A RESOLUTION GRANTING A SPECIAL REVIEW USE FOR
TIME SHARING 103 RESIDENTIAL UNITS OF PEREGRINE VILLAGE,
LOCATED ON LOT 63, BLOCK 2, BENCHMARK AT BEAVER CREEK
WFEREAS, Peregrine Properties Realty, Inc. as agent for PPL
Development Corporation has requested a Special Review Use for
Time sharing 103 residential units of Peregrine Village, located
on Lot 63, Block 2, Benchmark at Beaver Creek Subdivision; and
WHEREAS, the Planning and Zoning Commission has held
a public hearing and has determined that the proposed use:
1. otherwise complies with all requirements imposed
by the Zoning Code; and
2. is consistent with the objectives and purposes of
the Zoning Districts; and
3. is deemed compatible with the surrounding land
use and uses in the area;
Subject to:
1. Compliance with open space requirements of
the Town of Avon Zoning Code.
NOW THEREFORE BE IT RESOLVED THAT the Town Council
hereby approves the Special Review Use request for time sharing
103 residential units of Peregrine Village, Lot 63, Block 2,
Benchmark at Beaver Creek Subdivision, subject to:
1. Compliance with open space requirements of
the Town of Avon Zoning Code.

Gentlemen:
On September 13, 1584 the Planning and Zoning Commission
approved a Special Review Use for time sharing 103
residential units for Peregrine Village.
A Special Review Use requires final action by the Town
Council.
At its regular meeting of September 25th, the Avon Town
Council approved a Special Review Use request for time
sharing 103 residential units of Peregrine Village, Lot 63,
Block 2, Beaver Creek Subdivision.
Approval was given with the condition that Peregrine Village-would
have to comply with the open space requirements of the
Town of Avon zoning code. In addition to that, Peregrine
Village will still have to comply with the,Subdivision
Regulations of the Town of Avon.

Dear Commission:
Peregrine Properties Realty, Inc., as agent for PPL Development
Corporation, hereby requests the review of a Special Review
Use for Peregrine Village Condominiums, Lot 63, Block 2, Town
of Avon, Eagle County, State of Colorado.
While it is our intent to initially sell condominium units
on a fractional fee basis, we would like to proceed with
approval for all 103 condominium units.
Since fractional fee estate falls under the definition of
timeshare we would ask for approval under"the timeshare
subdivision regulations.
Enclosed for'example, is a sample addendum to a purchase
contract for fractional fee.
As this item should be heard in a public hearing on September
13, 1984, I will be in attendance and available to answer any
and all questions in regards to the above.

Lot 63, Block 2, Benchmark at Beaver Creek Subdivision
At the September 13, 1984 Planning and Zoning Commission meeting, the Commission
approved a Special Review Use for time sharing 103 residential units at
Peregrine Village, Lot 63, Block 2, Benchmark at Beaver Creek-Subdivision.
Approval. was given with the condition that Peregrine Village comply with the
open space requirements of the Town of Avon Zoning Code.
A Special-Review Use requires final action by the Town Council. The final
action may be granting, denying or granting with conditions identical to, or
different from those prescribed by,the Planning and Zoning'Commission.
In approving a Special Review Use, the Town Council may prescribe appropriate
conditions and safeguards in conformity with the zoning laws of the Town.
Resolution Plumber 84-38 provides for approval of the Special Review Use
with the condition as prescribed by the Planning and Zoning Commission.

A RESOLUTION REPEALING
RESOLUTION NO. 84-38
WHEREAS, Resolution No. 84-38 approved a special
review use for timesharing 103 residential units on Lot 63,
Block 2, Benchmark at Beaver Creek Subdivision; and
WHEREAS, no application for approval of a
time-share subdivision for said Lot 63 has been made to the
Town pursuant to chapter 16.36 of the Municipal Code of the
Town;
NOW, THEREFORE, BE IT RESOLVED that Resolution
84-38 is hereby repealed.
