RESIDENTIAL AND TIMESHARE CONDOMINIUM DEVELOPMENT,
TOWN OF AVON, EAGLE COUNTY, COLORADO.
WHEREAS, Lakeside Terrace, LLC and Points, of Colorado. owners of lots 45 & 46,
Benchmark at Beaver Creek Subdivision, have filed an application with the Town of Aron to
rezone the property from RHD and PUD, to PUD to expand the existing uses in the Falcon Point
PUD and to include Falcon Point and Lakeside Condominiums "vithin one new PUD and
subdivision to be named Lakeside PUD for timeshare and duplex residential development-. and
WHEREAS, a public !tearing was held by the Planning and Zoning Commission of the
Town of Avon on February 20, 1996, pursuant to notices required by law, at which time the
applicant and the public were given an opportunity to express their opinions and present certain
information and reports regarding the proposed rezoning; and
WHEREAS, following said public hearing, the Planning and Zoning Commission
forwarded its recommendations regarding the proposed rezoning to the Town Council of the
Town of Avon: and
WHEREAS, after notices provided by law. a public hearing was held before this Council
on the 26th day of March. 1996. at which time the applicant and the public were given an
opportunity to express their opinions regarding the proposed rezoning; and
WHEREAS, based upon the evidence, testimony, and exhibits, and a study of the
Comprehensive Plan of the Town of Avon and of the recommendation of the Planning and
Zoning Commission of the Town of Avon, this Council finds as follows:
1. The proper posting, publication and public notice were provided as required by laws for
the hearings before the Planning and Zoning Commission and the Town Council of the
Town of Avon.
2. That the hearings before the Planning and Zoning Commission and the Town Council
were both extensive and complete and that all pertinent facts, matters and issues were
submitted at those hearings.
3. That the proposed rezoning as Planned Unit Development is consistent with the
Comprehensive Plan of the Town of Avon which designates the area for residential
development.

NOW THEREFORE, BE I "I" ORDAINED BV THE TOWN COUNCIL OF THE TOWN
OF AVOID, COLORADO THAT. the rezoning of Lot 4? and 46. Block 2. Benclmiwk ,at
Beaver Creek lbr duple: residential and time share developmen? for 8 duplex: dw lfinnn units and
74 timeshare units, and which removes the 3l development rights assigned to Lot 45 and the 1
development rights assigned to Lot 46, is approved subject to the folio% %ing conadhions.
1. All development shall conform to the approved 1'UD Plan (;attached hereto as Exhlbit
A -) which establishes the number of`dwelling units, building' en% elopes. parking .and
driveway areas, and landscape plan.
2. 'rhe Properly is zoned for a maXimum of eight (g) residential d"vellnng units in four (4)
duplex buildings and seventy-four (74) timeshare condominium dwelling units in two (2)
buildings.
3. No additional dwelling units beyond those enumerated in Condition # 2 are allo+v °ed to be
developed on the prorA!rt }° within this PUD.
4. Revised pollution control, storm water control, and grading plans to be reviewed and
approved by "Town staff.
5. The final subdivision plat and site plan be redrawn to include the guest parking spaces
within Lot)
6. The parking analysis chart on the site plan be revised to reflect -the requirements for
timeshare spaces based on one (I) parking space per 600 square feet of timeshare unit.
7. The Final Design be approved. in accordance %%ith Town regulations, prior to application
for building permit.
8. The final subdivision plat be approved by the Town.
These conditions shall be deemed completed upon written approval of the To%,.m Manager or his
designee.

meeting, of the Town Council of the Towle of Avon. Colorado on the 26th day of March, 1996, at
