ORDINANCE NO. 86-13
ORDINANCE PROVIDING FOR THE AMENDMENT OF THE
ZONING DISTRICT MAP OF THE TOWN OF AVON BY THE
INCLUSION OF CERTAIN DESCRIBED LAND IN THE
NEIGHBORHOOD COMMERCIAL ZONE DISTRICT AND OF OTHER
CERTAIN DESCRIBED LAND IN THE OPEN SPACE,
LANDSCAPING AND DRAINAGE ZONE DISTRICT.
WHEREAS an application has been filed with the
Town of Avon to amend the Zoning District Map of the Town of
Avon by the inclusion of a parcel of land described more
fully herein, within the Neighborhood Commercial (NC) Zone
District, and of another parcel of land located in the same
Section in the Open Space, Landscaping and Drainage (OLD)
Zone District; and
WHEREAS, a hearing was held by the Planning and
Zoning Commission of the Town of Avon on the 3rd day of
June, 1986; and
WHEREAS, after notice as provided by law, a public
hearing has occurred before this Council at which time the
applicants and the public were given an opportunity to
express their opinions regarding the proposed amendment; and
WHEREAS, based on the evidence, testimony, and
exhibits, and a study of the Town of Avon Master Plan and
the recommendations of the Town of Avon Planning and Zoning
Commission this Council finds as follows:
1. That proper posting, publication and public
notice was provided as required by law for the hearing
before the Town Council of the Town of Avon.
2. That the hearing before the Town Council was
extensive and complete and that all pertinent facts, matters
and issues were submitted at that hearing.
3. That the proposed amendment to the Zoning
District MAP of the Town of Avon is consistent with the
Master Plan for the Town of Avon.
4. That the requested amendment to the Zoning
District Map of the Town of Avon will be in the best inter-
ests of the health, safety, welfare and morals of the
citizens of the Town of Avon, provided that the conditions
herein provided be complied with.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON, COLORADO:
Section 1. Amendment to Zone District Map.
The Zoning District Map of the Town of Avon be and
hereby is amended by the inclusion of the real property
described as Lot 1, Riverside Center, as shown on the plat
attached hereto as Exhibit B, which entire tract is more
particularly described on Exhibit A, attached hereto, within
and as a part of the Neighborhood Commercial (NC) Zone
District.
Section 2. Amendment to Zone District Map. The
Zoning District Map of the Town of Avon be and hereby is
amended by the inclusion of the real property described as
Tract A,Riverside Center,as shown on the plat attached
hereto as Exhibit B, which entire tract is more particular-
ly described on Exhibit A, attached hereto, within and as a
part of the Open Space, Landscaping and Drainage (OLD) Zone
District.

Section 3. Effective Date.
The amendment to the Zoning District Map of the
Town of Avon provided herein shall take effect in accordance
with the Charter of the Town of Avon and the Mayor and Town
Clerk are hereby directed and authorized to execute such
maps as may be required to reflect the amended Zoning
District Map with the County Clerk and Recorder of Eagle
County, Colorado.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND
ORDERED POSTED, THIS 1nth day of
June , 1986 and a public hearing on
this ordinance shall be held at the regular meeting of the
Town Council of the Town of Avon, Colorado, on the 24th
day of June , 1986 at 7:30 P.M. in the Municipal
Building of the Town of Avon, Colorado.

LEGAL DESCRIPTION:
A parcel of land lying in the East one-half of the Southeast one-quarter
of Section 12, Township 5 South, Range 82 West and the Southwest one-quarter
of Section 7, Township 5 South, Range 81 West, all of the Sixth Principal
Meridian, Eagle County, Colorado, being more particularly 'described as follows:
Beginning at the Southeast corner of said Section 12; thence along
the East line of the Southeast one-quarter of said Section 12 N 00°17'13" W
1458.64 feet to a point on the boundary line of the plat of Eaglebend Filing
No. 4 as recorded in the Eagle County Records, said point being the True
Point of Beginning; thence along the boundary of said plat of Eaglebend
Filing No. 4 the following three (3) courses:
1) S 59023'49" E 2.94 feet;
2) S 84°14'40" E 8.78 feet to the westerly right-of-way line
of Stonebridge Drive;
3) S 03009'12" W 136.04 feet along said westerly right-of-way
line to a point on the northerly right-of-way line of U.S. Highway
No. 6;
thence along said northerly right-of-way line the following four (4) courses:
1) N 63056'44"W 75.90 feet to a highway right-of-way monument;
2) N 63°11'10" W 749.61 feet to a highway right-of-way monument;
3) N 57°28'32" W 100.50 feet to a highway right-of-way monument;
4) N 63°13'29" W 588.49 feet to a rebar and cap marked L.S. No.
4551, said point lying on the west line of the East one-half of the
Southeast one-quarter of said Section 12, 696.08 feet from the South
one-sixteenth corner of said Section 12;
thence along said West line of the East one-half of the Southeast one-quarter
of Section 12 and the boundary line of a parcel of land owned by Grace White,
N 00°13'43" W 247.02 feet to a point on the approximate centerline of the
Eagle River and the Southerly boundary line of a parcel of land owned by
Nottingham Associates; thence along said centerline and boundary line the
following two (2) courses:
1) S 75°58'40" E 59.49 feet;
2) S 52°04'05" E 348.52 feet to the Southwest corner of the plat of
Eaglebend Filinq No. 4 as recorded in the Eagle County Records;
thence along the Southerly boundary line of said plat of Eaglebend Filing
No. 4 the following four (4) courses:
1) S 63°29'45" E 158.72 feet;
2) S 59°39'32" E 398.03 feet;
3) S 61°26'30" E 300.36 feet;
4) S 59°2349" E 305.05 feet to the True Point of Beginning,
containing 5.697 acres more or less.

OF THE TOWN OF AVON, COLORADO AT 7:30 P.M. ON THE.24TH DAY OF
JUNE, 1986 AT THE TOWN HALL FOR THE PURPOSE OF CONSIDERING THE
ADOPTION OF ORDINANCE NO. 86-13, SERIES OF 1986:
ORDINANCE PROVIDING FOR THE AMENDMENT OF THE ZONING DISTRICT MAP
OF THE TOWN OF AVON BY THE INCLUSION OF CERTAIN DESCRIBED LAND
IN THE NEIGHBORHOOD COMMERCIAL ZONE DISTRICT AND OF OTHER CERTAIN
DESCRIBED LAND IN THE OPEN SPACE, LANDSCAPING AND DRAINAGE ZONE
DISTRICT
A copy of said ordinance is attached hereto and is also on file
at the office of the Town Clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this ordinance.
This notice given and published by order of the Town Council of
the Town of Avon.
