SERIES OF 1984
A RESOLUTION APPROVING A REPLAT OF LOT 30 AND LOT 31, BLOCK
#2, BENCHMARK AT BEAVER CREEK, TOWN OF AVON, COUNTY OF EAGLE, STATE
OF COLORADO.
WHEREAS, Sunroad Group Ltd., a California Limited Partnership
and First Bank Holding Company of Colorado, a Colorado Corporation
have submitted a Final Plat for Lot 30 and 31, Block #2, Benchmark
at Beaver Creek, Town of Avon, County of Eagle, State of Colorado,
a Replat of Lot 30 and Lot 31, Block #2, Benchmark at Beaver Creek,
Town of Avon, County of Eagle, State of Colorado; and
WHEREAS, the Final Plat has been reviewed by the Town Engineer
and Town Attorney, and found to be substantially in accord with
the Subdivision Regulations of the Town of Avon, and is recommended
for approval.
NOW THEREFORE BE IT RESOLVED, by the Town Council of the Town
of Avon, that this Plat is hereby approved by the Town of Avon
subject to:
1. The Title Insurance Company or Attorney's Certificate
be completed and signed in a manner satisfactory to
the Town Attorney.
2. The Certificate of Dedication and ownership be executed
in a manner satisfactory to the Town Attorney.
3. The Certificate of Dedication and Ownership be revised
to address the access easement in a manner satisfactory
to the Town Attorney.
4. Letters, Quit Claim Deeds or other evidence from all
local utility companies indicating their concurrence
with the relocation of existing utility easements be
submitted for review and approval by Town Attorney.
5. The Plat be modified to clarify the assignment of
Transferable Development Rights on Lot 30 and Lot 31,
Block #2, Benchmark at Beaver Creek.
6. The access easement width be increased to a total
width of 50 feet.
7. This approval shall terminate 60 days from the date
of this Resolution, if the above actions are not com-
plete or Plat is not submitted for Town Approval by
that date.

Replat, Lot 30 and Lot 31, Block #2,
Benchmark at Beaver Creek
The purpose of this Plat is to relocate the common property line
between Lots 30 and 31. The common lot line is being moved 50
feet westerly increasing the area of Lot 30 and decreasing the
area of Lot 31.
This qualifies as a Minor Subdivision, thus, the shorter review
process has been followed.
This Plat has been reviewed by the Town's Engineer and Attorney
and found to be substantially in accordance with Subdivision
Regulations of the Town, with the following exceptions:
1. The execution and completion of various certificates;
2. Modification Certificate of Dedication and Ownership
to clarify use and responsibilities related to access
easement;
3. Provision of documentation from local utility companies
approving relocation of utility easements;
4. The addition of a note to the Plat clarifying the assign-
ment of Transferable Development Rights to Lot 30 and Lot
31;
5. It is recommended that the access easement have a minimum
total width of 50 feet rather than the 40 feet provided.
In order to assure that these conditions are net in a timely
manner, we are recommending the approval expire in 60 days if
the above actions are not complete within that time frame.
