TOWN OF AVON
ORDINANCE NO. 86-6
SERIES OF 1986
AN ORDINANCE AMENDING SECTION 15.04.820 AND SECTION 15.24.010
OF THE AVON MUNICIPAL CODE AND PROVIDING FOR THE PROTECTION OF
THE PUBLIC HEALTH AND SAFETY; REGULATING FEES AND THE INSTALLATION
AND MAINTENANCE OF HEATING, VENTILATING, COMFORT COOLING AND
REFRIGERATION SYSTEMS IN THE TOWN OF AVON, COLORADO FOR THE
PURPOSE OF PROVIDING.A UNIFORM MECHANICAL CODE CONSISTENT WITH
AND GENERALLY CONFORMING TO SIMILAR REGULATIONS THROUGHOUT THE
TOWN; DEFINING CERTAIN TERMS; ESTABLISHING MINIMUM REGULATIONS;
ADOPTING BY REFERENCE THE 1985 EDITION OF THE "UNIFORM MECHANICAL
CODE"; AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON,
as follows:
Section 1. Amendment. Section 15.04.820 of Chapter 15.04
Title 15 of the Avon Municipal Code is amended to read as
follows:
15.04.820 Table No. 3-C Mechanical: Permit Fees

forced air or gravity-type furnace or

Section 2. Amendment. Section 15.24.010 of
Chapter 15.24, Title 15 of the Avon Municipal Code is amended
to read as follows:
15.24.010 Adoption Pursuant to Section 6.9 of the
Charter of the Town of Avon, there is adopted by reference the
"Uniform Mechanical Code" of the International Conference of
Building Officials, 5360 South Workman Mill Road, Whittier,
California, 90601, and the International Association of
Plumbing and Mechanical officials, 5032 Alhambra Avenue,
Los Angeles, California, 90032, 1985 Edition. Three (3) copies
of each Code are now filed in the office of the Clerk of the Town
of Avon, Colorado and may be inspected during regular business
hours. The above Code is being adopted as if set out at length
save and except the following sections which are declared to be
inapplicable and are therefore expressly deleted:
A. Sections 201 through 306 inclusive.
B. Section 803 - delete second paragraph
and all thereafter.
C. Section 804.
Section 3. Amendment. Section 15.24.020 of Chapter
15.24, Title 15 of the Avon Municipal Code is amended to read as
follows:
15.24.020. Additions or Modifications. The adopted
code is subject to the following additions or modifications:
A. Section 502(a) Add following sentence:
No open face circulating heater or gas log type heater
shall be hereafter installed in this jurisdiction.
B. Section 804. Note: Floor furnaces shall not be
permitted in the Town of Avon.
C. Section 2213(j). Add as a third sentence: Gas
outlets in a solid fuel burning fireplace are not permitted.

Section 4. Violations and Penalties.
a. Violations. The following clause concerning
violations is hereby set forth in full and adopted with reference
to all of the Codes and Standards named in the title of this
Ordinance:
It shall be unlawful for any person, firm or corporation
to erect, construct, enlarge, alter, repair, move, improve, remove,
convert or demolish, equip, use, occupy or maintain any building or
structure in the Town of Avon or cause or permit the same to be
done, contrary to or in violation of any of the provisions of any
of the Codes or Standards named in the title of this Ordinance.
b. Penalties. Any person, firm or corporation violating
any of the provisions of any of the Codes or Standards named in
the title of this Ordinance shall be deemed guilty of a misdemeanor,
and any such person, firm or corporation shall be deemed guilty
of a separate offense for each and every day or portion thereof
during which any violation of any of the provisions of any of the
Codes or Standards named in the title of this Ordinance is
committed, continued, or permitted, and upon conviction of any
such violation, such person, firm or corporation shall be punished
by a fine of not more than $500.00 or by imprisonment for not
more than 90 days, or by both such fine and imprisonment.
Section 5. Saving Clause. If any part, section,
subsection, sentence, clause or phrase of this Ordinance or any
of the Codes or Standards adopted hereby are for any reason held
to be invalid, such decisions shall not affect the validity of
the remaining sections of this Ordinance or any of the Codes or
Standards adopted hereby; the Town Council hereby declares that
it would have passed this Ordinance and adopted the Codes and
Standards named in the title hereto in each part, section,
subsection, sentence, clause or phrase thereof, irrespective of
the fact that any one or more parts, sections, subsections,
sentences, clauses or phrases be declared invalid.

ORDERED POSTED, this 11TH day of February , 1986 and
a public hearing on this Ordinance shall be held at the regular
meeting of the Town Council of the Town of Avon, Colorado, on the
25TH day of February , 1986 at 7:30 p.m. in the
Municipal Building of the Town of Avon, Colorado.
