No. 1999-11 Repealing and Reenacting Chapter 15.12 of the Avon Muni CodeTOWN OF AVON ORDINANCE NO. 99 -11 SERIES'OF 1999 AN ORDINANCE REPEALING AND REENACTING CHAPTER 15.12 OF THE AVON MUNICIPAL CODE: ADOPTING BY REFERENCE THE 1999 EDITION OF THE NATIONAL ELECTRIC CODE AND SETTING FORTH DETAILS IN REGARD THERETO WHEREAS, the 1999 Edition of the National Electric Code has been published; and WHEREAS, the Town of Avon wishes to adopt the 1999 Edition of the National Electric Code. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COUNTY OF EAGLE, STATE OF COLORADO, THAT: Chapter 15.12 of the Avon Municipal Code is hereby repealed and reenacted to read as follow: SECTIONS: 15.12.010 Adoption. 15.12.020 Additions or modifications. 15.12.030 Article 100 -- Definitions 15.12.040 Amendments to the National Electrical Code. 15.12.050 - Appeals to Town Council. 15.12.060 Violations. 15.12.070 Penalty. 1 15.12.080 Validity. 15.12.090 Repeal. CHAPTER 15.12 15.12.010 Adoption. The Charter of the Town, Section 6.9, provides that standard codes may be adopted by reference, with amendments. The town adopts the 1999 Edition of the National Electric Code and all appendix chapters thereto. The National. Electric Code is published by the National Fire Protection Association, Batterymarch Park, Quincy, MA 02269. Three copies of the National Electrical Code are on file in the Town Clerk's office and are available for inspection during regular office hours. 15.12.020 Additions or modifications. The National Electrical Code (1999 Edition) is amended and changed in Sections 15.12.030 through 15.12.050 of this chapter. 15.12.030 Article 100 Definitions. Article 100 is amended as follows: Article 100: Definitions. Electrical Permit Fees. All fees shall be as shown on the Town of Avon Fee Schedule A (as adopted -by resolution of the Avon Town Council). 15.12.040 Amendments to the 1999 National Electrical Code. The following additions are made to the National Electrical Code, 1999 Edition: A. Article 110 -5:- Conductors. 2 No aluminum or copper covered aluminum conductors, smaller than size `8', shall be installed in the Town of Avon. B. Article 210 -8: Ground Fault Protection for Personnel (8) There shall be a maximum of four (4) outlets on each of the small appliance circuits and each circuit used for G.F.I. protection devices. (9) All G.F.I. circuits shall be re- settable in the area of use. C. Article 210 -23: Permissible Loads. (a)(1 ) 2p Circuits. There shall be a maximum of ten (10) outlets on any 20 -amp convenience circuit. (a)(2) 15 -Amp Circuits. There shall be a maximum of eight (8) outlets on any 15 -amp lighting circuit. (a )(3) Separation of Circuits. All lighting circuits shall be separated from the convenience circuits. D. Article 210 -70: Li tins Outlets Required. (4) Attics and Crawl Spaces. All attic spaces over 36 inches high and all crawl spaces shall have a light within 10 feet of the access opening and the switch shall be adjacent to the opening. Crawl spaces shall have at least one G.F.I. convenience outlet. Both areas shall also have lights and outlets at the location of any equipment, valves, devices or other items requiring inspection or maintenance which are located more than 10 feet from the access opening. A' second G.F.I. outlet and light will be required for any equipment in excess of 25 feet spacing. E. Article 230 -2 (b)(1): Services — Special Occupancies 3 (b) By special permission, additional'services shall be permitted for (1) multiple - occupancy buildings where there is no available space for service equiptment accessible to all occupants, providing all residential units built as townhouses or duplexes shall have a service disconnect mounted on each-such unit. All grounding and general wiring shall be as for a single family residence, F. Article 300- 2: Limitations. (c) General Wiring_ All electrical wiring in A, B, E, F, H, I, M and S occupancies, as defined in the Uniform Building Code, and all buildings in excess of three stories above finished grade, shall be in approved raceways, conduit or armored style cable. G. Article 300 -21: Spread of Fire or Products of Combustion No penetrations of any fire rated assembly will be allowed in any occupancy unless through an approved, listed device. H.- Article 680 -70: Protection. All bathtubs with motors shall be fed on a dedicated circuit. It shall be protected with a faceless G.F.I. device, which shall be wall mounted in the area of the tub, a minimum of 5 feet A.F.F., no closer than 5 feet to the tub and marked as to the use. The minimum size opening for access to the tub motor shall be 15 inches by 20 inches. 15.12.050 Appeals to Town Council. (a) A person shall have a right to appeal a decision of the code official to the Town Council. An application for appeal shall be filed with the Town Clerk within 20 days after the date of the decision of the code official. An application for appeal shall 4 be based on a claim that the true intent of this code or the rules legally adopted hereunder have been incorrectly interpreted. (b) Any member of the Town Council, acting in good faith and without malice for the Town of Avon in the discharge of their duties, shall not thereby render themselves personally liable. The members are hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of their duties. Any suit brought against a member or members of the Town Council because of any act or omission performed by them in the discharge of their duties, shall be defended by the Town of Avon until final termination of the proceedings. 15.12.060 Violations. The following clause concerning violations is set forth in full and adopted with reference to the National Electrical Code named in the title of this Chapter. It is unlawful for any person, firm or corporation to erect, construct, alter, move, demolish, repair, use and occupy any building or structure and building service equipment, or maintain any building or structure in the town or cause or permit the same to be done, contrary to or in violation of any of the provisions of any of the codes or standards named in the title of this Chapter. 15.12.070 Penaltv. Any person, firm or corporation violating any of the provisions of this Chapter, or of the National Electrical Code named in the title of this Chapter, shall be deemed guilty of a misdemeanor, and such person, firm or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of any of the codes and standards names in the title of this Chapter is committed, continued or permitted, and upon conviction of any such violation, such person, firm or corporation shall be guilty of a misdemeanor and punishable by a fine of not more than one thousand dollars or ninety days in jail or both. 15.12.080 . Validity. If any section, subsection, sentence, clause or phrase of the National Electrical Code named in the title of this Chapter is for any reason held to be invalid or unconstitutional, such decision shall not effect the validity or constitutionality of the remaining provisions of these ordinances. The Town declares that it would have passed these ordinances, and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared invalid. 15.12.090__ Repeal. The repeal or the repeal and reenactment of any provision of this code of the town as provided in this chapter shall not affect any right which has accrued, any duty imposed, any violation that occurred prior to the effective date hereof, any prosecution commenced, nor any other action or proceeding as commenced under or by virtue of the provisions repealed or repealed and reenacted.
