RESOLUTION NO. #83-20
SERIES OF 1983
A RESOLUTION CONCERNING SENATE BILL 211, GRANTING
ANTITRUST IMMUNITY FOR LOCAL GOVERNMENT LAND USE
ACTIVITIES.
WHEREAS, The Town Council of the Town of Avon, Colorado
has determined that it is of the utmost urgency that the Colorado
State Legislature act positively to protect the counties and
municipalities from being subjected to antitrust litigation and
liability resulting from their exercise of its powers granted by the state
to regulate and control their land-use and to exercise their authority
to plan for the growth and development of their local governmental
jurisdictions, and
WHEREAS the Colorado Senate and the House Local Government
Committee have supported this effort by acting favorably on S.D. 211, and
NOW THEREFORE BE IT RESOLVED that the Town Council of
the Town of Avon hereby urges that the members of the House State
Affairs Committee as well as the members of the Colorado House of
Representatives, act favorably to support S-B. 211 as it serves to
afford the duly elected representatives of the people in municipalities
and counties of this state reasonable protection in their efforts
and exercise the land use regulatory powers proscribed to them by the
government of this state.
