TC Ord. No. 1996-17 Approving the PUD plan for Chateau St. ClaireTOWN OF AVON ORDINANCE NO. 96 - 19 SERIES OF 1996 AN ORDINANCE APPROVING A PUD DEVELOPMENT PLAN FOR CHATEAU ST. CLAIRE ANNEXATION, TOWN OF AVON, EAGLE COUNTY, COLORADO, LOCATED SOUTH OF HIGHWAYS 6 AND 24 AND EAST OF AVON ROAD. WHEREAS, Colorado Pacific Construction Ventures has filed an application with the Town of Avon for approval of planned unit development (PUD) Development Plan for the Chateau St. Claire Annexation; and WHEREAS, after notices required by law, a public hearing was held before the Planning and Zoning Commission of the Town of Avon on June 18. 1996, at which time the applicant and the public were given an opportunity to express their opinions and present certain information and reports regarding the proposed Development Plan; and WHEREAS, following said public hearing, the Planning and Zoning Commission forwarded its recommendations regarding the proposed Development Plan to the Town Council of the Town of Avon; and WHEREAS, after notices provided by law, a public hearing was held before this Council on the ,24th day of September, 1996, at which time the applicant and the public were given an opportunity to express their opinions regarding the proposed Development Plan; and C WHEREAS, based upon the evidence, testimony, and exhibits, and a study of the Comprehensive Plan of the Town of Avon and of the recommendation of the Planning and Zoning Commission of the Town of Avon, this Council finds as follows: 1. That the proper posting, publication and public notice were provided as required by law for the hearings before the Planning and Zoning Commission and the Town Council of the Town of Avon. 2. That the hearings before the Planning and Zoning Commission and the Town Council were both extensive and complete and that all pertinent facts, matters and issues were submitted at those hearings. 3. That the Development Plan is consistent with the Comprehensive Plan of the Town of Avon, which designates the land use for this area as mixed -use. 4. A76 nV '14 CG 'i: A 9kQ NOW THEREFORE:, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON, COLORADO, THAT the Chateau St. Claire PUD Development Plan is hereby approved subject to the following conditions: 1. That all development on this property shall conform to the approved Development Plan which establishes the permitted uses, number of dwelling units, amount of commercial area, locations of buildings and site improvements, building envelopes, parking and driveway areas, and landscape plan. 2. A sidewalk system be constructed on site and extended west to the Avon Road Intersection. Construction plans for the sidewalk will be required with the submittal of the final plat. 3. All landscaping above 36 inches in a 30 foot site distance triangle be removed from the site entrance. 4. Four parking spaces be removed from across the underground parking entrance to provide an increased turning radius, minimize conflicts between cars entering the site, and provide more snow storage. 5. Four parking spaces be removed from the south end of the parking ramp. 6. Landscaping be provided at the end of the parking ramp. 7. Parking garages be deleted as a principal use from the PUD. 8. The PUD be amended to indicate that retaining walls be allowed in the setback. 9. Parking calculations will be determined at the time of final design review, and the actual leasable floor area be provided with dimensions of the areas. .. 10. All staff comments in the staff report to the Planning & Zoning Commission dated Ca to August 30, 1996 be addressed. 11. The garage floor plan be revised to indicate that all compact parking spaces will meet minimum dimensions. 12. Two more handicap parking spaces be provided to meet the accessibility requirements of the UBC. 13. An access easement across the parking lot with steps or other means of accessing Lot 2 needs to be provided to the town. 14. The ridgeline building height be limited to 74 feet from existing grade and the tower be limited to a maximum height of 84 feet. 15. That vehicle access to the site from Highway 6 must conform with Colorado Department of Transportation (CDOT) regulations. 16.
