No. 86-4 approves the Preliminary Plat for Falcon Pointe
Lodge subject to the submission of Condominium Declarations, By-Laws
and Articles of Incorporation and approval of an appropriate Subdivision
Agreement prior to submittal of Final Plat.
Recommended Action :
1. Conduct Public Hearing on Preliminary Plat.
2. Adopt Resolution No. 86-4

A RESOLUTION FROM THE TOWN OF AVON PLANNING AND ZONING COMMISSION
RECOMMENDING THE AVON TOWN COUNCIL APPROVE A SPECIAL REVIEW USE
TO ALLOW AUTOMOTIVE REPAIR (BODY AND FRAME SHOP) ON
LOT 11, BLOCK 1, BENCHMARK AT BEAVER CREEK
WHEREAS, Robert Warner, Jr., dba Metcalf Ventures, has
filed application with the Town of Avon for approval of a Special
Review Use to allow Automotive Repair (Body and Frame Shop) on
Lot 11, Block 1, Benchmark at Beaver Creek; and
WHEREAS, Lot 11, Block 1, Benchmark at Beaver Creek is
zoned IC (Industrial and Commercial) in which automotive or other
vehicular sales and repair shops may be approved as a Special
Review Use; and
WHEREAS, a public hearing has been held by the Planning
and Zoning Commission of the Town of Avon, pursuant-to notices
required by law, at which the applicant and the public were given
an opportunity to express their opinions and present certain
information and reports regarding the proposed Special Review Use;
and
WHEREAS, following such public hearing and consideration
of such information as presented, the Planning and Zoning
Commission finds as follows:
1. The proposed use otherwise complies with all
requirements imposed by the zoning code;
2. The proposed use is consistent with the objectives
and purposes of the zoning code and the applicable
zoning district;
3. The proposed use is designed to be compatible with
surrounding land uses and uses in the area.

NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND
ZONING COMMISSION OF THE TOWN OF AVON, COLORADO, THAT:
The Planning and Zoning Commission of the Town of Avon,
Colorado hereby approves and recommends the Town Council of the
Town of Avon, Colorado approve a Special Review use to allow
Automotive Repair (Body and Frame Shop) on Lot 11, Block 1,
Benchmark at Beaver Creek, subject to:
1. Design review approval of building and site
development plans specifically designed for the
proposed use.
