ORDINANCE NO. #83-7

AN ORDINANCE AMENDING SECTION 15.24.010 OF THE AVON
MUNICIPAL CODE AND PROVIDING FOR THE PROTECTION OF THE
PUBLIC HEALTH AND SAFETY; REGULATING THE INSTALLATION AND
MAINTENANCE OF HEATING, VENTILATING, COMFORT COOLING AND
REFRIGERATION SYSTEMS IN THE TOWN OF AVON, COLORADO FOR THE
PURPOSE OF PROVIDING A UNIFORM MECHANICAL CODE CONSISTENT
WITH AND GENERALLY CONFORMING TO SIMILAR REGULATIONS
THROUGHOUT THE TOWN; DEFINING CERTAIN TERMS; ESTABLISHING
MINIMUM REGULATIONS; ADOPTING BY REFERENCE THE 1982 EDITION
OF THE "UNIFORM MECHANICAL CODE"; AND PROVIDING PENALTIES
FOR VIOLATION THEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON as follows:
Section 1. Amendment. Section 15.24.010 of
Chapter 15.24, Title 15 of the Avon Municipal Code is
amended to read as follows:
"15.24.010 Adoption. Pursuant to Section
6.9 of the Charter of the Town of Avon, there is
hereby adopted by reference the Uniform Mechanical
Code of the International Conference of Building
Officials, 5360 South Workman Mill Road, Whittier,
California 90601, 1982 Edition. Three (3) copies
of each Code are now filed in the office of the
Clerk of the Town of Avon, Colorado and may be
inspected during regular business hours. The
above Code is being adopted as if set out at
length save and except the following sections
which are declared to be inapplicable and are
therefore expressly deleted:
A. Sections 201 through 306 inclusive.
B. Section 803 - delete second paragraph and
all thereafter.
C. Section 804.
Section 2. Violations and Penalties.
a. Violations. The following clause concerning
violations is hereby set forth in full and adopted with
reference to all of the Codes and Standards named in the
title of this Ordinance:
It shall be unlawful for any person, firm or
corporation to erect, construct, enlarge, alter, repair,
move, improve, remove, convert or demolish, equip, use,
occupy or maintain any building or structure in the Town of
Avon or cause or permit the same to be done, contrary to or
in violation of any of the provisions of any of the Codes or
Standards named in the title of this Ordinance.
b. Penalties. Any person, firm or corporation
violating any of the provisions of any of the Codes or

Standards named in the title of this Ordinance shall be
deemed guilty of a misdemeanor, and any such person, firm or
corporation shall be deemed guilty of a separate offense for
each and every day or portion thereof during which any
violation of any of the provisions of any of the Codes or
Standards named in the title of this Ordinance is committed,
continued or permitted, and upon conviction of any such
violation, such person, firm or corporation shall be pun-
ished by a fine of not more than $500.00 or by imprisonment
for not more than 90 days, or by both such fine and impris-
onment.
Section 3. Saving Clause. If any part, section,
subsection, sentence, clause or phrase of this Ordinance or
any of the Codes or Standards adopted hereby are for any
reason held to be invalid, such decisions shall not affect
the validity of the remaining sections of this Ordinance or
any of the Codes or Standards adopted hereby; the Town
Council hereby declares that it would have passed this
Ordinance and adopted the Codes and Standards named in the
title hereto in each part, section, subsection, sentence,
clause or phrase thereof, irrespective of the fact that any
one or more parts, sections, subsections, sentences, clauses
or phrases be declared to be invalid.
INTRODUCED, PASSED ON FIRST READING, APPROVED AND ORDERED
POSTED, THIS 8th day of Februarv , 1983
and a public hearing on this Ordinance shall be held at the
regular meeting of the Town Council of the Town of Avon,
Colorado, on the 22nd day of February , 1983 at
7:30 P.M. in the Municipal Building of the Town of Avon,
Colorado.

OF THE TOWN OF AVON, COLORADO, AT 7:30 P.M. ON THE 22ND DAY OF
FEBRUARY, 1983 AT THE MUNICIPAL BUILDING, 400 BENCHMARK ROAD, AVON,
COLORADO FOR THE PURPOSE OF CONSIDERING THE ADOPTION OF ORDINANCE
NO.#83-7, SERIES OF 1983:
AN ORDINANCE AMENDING SECTION 15.24.010 OF THE AVON MUNICIPAL CODE
AND PROVIDING FOR THE PROTECTION OF THE PUBLIC HEALTH AND SAFETY;
REGULATING THE.INSTALLATION AND MAINTENANCE OF HEATING, VENTILATING,
COMFORT COOLING AND REFRIGERATION SYSTEMS IN THE TOWN OF AVON, COLORADO

A copy of said Ordinance is attached hereto and is also on.file
at the office of the town clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.

Town of Avon, Colorado.
