AN ORDINANCE REPEALING AND REENACTING
CHAPTER 15.12 OF THE AVON MUNICIPAL
CODE; ADOPTING BY REFERENCE THE
"NATIONAL ELECTRICAL CODE", 1990
EDITION
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE
TOWN OF AVON, STATE OF COLORADO, THAT:
Section 1. Chapter 15.12 of the Municipal Code of the Town
of Avon is hereby repealed and reenacted to read as follows:

NATIONAL ELECTRICAL CODE
15.12.010 ADOPTION. The Charter of -the Town of
Avon, Section 6.9 provides that standard codes may be adopted by
reference; with amendments. The Town of Avon hereby adopts the
1990 Edition of the National Electrical Code and all appendix
chapters thereto. The National Electrical Code is published by
the National Fire Protection Association, Batterymarch Park.,
Quincy, MA 02269. Three (3) copies of the National Electrical
Code are on file in the office of the Town Clerk or the Town, OT
Avon and are available for inspection during regular office hours.
15.12.020 ADDITIONS OR MODIFICATIONS. The National
Electrical Code is amended and changed in Sections 15.12.040
through 15.12.060.
15.12.030 DELETION OF TABLE NO. 3-A - ELECTRICAL
PERMIT FEES. Table No. 3-A Electrical Permit Fees is deleted.
15.12.040 AMENDMENTS TO THE NATIONAL ELECTRICAL
CODE. The following amendments are hereby made to the National
Electrical Code, 1990 edition.
A. All electrical wiring in Groups A, B, E, I, and
H occupancies as defined in the Uniform Building Code, shall be
encased in conduits, raceways, or- an approved armor. All wiring
in Group R shall be encased in conduits, raceways, or in approved
armor to the circuit breaker box for each unit. No aluminum wire
or copper clad aluminum wire smaller than size 8 will be permitted
within the Town of Avon.
B. Persons engaged in the installation of remote
control, low energy power, and signal circuits as defined in
Article 725 and 760 of this code, need not be licensed themselves

pursuant to Title 12, Article 23, Colorado Revised Statutes, nor
work under the supervision of such licensed electricians; however,
all such persons shall register with the State Electrical Board.
Proof of registration shall be produced by the registrant to the
Town of Avon Building Official.
C. All such installations of remote control, low
energy power and signal systems are subject to the permit and
inspection set forth in 12-23-116 C.R.S. Accordingly, all
installations of remote control, low energy power and signal
systems must be performed in accordance with the minimum
standards set forth in the National Electrical Code.
15.12.050 SECTION 203 LIABILITY OF BOARD MEMBERS.
Section 203 is amended by adding the following:
(c) Any members of the Board prowioeci
for herein, acting in good faith and without malice for the Town
of Avon in the discharge of their duties, sha'il not thereby render
themselves personally liable. The members are hereby relieved
from all personal liability for an damage that may accrue to
persons or property as a result of any act or omission related to
the discharge of their duties. Any suit brought against a member
or members of the board as provided herein, because of such act or
omission performed by them in the discharge of their duties, shall
be defended th the Town of Avon until final termination of the
proceedings.

15.12.060 ELECTRICAL PERMIT FEES. Electrical
permit fees shall be as follows:

Over 1000 square feet and not

more than 2,000 square feet ...........................$75.00
Per 100 square feet in excess
of 2,000 square feet $ 5.00
All other fees, except for inspection in mobile
homes and travel trailer parks, shall be computed on the dollar
value of the electrical installations, including fixtures and
installation, including time and material (total cost to the
customer), and such fees shall be computed as follows:

15.12.070 VIOLATION. The following clause
concerning violations is set forth in full and adopted with
reference to the National Electrical Code named in the title of
this chapter:
It shall be unlawful for any person, firm or corporation to
erect, construct, alter, move, demolish, repair, use and occupy
any building or structure and building service equipment, or
maintain any building or structure in the Town of Avon or cause or
permit the same to be done, contrary to or in violation of any of
the provisions of any of the codes or standards named in the title
of this ordinance.
15.12.080 PENALTY. Any person, firm or corporation
violating any of the provisions of the National Electrical Code
named in the title of this chapter shall be deemed guilty of a
misdemeanor, and any such person, firm, or corporation shall be
deemed guilty of a separate offense for each and every day or
portion thereof during which any violation of any of the
provisions of any of the codes and standards named in the title of
this chapter is committed, continued or permitted, and upon
conviction of any such violation, such person, firm or corporation
shall be guilty of a misdemeanor and punishable by a fine of not

mor than $300.00 or 90 days in jail, or both.
15.12.090 REPEAL - Part II Repeal - The repeal or
the repeal and re-enactment of any provision of the Lode of the
Town of Avon, Colorado as provided in this Ordinance shall not
effect any right which has accrued, any duty imposed, any
violation that occured prior to the effective date hereof, any
prosecution commenced, nor any other action or proceeding as
commenced under or by virtue of the provision repealed or repealed
and re-enacted. The repeal of any provision hereby shall riot
revive any provision or any ordinance previously repealed or
superseded unless expressly stated herein.
15.12.100 VALIDITY. That if any section,
subsection, sentence, clause or phrase of the National Electrical
Code named in the title of this chapter, is for any reason, held
to be invalid or unconstitutional, such decision shall not affect
the validity or constitutionality of the remaining provisions of
these ordinances. The Town of Avon hereby declares that it would
have passed these ordinances, and each section, subsection, clause
or phrase hereof, irrespective of the fact that any one or more.
sections, subsections, sentences, clauses and phrases be declared
unconstitutional.

ELECTRICAL CODE", 1990 EDITION
A copy of said Ordinance is attached hereto, and is also on
file at the office of the Town Clerk, and may be inspected
during regular business hours.
Following this hearing the Council may consider final passage
of this Ordinance.

of the Town of Avon, Colorado.
