ORDINANCE NO. 84 - 5
AN ORDINANCE AMENDING CHAPTER 8.24 OF THE
TOWN CODE OF THE TOWN OF AVON AS IT PERTAINS
TO AREAS PROHIBITED TO DOGS AND AS IT
PERTAINS TO DOG WASTE.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON AS FOLLOWS:
Section 1. Amendment. Chapter 8.24, Title 8 of
the Town Code of the Town of Avon is amended by the addition
of a section 8.24.052 to read as follows:
"8.24.052 Depositing Dog Waste. No owner of
any dog shall allow or permit the depositing of
fecal waste material by such dog within any public
park or other landscaped public area within the
Town except in areas designated therefor or unless
such waste material is promptly removed from the
public park or other landscaped public area or
deposited in a trash container."
Section 8.24.051 of Chapter 8.24, Title 8 of the
Town Code of the Town of Avon is amended to read as follows:
"8.24.051 Permitting doas at Nottinaham
Lake. The permitting of any dog to be within the
following described portion of Tract G, Benchmark
at Beaver Creek Subdivision within the Town of
Avon:
That area enclosed by the inside paved edge
of the innermost bike path immediately surrounding
Nottingham Lake; and
That area within twenty (20) feet of either
side of the uncovered portion of Buck Creek and
the uncovered portion of Metcalf Ditch
shall be deemed a public nuisance and a violation
of this Code."
Section 2. Violations and Penalties.
It is unlawful for any person to violate any
provision hereof. Any person who violates any provision of
this Ordinance shall be punished by a fine of not more than
five hundred dollars or by imprisonment for a period of not
more than ninety days or by both such fine and imprisonment;
provided, no person under the age of eighteen years shall be
punished by imprisonment. Any such person shall be guilty
of a separate offense for each and every day during any
portion of which a violation of any provision of this code
is committed,.continued, or permitted by such person and
shall be punished accordingly.
Section 3. Severability. If any part, section,
sentence, clause or phrase of this Ordinance is for any
reason held to be invalid, such decision shall not affect
the validity of the remaining portions of this Ordinance;
and the Town Council for the Town of Avon hereby declares it
would have passed this Ordinance and each part, section,
sub-section, sentence, clause or phrase thereof,
irrespective of the fact that any one or more parts,

sections, sub-sections, sentences, clauses or phrases be
declared invalid.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED
POSTED, THIS 22nd day of May , 1984,
and a public hearing on this Ordinance shall.be held at the
regular meeting of the Town Council of the Town of Avon,
Colorado, on the 12th day of June ,

OF THE TOWN OF AVON, COLORADO, AT 7:30 P.M. ON THE 12TH DAY OF
JUNE, 1984 AT THE MUNICIPAL BUILDING, 400 BENCHMARK ROAD, AVON,
COLORADO FOR THE PURPOSE OF CONSIDERING THE ADOPTION OF ORDINANCE
NO.#84-5, SERIES OF 1984:
AN ORDINANCE AMENDING CHAPTER 8.24 OF THE TOWN CODE OF THE TOWN
OF AVON AS IT PERTAINS TO AREAS PROHIBITED TO DOGS AND AS IT
PERTAINS TO DOG WASTE
A copy of said Ordinance is attached hereto and is also-on file
at the office of the town clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
This notice given and passed by order of the Town Council of the
Town of Avon, Colorado.
