AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE ZONING
DISTRICT MAP OF THE TOWN OF AVON AS IT PERTAINS TO THE
RIVERSIDE SUBDIVISION, A SPECIALLY PLANNED AREA

WHEREAS, Golden Buff Enterprises has applied to have C1.

WHEREAS, public hearings have been held by the Planning

required by law, at which the applicant and the public were given

WHEREAS, based upon the evidence, testimony and exhibits,

recommendations of the Planning and Zoning Commission of the Town

3. The proposed amendment to the Zoning Map of the Town m z

of Avon is consistent with the Master Plan of the Town of Avon. fti
4. The requested amendment to the Zoning Map of the Town
of Avon will be in the best interest of the health, safety,
Welfare, and morals of the citizens of the Town of--Avon.
NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL
OF THE TOWN OF AVON, AS FOLLOWS:

Section 1. Specially Planned Area Plan. The land uses
permitted within the area described on Exhibit A hereto, and the
regulations affecting such area and the respective divisions of
land within such area as described on Exhibit A, shall be those
attached hereto as Exhibit B, together with such other provisions
of the Municipal Code of the Town of Avon(including but not
limited to the Subdivision Code and the Zoning Code) as are
not in conflict with the regulations and limitations in Exhibit B.
Section 2. Effective Date. The Specially Planned
area Plan for the property described as Exhibit A, and the Zoning
Map of the Town of Avon provided for herein, shall take effect
in accordance with the charter and the ordinances of the Town of
Avon, and the Mayor and the Town Clerk are hereby directed and
authorized to execute such documents as may be required to reflect
4 the amendment herein authorized, and to file a certified copy
of such document with the Clerk and Recorder for Eagle County,
Colorado.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED
POSTED, THIS 28th DAY OF February , 1989, and a public
hearing on this Ordinance shall be held at the regular meeting of
the Town Council of the Town of Avon, Colorado, on the 14th day
of March , 1989, at 7:30 p.m. in the Municipal Building
of the Town of Avon, Colorado.

Minimum Building Setbacks:
Front: 25 feet
Side & Rear: 30 feet from Mean Annual High Water Line of Beaver
Creek and the Eagle River.
Minimum Parking Requirement:
Per Title 17 of the Avon Municipal Code.
Maximum Building Height:
1. Maximum building height shall not exceed 7,500 feet in
elevation;
2. Not more than 50% of the total building area shall exceed
7,445 feet in elevation;
Building Height Control Standards for Lot 2:
Maximum building height shall be determined by the elevation at
the highest point of a roof peak, parapet wall or other similar
extension of a wall or roof.
Decorative spires, chimneys, light standards, snow and wind
control devices, antennas or other similar appurtenances may
exceed the maximum height by no more than ten (10) feet.
All elevations shall be used on U.S.

Dear Mr. Jamar:
At its regular meeting of March 14, 1989, the Avon Town
Council approved Ordinance No. 89-5, Series of 1989 which
provided for the amendment of the Zone District Map of the
Town of Avon as it pertains to the Riverside Subdivision,
which is a Specially Planned Area.
Also, the Avon Town Council approved Resolution No. 89-8
which approved the Final Plat of Riverside subject to:
1. Review and approval by the Town Attorney of executed
Plat Certificates for conformance with the Town
regulations.

ZONING AND LAND USE SUMMARY - RIVERSIDE
LOT 1
Area: - 2.50 acres
Assigned Density:
1) 150 Accommodation Unit Development Rights are assigned
which may be developed only in accordance with Allowed Uses.
Allowed Uses:
150 Accommodation Unit Hotel, Lodge, or Motel with a maximum of
5000 net square feet of commercial uses which may consist of
retail shops, restaurants, personal service shops, cocktail
lounge, and office.
Maximum Building Area Ratio (Building Coverage): - .6
Minimum Open Space: - 30%
Minimum Building Setbacks:
Front: 25'*
Side: 7.5'
Rear: 30' from Mean Annual High Water Line
*An access drive or ramp to parking not exceeding 200' in length
shall be permitted within the Front Setback Area. Underground
parking shall be permitted within the Front Setback Area.
Minimum Parking Requirement:
Per Title 17 of the Avon Municipal Code, with the exception that
the project is not required to be on the Town of Avon bus route
to qualify for a 15% parking reduction.
Maximum Building Height: - 60' as defined by Section 17.08.160 of the
Avon Municipal Code.
