RESOLUTION NO. #83-52
SERIES OF 1983
A RESOLUTION APPROVING A SPECIAL REVIEW USE FOR
AUTOMOBILE REPAIR IN BAYS 2 AND 5, LOT 13, BLOCK
1, BENCHMARK SUBDIVISION
WHEREAS, an application has been submitted requesting
that Automobile Repair be allowed in Bays #2 and #5, Lot 13,
Block 1, Benchmark Subdivision, and that the applicant be
allowed to leave the overhead door open in Bay #1 during hot
weather, and,
WHEREAS, the Planning and Zoning Commission has held
a Public Hearing on said request and determined that the proposed
use complies with all requirements imposed by the Zoning Code,
is consistant with the objectives and purposes of this Zoning
Code and the applicable zoning district; and is designed to be
compatible with surrounding land uses and uses in the area, and,
WHEREAS, the Planning and Zoning Commission has
recommended approval of the request subject to the following
condition:
(1) That the parking spaces be striped as shown
on the approved site plan prior to the use of
Bay #5.
(2) That all conditions noted in the design approval,
dated October 21, 1982 for the rebuilding of Bay
#5 be complied with by the owner prior to the use
of Bay #5. A performance bond or cash in escrow
shall be posted for those items which cannot be
completed prior to the use of Bay #5. The bond
or escrow account shall be drawn so that the Town
of Avon shall have the right to withdraw the money
to complete the improvements should the owner fail
to do so after receiving proper legal notice.
The amount of the bond or escrow account shall
be sufficient to complete the projects.

NOW THEREFORE BE IT RESOLVED that the application is
hereby approved subject to the conditions listed above.

Planning & Zoning Commission Report to Town Council
S.R.U. - Automotive Repair
Bay 2 & 5, Lot 13, Block 1, Benchmark Subdivision
The Planning and Zoning Commission, at their regular meeting of November
10, 1983, reviewed the request of Mr'. David Svabik for_approval.of a Special
RevTew_Use for Automotive Repair.in Bays 2 and 5;-4ot '13, Block 1, Benchmark
Subdivision. Bay 2 consists of 800 square feet, Bay 5 is 1,600-square feet.
The request is to allow for the expansion of Beaver Creek Automotive which is
pres_ently.`operating in Bay 1. Also included is_a request to allow up to three
vehicles,which are being repaired to be parked along the south side of Bay
1 and one vehicle to be parked along the southeast corner of the building.
Mr. Svabik also requested that the condition imposed on Bay 1, requiring
that the overhead door be kept closed, be deleted. He would like to be able
to open the door during hot summer days.
The Planning Commission-recommended approval of the entire request
subject to the following conditions:
1) That the parking spaces_be striped as shown on the approved
site plan prior to the use of Bay 5.

Attached is the report and recommendation of the Planning and Zoning
Commissi©n and a proposed resolution for Council consideration for the
S.R.U. requested by Mr. David Svabik for the expansion of his automobile
repair shop.
The Planning and Zoning Commission recommended approval of this request
subject to the conditions noted in the attached report.
The Council may want to add, delete or modify any conditions listed in
the resolution.
