A RESOLUTION OF THE AVON TOWN COUNCIL DECLARING ITS
OPPOSITION TO THE STORAGE AND TRANSPORTATION OF
RADIO-ACTIVE SUBSTANCES AND OTHER HAZARDOUS 14ATERIALS
IN THE TOWN-OF AVON AND ALONG INTERSTATE HIGHWAY I-70
WHEREAS, the Town of Avon, Colorado, is a home rule
municipality existing under and by virtue of the Constitution
and laws of the State of Colorado with all of the powers conferred
thereby; and
WHEREAS, the Town of Avon;has received an application
from the Commonsense Coalition, Paul M. Crawford, to enact
legislation declaring the.Town of Avon as a "Nuclear-Free Zone"; and
WHEREAS, the Town of Avon finds that contamination
by radio-active and other hazardous substances, by accident or
intent, presumptively.interferes with the tourist and
residential character of the Town of Avon and would have an
adverse effect.-,on the residents, visitors, businesses and
wildlife, in the Avon area; and
WHEREAS, because Interstate Highway I-70 is the main
ground-route for visitors and inhabitants traveling to and
from Avon, the Town Council also opposes the transportation
of radio-active and other hazardous substances along Interstate
Highway I-70; and
WHEREAS, the Town Council is aware that certain court
decisions have limited the-Ability of local governments to ban
or regulate the transportation and storage of radio-active and
other hazardous materials on state and federal highways; and
WHEREAS, the Town Council desires to declare its
opposition to the storage and transportation of radio-active
and other hazardous materials in the Town of Avon and along
Interstate Highway I-70, and therefore desires that the Town
Manager and Town Attorney recommend a program for prohibiting
or regulating the storage and transportation of radio-active
and other hazardous materials in the Town consistent with the
Town's legal authority in such matters.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF
THE TOWN OF AVON, COLORADO:
Section 1. The Town Council of the Town of Avon,
Colorado, hereby declares its general opposition to the storage
and transportation of radio-active substances and other
hazardous materials in the Town of Avon and along Interstate
Highway I-70.
Section 2. The Town Manager and Town Attorney are
hereby directed to.develop a work program for making recommen-
dations to determine what positive steps the Town Council can
take to prohibit or regulate the storage and transportation
of radio-active''and other hazardous substances'in the Town
of Avon.
Secti6n_3.':The Town Clerk shall certify a copy of this
resolution_.to the Governor of the State of Colorado, and.such
other local, state and federal officials, as the Town Manager
may-deem appropriate.
INTRODUCED, READ, PASSED, AND ADOPTED at a regular
meeting of the Council of the Town of Avon, Colorado, held
on February 12, 1985.
