A RESOLUTION GRANTING'A
SPECIAL REVIEW USE FOR REDUCTION
IN PARKING REQUIREMENTS FOR
SUNRIDGE II, LOTS 1 & 2, BLOCK 3
BENCHMARK AT BEAVER CREEK
WHEREAS, Sunridge at Avon II Condominium Association has
requested a Special Review Use for a reduction in parking space
requirements to allow construction of a clubhouse on Lot 1, Block 3,
Benchmark at Beaver Creek; and
WHEREAS, the Planning and Zoning Commission has determined
that the reduction in parking requirements from 307 spaces to 272
spaces;
(1) complies with all requirements imposed by the Zoning
Code,
(2) is consistent with the objectives and purposes of
this Zoning Code and the applicable zoning district,
(3) will be compatible with surrounding land uses and
uses in the area,
subject to,
use of the clubhouse and facilities restricted to owners,
tenants and guests of Sunridge at Avon Phase II only, and no
commercial operation be allowed without additional review and
approval by the Planning and Zoning Commission.
NOW THEREFORE BE IT RESOLVED that the Town Council hereby
approves the reduction in parking space requirements from 307 spaces
to 272 spaces to allow construction of a clubhouse on Lot 1,
Block 3, Benchmark at Beaver Creek subject to the following;
(1) use of the clubhouse and facilities shall be restricted
to owners, tenants and guests of Sunridge at Avon
Phase II only, and:no commercial operation of the
facilities will be allowed without prior review and
approval by the Planning and Zoning Commission.

At the May 24, 1984 Planning and Zoning Commission meeting, the Commission
approved a Special Review Use fcr a reduction in parking requirements from
307 parking spaces to 272 spaces for Sunridge at Avon Phase II, Lot 1, Block
3, Benchmark at Beaver Creek to allow construction of a clubhouse.
Approval was conditioned upon the use of the clubhouse and facilities being
restricted to owners, tenants and guests of Sunridge at Avon Phase II only,
and no commercial operation be allowed without additional review and approval
by the Planning and Zoning Commission.

Special Review Use - Parking Requirement Reduction
Lots 1 & 2, Block 3, Benchmark Subdivision
This Special Review Use request is for a reduction in-parking space requirements
to allow construction of a clubhouse for Sunridge at Avon,-Phase II. In
accordance with Section 17.-24:020.B of the Avon Municipal Code,.parking
requirements may be reduced up'to 15% for large lots having 250 spaces or more,
as a Special Review Use.
The proposed clubhouse is intended to serve only the residents of Sunridge II
and is located on a portion of the current parking lot on the westerly,side of
Beaver'Creek Boulevard. There are a total of 198 units in the Sunridge Phase II
project with 143 units on the westerly side and 55 units on the easterly side of
Beaver Creek Boulevard. With the proposed clubhouse and parking lot layout,
there are 272 spaces on the.westerly-site and 110 spaces on-the easterly site.
Parking requirements for this project are calculated as follows:

In approving a Special Review Use, the Planning and Zoning Commission shall make
a finding-that the following conditions are satisfied by the reasons set forth
in the application and that granting the Special Review Use will make possible
the reasonable use of the land, all in accordance with Section 17.020.030 of the
Avon Municipal Code:
1. The Planning and Zoning Commission shall hold a public-hearing on the
Special Review Use;
2. Notice of the public hearing shall be published and written notice shall
be mailed.to all property ,owners within the area and within 300 feet thereof
at least 12 days prior to the hearing date;
3. The applicant shall paya fee of $50.00 plus actual costs of notification.

In accordance with Section 17.20.020 of the Avon Municipal Code: In considering
the suitability of the Special Review Use, the Board shall determine:
1. Whether the proposed use otherwise complies with all requirements imposed
by the zoning code;
2. Whether the proposed use is consistent with the objectives and purposes
of this zoning code and the applicable zoning district; and
3. Whether the proposed use is designed to be compatible with surrounding
land uses and uses in the area.
In approving a Special Review Use, the Planning and Zoning Commission may
prescribe appropriate conditions and safeguards in conformity with zoning laws
of the Town. The following condition may be appropriate in this Special Review
Use:
1. Use of the clubhouse and facilities restricted to owners, tenants and guests
of Sunridge at Avon - Phase II.

We have enclosed the notification documents as required for the Special Review
Use Hearing we would like to have scheduled for May 24, 1984. The calculations
we used to determine the percentage of reduction necessary are as follows:
198 Units @ 2 spaces per unit = 396

While the percentage of reduction requested appears to be close to the maximum
permitted, we feel the actual impact is much less. As indicated in the "Notice
of Public Hearing" the clubhouse is to be used primarily by owners, tenants and
guests of the project. Although we are requesting a_ 13.12% reduction we feel
the "real impact" can be considered as:
396 spaces - @ 2 spaces per unit
10 spaces - guest parking
406 spaces required for condominium units
384 spaces provided
22 space reduction = 5.42% reduction

ordinance a 13.12% reduction is-required. The
maximum reduction permitted by 17.24.020.8 for
parking lots over 250 spaces is 15%. Since the
clubhouse is to be used primarily by owners,
tenants and guests of the project the impact of
the 13.12% reduction will be minor because the
additional spaces required by the clubhouse are
included in the calculations of the-reduction
percentage.
