ORDINANCE NO. 86-24
SERIES OF 1986
AN ORDINANCE AMENDING SECTION 9.12.030 OF THE
MUNICIPAL CODE OF THE TOWN OF AVON AS IT
RELATES TO PROHIBITED CONDUCT IN LIQUOR
LICENSED PREMISES AND PROVIDING PENALTIES FOR
VIOLATION THEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON, COLOADO, AS FOLLOWS:
Section 1. Amendment. Section 9.12.030 of
Chapter 9.12 of Title 9 of the Municipal Code of the Town of
Avon is amended by the addition of a subsection H and a
subsection I as follows:
H. No licensee, manager or agent shall
shall sell, serve, give away, dispose of,
exchange, or deliver or permit the sale,
serving, giving, or procuring of any malt,
vinous, or spirituous liquor to or for any
person under the age of twenty-one years, to
a visibly intoxicated person, or to a known
habitual drunkard.
I. No licensee, manager or agent shall sell,
serve, or distribute any malt, vinous, or
spirituous liquors at any time other than the
following:
(1) For consumption on the premises, on
any Tuesday through Saturday and on any
Monday which falls on a January 1,
beginning each day at 12 midnight until
2 a.m. and from 7 a.m. until 12 mid-
night;
(2) For consumption on the premises, on
Sundays and Christmas, beginning at 12
midnight until 2 a.m. and from 8 a.m.
until 8 p.m.;
(3) For consumption on the premises, on
any Monday which does not fall on a
January 1 and on any day after Christ-
mas, beginning at 7 a.m. until 12
midnight;
(4) In sealed containers, on Monday
through Saturday, beginning at 8 a.m.
until 12 midnight each day, but no
alcoholic beverage shall be sold,
served, or distributed in a sealed
container on any such weekday which is
also Christmas.
Notwithstanding any of the provisions of this
paragraph I, a hotel and restaurant licensee,
beer and wine licensee, tavern licensee, club
licensee, or arts licensee may obtain, for an
additional fee, from the local licensing
authority, a special license to sell, serve
or distribute malt, vinous and spirituous
liquors by the drink after the hour of 8 p.m.
and until 12 midnight on Sundays and Christ-
mas.

Section 2. Severability. If any part,
section, sentence, clause or phrase of this Ordinance is for
any reason held to be invalid, such decision shall not
affect the validity of the remaining portions of this
Ordinance; and the Town Council for the Town of Avon hereby
declares it would have passed this Ordinance and each part,
section, sub-section, sentence, clause or phrase thereof,
irrespective of the fact that any one or more parts,
sections, sub-sections, sentences, clauses or phrases be
declared invalid.
Section 3. Penalty for Violation. Any person,
firm or corporation violating any of the provisions of this
Ordinance shall be deemed guilty of a violation of this
Ordinance and any such person, firm or corporation shall be
deemed guilty of a separate offense for each and every day
or portion thereof during which any violation is committed,
continued or permitted, and upon conviction of any such
violation, such person, firm or corporation shall be pun-
ished by a fine of not more than $500.00 or by imprisonment
for not more than 90 days, or by both such fine and impris-
onment.

POSTED, THIS 25th day of November , 1986 and
a public hearing on this Ordinance shall be held at the
regular meeting of the Town Council of the Town of Avon,
Colorado, on the 9th day of December , 1986 at
7:30 P.M. in the Municipal Building of the Town of Avon,
Colorado.

OF THE TOWN OF AVON, COLORADO AT 7:30 P.M. ON THE 9TH DAY OF
DECEMBER, 1986 AT THE TOWN HALL FOR THE PURPOSE OF CONSIDERING THE
ADOPTION OF ORDINANCE NO. 86-24, SERIES OF 1986:
AN ORDINANCE AMENDING SECTION 9.12.030 OF THE MUNICIPAL CODE
OF THE TOWN OF AVON AS IT RELATES TO PROHIBITED CONDUCT IN LIQUOR
LICENSED PREMISES AND PROVIDING PENALTIES FOR VIOLATION THEREOF
A copy of said Ordinance is attached hereto and is also on file
at the office of the Town Clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this ordinance.
This notice given and published by order of the Town Council of
the Town of Avon.
