A RESOLUTION GRANTING A
DENSITY TRANSFER OF 2 UNITS
FROM LOT 1, BLOCK 3, WILDRIDGE SUBDIVISION TO
LOT 56, BLOCK 2, WILDRIDGE SUBDIVISION
WHEREAS, Coyote Construction and Development, has requested
that they be allowed to transfer the development rights for 2 units
from Lot 1, Block 3, to Lot 56, Block 2, all in Wildridge Subdivision;
and
WHEREAS, the Planning and Zoning Commission has determined
that the transfer:
(1) complies with all requirements imposed by the Zoning
Code,
(2) is consistent with the objectives and purposes of
this Zoning Code and the applicable zoning district,
(3) will be compatible with surrounding land uses and
uses in the area,
subject to,
(1) Planning and Zoning Commission approval of an
acceptable site plan for 2 duplexes on Lot 56,
(2) Lot 1 being rezoned as open space,
(3) Lot 1 being deeded to the Town of Avon as open space,
NOW THEREFORE BE IT RESOLVED that the Town Council hereby
approves the transfer subject to the following;
(1) Planning and Zoning Commission approval of an
acceptable site plan for 2 duplexes on Lot 56,
(2) Lot 1 being rezoned as open space,
(3) Lot 1 being deeded to the Town of Avon as open space.

Re: Application for Special Review to Transfer the Development
Rights for One Duplex (2 Units) from Lot 1, Block 3, to Lot
56, Block 2, Wildridge Subdivision.
Gentlemen and Dear Sheila Davis:
The purpose of this letter is to acknowledge our consent and
approval for transfer of the above-described development rights,
which will, of course, be contingent upon closing a purchase
contract on Lot 56, Block 2. At the time of said closing,
Wildridge will convey title to Lot 1, Block 3, to the Town of
Avon.

Gentlemen and Mrs. Davis:

I represent Coyote Construction & Development in this effort to transfer
density within the Wildridge Subdivision. Coyote Construction &.Develop-
ment is attempting to purchase these two duplex residential lots from
Wildridge Development Company, contingent upon a transfer of density as
follows:
The allowed two dwelling units-on Lot 1 to be transferred to
Lot 56 in order to allow a total of four dwelling units (two
separate duplex residences) to be constructed on Lot 56. Lot
1 (with no remaining building rights)'is to be rezoned to "OLD"
(open space, landscaping and drainage) in accordance-with the
Title 17 zoning code of the Town of Avon, for subsequent deeding
to the Town of Avon.
At the May 10, 1984 public hearing, the Planning and Zoning Commission
granted approval of this application, conditional upon:
1.-The rezoning of Lot 1 to "OLD", open space, landscaping
and drainage;
2. The deeding of the rezoned Lot 1 to the Town of-Avon; and
3. The approval of the Planning and Zoning Commission of an
acceptable site development plan indicating access, drainage
and parking for the two duplex structures to be built on
Lot 56.
We would appreciate your review and a similar conditional approval as
recommended by the Planning and Zoning Commission. It is our intention
to provide the information required by condition #3 above in the normal
course of the Design Review/Planning and Zoning Commission approval
.process. We would appreciate direction from the Town Council as to how
we should accomplish or make application for the approval for conditions
#1 and ##2.
