RESOLUTION NO. 81-7
Series of 1981
WHEREAS, Allan R. Nottingham and Wildridge Development
Company have requested that the Town of Avon grant the vacation of
certain utility easements on Lots 24, 25, 26, and 27, respectively, Block
4, Wildridge Subdivision, as per the recorded plat thereof recorded in
the real property records of Eagle County, Colorado, and as more fully
described in Exhibits 24A, 25A, 26A, and 27A attached hereto; and
WHEREAS, Nottingham and Wildridge desire to create and
establish new utility easements on their respective lots referred to
hereinabove and as more fully described in Exhibits 24B, 25B, 26B, and
27B attached hereto; and
WHEREAS, Nottingham and Wildridge desire to dedicate said
nonexclusive utility easements hereinabove mentioned and as described
in Exhibits 24B, 25B, 26B, and 27B to the Town for utility purposes; and
WHEREAS, by separate letter Wildridge Development Company has
agreed that the newly created and established nonexclusive utility
easements shall be included on an amended plat for the Wildridge
Subdivision, said amended plat to be completed within six (6) months
of date hereof.
NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF AVON that the Mayor and Town Clerk are hereby authorized to execute
the instrument, attached hereto as Exhibit A, granting said vacation of
easements and accepting the newly created and established easements.

VACATION OF EASEMENTS

CREATION and ESTABLISHMENT of NEW EASEMENTS
THIS INSTRUMENT entered into this /2246day of , 1981, by
and between-ALLAN R. NOTTINGHAM, whose address is P.O. Box P, Avon, Colorado
("Nottingham"), the WILDRIDGE DEVELOPMENT COMPANY, whose address is P.O. Box
20, Avon, Colorado ("Wildridge") and the TOWN OF AVON, a municipality, whose
address is P.O. Box D, Avon, Colorado (the "Town").
RECITALS
WHEREAS, Nottingham is the owner of Lots 24 and 27, respectively,
Block 4, Wildridge Subdivision, as per the recorded plat thereof recorded in
the real property records in Book 303 at Page 466 of County of Eagle, State of
Colorado; and
WHEREAS. Wildridge is the owner/developer of Lots 25 and 26,
respectively, Block 4, Wildridge Subdivision, as per the recorded plat thereof
recorded in the real property records in Book 303 at Page 466 of County of
Eagle, State-of Colorado; and
WHEREAS. Nottingham and Wildridge desire to vacate those certain
utility easements on their respective lots referred to hereinabove,.and further
as described in`Exhibits'.24A', 25A, 26A, and~27A, attached hereto and made 'a
part hereof by this reference; and
WHEREAS, Nottingham and Wildridge desire to create and establish new
utility'easements on their respective lots referred to*hereinabove, and further
described in Exhibits 24B, 25B, 26B, and 27B, attached hereto and made a part

hereof-by this reference.
NQW THEREFORE, for good and valuable consideration received by each
of the parties hereto, the receipt and sufficiency of which is hereby
acknowledged, the parties make the following grant and conveyance.
The parties hereto agree to do as follows:
1. The Town after duly considering the matter and the interests of
all affected parties does hereby grant the vacation of easements as described
in Exhibits 24A, 25A, 26A, and 27A.
2. Nottingham hereby dedicates to the Town those nonexclusive
easements, as described on Exhibits 24B and 27B, respectively, for utility

purposes.
3. Wildridge hereby dedicates to the Town the nonexclusive easements
as described on Exhibits 25B and 26B, respectively, for utility purposes.
4. The Town after duly considering the matter and the interests of
all affected parties hereby accepts the dedication of the easements as
described in Exhibits 24B, 25B, 26B, and 27B.
5. Said newly created easements shall inure to the benefit of, and
be binding upon, the parties hereto and their respective successors and
assigns.
IN WITNESS WHEREOF, Allan R. Nottingham, Wildridge Development
Company and the Town of Avon have hereunto set their hands and seals the day
and year first above written.

vacation and the creation of new easements as set forth in
Resolution No. 9/ - 7 , Wildridge Development Company agrees
to include said new easements on an amended subdivision final plat
within six (6) months after the approval by the Town Council of the
Town of Avon of Resolution No. - The cost of said replat
