SERIES OF 1981
ORDINANCE PROVIDING FOR THE AMENDMENT OF THE
ZONING DISTRICT MAP OF THE TOWN OF AVON BY
THE INCLUSION OF CERTAIN DESCRIBED LAND IN
THE RESIDENTIAL HIGH DENSITY AND COMMERCIAL
ZONE DISTRICT
WHEREAS, S. G. MEYER and KELTON/GARTON/VAUGHAN Venture,
a General Partnership, have filed an application with the
Town of Avon to amend the Zoning District Map of the Town of
Avon by the inclusion of certain newly annexed, presently
unzoned land, being two parcels of land located in the
EhNW4 and the S;INE4 of Section 11, Township 5 South, Range
82 West of the Sixth Principal Meridian, described more
fully herein, within the Residential High Density and
Commercial (RHDC) Zone District; and
WHEREAS, a public hearing was held by the Design Review
Board of the Town of Avon on the 19th day of August, 1981,
at which time the applicants and the public were given an
opportunity to express their opinions regarding the proposed
amendment; and
WHEREAS, after notice as provided by law, a public
hearing occurred before this Council on the 8th day of
September, 1981, at which time the applicants and the public
were given an opportunity to express their opinions regarding
the proposed amendment; and
WHEREAS, based on the evidence, testimony, and exhibits,
and a study of the Town of Avon Master Plan and the recom-
mendations of the Town of Avon Design Review Board, this
Council finds as follows:
1. That proper posting, publication and public notice
was provided as required by law for the hearings before the
Design Review Board and the Town Council of the Town of Avon.
2. That the hearings before the Design Review Board and
the Town Council were both extensive and complete and that
all pertinent facts, matters and issues were submitted at
those hearings.
3. That the proposed amendment to the Zoning District
Map of the Town of Avon is consistent with the Master Plan
for the Town of Avon, provided that certain conditions be
placed upon the uses permitted on the subject property other-
wise allowed within the RHDC Zone District.
4. That impacts which would otherwise adversely affect
adjoining properties may be mitigated by the limitations
placed on the use of the subject property as provided herein
and through a separate agreement between the Town of Avon
and the applicants, to the extent that this Council may
grant the requested amendment to the Zoning District Map of
the Town of Avon.
5. That the requested amendment to the Zoning District
Map of the Town of Avon will be in the best interests of
the health, safety, welfare and morals of the citizens of
the Town of Avon, provided that the conditions herein pro-
vided be complied with.

NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF AVON, COLORADO, THAT:
Section 1. Amendment to Zone District Map.
The Zoning District Map of the Town of Avon be and
hereby is amended by the inclusion of that real property
described as two tracts of land located in the EhNWh and
the ShNEh of Section 11, Township 5 South, Range 82 West
of the 6th Principal Meridian, Eagle County, Colorado,
more particularly described in Exhibit "A" attached here-
to within and as a part of the Residential High Density
and Commercial Zone District.
Section 2. Conditions Upon Uses Within Area Zoned.
The uses within the aforementioned real property shall
be subject to the following conditions and limitations:
a. That the use of the property shall be limited
to 140 residential units, commercial uses limited to 9,000
square feet (of which not more than 4,000 square feet shall
be a restaurant unit, and not more than 5,000 square feet
shall be other types of commercial units), and such non-
commercial, recreational open space uses as may be speci-
ficially approved by the Design Review Board of the Town
of Avon.
b. That improvements on the property shall not be
divided on a time-share basis.
c. That no structure exceeding 60 feet of height
shall be constructed on the subject property except within
that area described in Exhibit "B" hereto, within which
area structures may be erected up to but not exceeding the
maximum otherwise allowable in the RHDC Zone District, as
more specifically defined and limited on Exhibit "B".
d. That the foregoing limitations shall be incorp-
orated into the covenants running with the subject property
upon the development thereof, which limitations shall be
subject to the approval of the Town and shall not be amended
without the consent of the Town.
e. That the portion of the subject property north
of the Eagle River shall be used only for park land or open
space, subject to the right of the Avon Metropolitan
District or its successors in interest to conduct activities
thereon related to water wells or water storage on such
portion of the subject property.
Section 3. Effective Date.
The amendment to the Zoning District Map of the Town of
Avon provided herein shall take effect in accordance with
the Charter and Ordinances of the Town of Avon, and the
Mayor is hereby directed and authorized to execute such
maps as may be required to reflect the amendment herein
authorized, and to file a certified copy of the amended
Zoning District Map with the County Clerk and Recorder of
Eagle County, Colorado.
INTRODUCED, PASSED, READ ON FIRST READING, APPROVED AND
ORDERED PUBLISHED ONCE IN FULL, this Z42qday of September,
1981, and a public hearing on this Ordinance shall be held
at the regular meeting of the Town Council of the Town of
Avon, Colorado, on the day of pee, 1981,
at 7:30 PM in the Municipal Offices of the Town.

1981 AT THE MUNICIPAL.BUILDING,, 400-BENCHMARK ROAD, AVON FOR THE
PURPOSE,iOF CONSIDERING THE ADOPTION OF ORDINANCE N0.#81=29, Series of
1981:
AN ORDINANCE PROVIDING FOR THE AMENDMENT OF THE ZONING DISTRICT MAP OF THE
TOWN OF AVON BY THE INCLUSION OF CERTAIN DESCRIBED LAND IN THE RESIDENTIAL
HIGH DENSITY AND COMMERCIAL ZONE DISTRICT.
A copy of said ordinance is attached hereto and is also on file at
the office of the Town Clerk and may be inspected during regular business
hours.
Following this hearing, the Council may consider final passage of this
ordinance.

A G R E E M E N T
This Agreement dated as of the day of
October, 1981, by and between the TOWN OF AVON, COLORADO
(hereinafter the "Town") and S. G. MEYER and KELTON/
GARTON/VAUGHAN Venture, a General Partnership (hereinafter
collectively the "Developers"):
R E C I T A L S:
1. The Town is a political subdivision of the
State of Colorado governed by the Home Rule Charter of the
Town of Avon and the Statutes of the State of Colorado, and
in such capacity the Town has the right and responsibility
to provide for the zoning of areas within the corporate
limits of the Town;
2. The Developers own property recently annexed
to the Town and have requested that the subject property,'
described on "Exhibit A" be placed in the Residential High
Density Commercial (RHDC) zone district.
3. The parties have agreed that certain uses
otherwise allowed in the RHDC zone district may be'undesir-
able for the subject property due to irregular terrain and
proximity to geographical features and other land uses
adjacent to the subject property, but that generally the
RHDC zoning is most appropriate for the subject property.
NOW, THEREFORE, IT IS AGREED by the parties:
1. That the Town shall take appropriate action by
ordinance to amend the zone district map of the Town of
Avon, Colorado, to provide for the inclusion of the subject
property in the RHDC zone district, which Ordinance shall
provide that'the inclusion of the subject property in the
RHDC zoned district shall be subject to certain specific
limitations set forth herein;
2. That the Developers agree that the property
shall be subject to the following limitations affecting the
right to use the property for purposes otherwise arguably
allowed within the RHDC zone district:
A. That use of the property shall be limited
to 140 residential units, commercial uses limited to 9,000
square feet, (of which not more than 4,000 square feet shall
be a restaurant unit, and not more than 5,000 square feet
shall be other types of commercial units), and such non-
commercial, recreational and open-space uses as may be
specifically approved by the Design Review Board of the Town
of Avon.
B. That improvements constructed on that
property shall not be divided on a time-share basis.
