AN ORDINANCE PROVIDING FOR THE
REGULATION OF RAILROAD CROSSINGS
WITHIN THE TOWN OF AVON AND
PROVIDING PENALTIES FOR THE
VIOLATION THEREOF.
Section 1. Amendment. Title 12 of the Municipal Code of
the Town of Avon is amended by the addition of a Chapter
12.12 as follows:
CHAPTER 12.12
REGULATION OF RAILROAD CROSSINGS
12.12.010 Unlawful to Obstruct Railroad Crossing
12.12.020 Duty Upon Obstruction
12.12.030 Duty to Break Train
12.12.040 Speed Limit
12.12.050 Violation
12.12.010 Unlawful to Obstruct Railroad Crossing. It is
unlawful for any person or corporation to obstruct or
cause to be obstructed any railroad crossing within the
Town by means of any railroad car or cars or locomotive
engine or other railroad equipment standing for a
period of time exceeding five consecutive minutes.
12.12.020 Duty Upon Obstruction. Upon obstruction of a
railroad crossing within the Town by means of any
railroad car or cars or locomotive engine or other
railroad equipment, it shall be the duty of the person
or corporation having control of such railroad car or
cars or locomotive engine or other railroad equipment
thereafter to leave clear said railroad crossing for
the following ten consecutive minutes.
12.12.030 Duty to Break Train. Upon order of the police
chief of the Town of Avon or his designated
representative, it shall be the duty of any person or
corporation having control of any railroad train within
the Town to break said railroad train at any railroad
crossing so as to cause said railroad crossing to be
clear for a period of time sufficient in length to
allow the passage of waiting vehicles or any emergency
vehicles across said railroad crossing.
12.12.040 Speed Limit. It is unlawful for any person or
corporation to cause any railroad car or cars or
locomotive engine to pass over any railroad crossing
within the Town at a speed in excess of forty miles per
hour.
12.12.050 Violation. It is unlawful for any person or
corporation to violate any provision of this Chapter or
to fail to comply with any duty imposed by this
Chapter. Any person or corporation violating any
provision of this Chapter or failing to comply with any
duty imposed by this Chapter shall be deemed guilty of

a violation hereof and shall upon conviction, be
punished by a fine of not more than five hundred
dollars or by imprisonment for a period of not more
than ninety days or by both such fine and imprisonment.
Section 2. Severability. If any part, section,
sentence, clause or phrase of this Ordinance is for any
reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this Ordinance;
and the Town Council for the Town of Avon hereby declares it
would have passed this Ordinance and each part, section,
irrespective of the fact that any one or more parts,
sections, sub-sections, sentences, clauses or phrases be
declared invalid.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND
ORDERED POSTED, this 8th day of April , 1986, and a
public hearing on this Ordinance shall be held at the
regular meeting of the Town Council of the Town of Avon,
Colorado, on the 22nd day of April , 1986 at 7:30 P.M.
in the Municipal Building of the Town of Avon, Colorado.

NOTICE IS HEREBY GIVEN OF A PUBLIC HEARING BEFORE THE TOWN COUNCIL
OF THE TOWN OF AVON, COLORADO AT 7:30 P.M. ON THE 22ND DAY OF
APRIL, 1986 AT THE TOWN HALL FOR THE PURPOSE OF CONSIDERING THE
ADOPTION OF ORDINANCE NO. 86-10, SERIES OF 1986:
AN ORDINANCE PROVIDING FOR THE REGULATION OF RAILROAD CROSSINGS WITHIN
THE TOWN OF AVON AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
A copy of said ordinance is attached hereto and is also on file
at the office of the Town Clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this ordinance.
This notice given and published by order of the Town Council of
the Town of Avon.
