AN ORDINANCE AMENDING SECTION 17.20.170,
OF THE AVON MUNICIPAL CODE OF THE TOWN OF AVON
AS IT PERTAINS TO ALLOWED DENSITIES
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF AVON AS
FOLLOWS:
Section 1.
Amendment. Section 17.20.170 of the Avon Munici=
pal Code is repealed and reenacted as follows:
(A) Any provision of this Title 17 to the contrary.
notwithstanding, the allowed densities designated on the
official town plat as amended from time to time shall not be
exceeded. Dwelling or accommodation units may be transferred
as a special review use. In the event of any transfer,
whether before or after the effective date of the Ordinance
codified in this section, the allowed densities shall be in-
creased or diminished to the extent of such transfer..
(B) The following described lots shall have allowed
densities as to accommodation units and dwelling units as
designated herein.
1. Lots 25,, 26, 27, 28, and 35, Block 2, of-
ficial plat Town of Avon, Eagle County, Colorado,
and final Subdivision plat--- Amendment Number Four
(4) Benchmark at Beaver Creek, Eagle County, Colorado,
shall have a density of 280 accommodation units in
total'.
2. Lots 29, 30, 31, and 32, Block 2, official
plat Town of Avon, Eagle County, Colorado, and
final Subdivision plat Amendment Number Four (4)
Benchmark at Beaver Creek, Eagle County, Colorado,
shall have a densities as follows:
(a) In the event a hotel/convention center
facility is constructed on said lots, a density of
448 accommodation units or dwelling units, based upon
a formula which provides that three (3) accommodation
units of density shall be subtracted from the
maximum density of 448 accommodation units for each
dwelling unit constructed.
(b) In the event a hotel/convention center
facility is not constructed on said lots, a maximum
density of sixty (60) dwelling units.
(c) These dwelling or accommodation units may not
be transferred from said lots to other lots in the
Town of Avon.
Section 2. Conditions Concerning Use and Development. De-

velopment of Sts 29, 30, 31, and 32, Block 2, official plat
Town of Avon, Eagle County, Colorado, and final Subdivision
plat Amendment Number Four (4) Benchmark at Beaver Creek,
Eagle County, Colorado, shall be subject to the following con-
ditions:
(A) If all or any portion of the above described
lots is developed as a hotel/convention center facility,
such facility shall contain:
1. A 6,000 square foot main meeting room with
provisions for dividing the space into 6-8 smaller
meeting rooms. A storage area of approximately 600
square feet shall join the main meeting room.
2. One (1) 400 square foot executive meeting
room for 15=20 people containing a bar and audio
visual facilities.
3. Four (4) meeting rooms of 250-750 square
feet each for individual private meetings.
4. Appropriate recreational.facilities for the
use of hotel guests as well as the general public in the
Town of Avon, with the general public to be admitted on
a reasonable fee basis. The recreational facilities to
be included in conjunction with any hotel/convention
center containing 400 or more accommodation units or
equivalent dwelling units shall include the following:
3 racquetball/handball courts; 1 squash court; 2 chang-
ing rooms; 1 sauna with dry heat steam room, and
Jacuzzi; 1 weight room; 1 multi-purpose exercise/
meeting room of 1,200 to 1,500 square.feet;'1 35 x
60 foot swimming pool; 1 whirlpool near the swimming
pool; and 1 small pro shop.
(B) The owner of the above described lots shall be
responsible for a fair prorata share of all off-site infra-
structure requirements for roads, water, sewer or parks at-
tributable specifically to the impacts of the development on
those services, in a manner consistent with the normal
requirements of the.Town of Avon or other applicable quasi-
governmental districts. All such off-site infrastructure
requirements and.the work necessitated to meet the same shall
be detailed and reviewed with the Town of Avon Design Review
Board at the time of final design approval, in accordance
with normal procedures relating to Design Review Board ap-
proval of 'such off-site improvements.
(C) If all or any portion of the above described
lots is developed as a hotel/convention center facility,
because the development of a hotel/convention center
facility as described above, and specifically the trans-
portation needs of hotel/convention center guests, will

significantly effect the transportation system provided
by the Town of-Avon, the owner of the above described lots
shall provide to the Town of Avon two (2) thirty (30) foot
long City Cruiser Orion buses (buses similar in design to
those used by Beaver Creek Transit System) for the use of
the Town of Avon Transportation System, or in lieu there-
of, at the option of the Town of Avon, the owner of the
above described lots shall pay to the Town of Avon the
cash equivalent of the two buses described above. Said
buses, or cash in lieu thereof, shall be delivered to
the Town of Avon on or before the approval date
of the final development plans by the Town of Avon.
