Series of 1981 i AN ORDINANCE ANNEXING TO THE TOWN OF AVON TWO PARCELS OF LAND LOCATED IN THE Eh NWk, AND THE S'i NEk SECTION 11, T. 5 S., R. 82 W. OF THE 6TH P.M., EAGLE COUNTY, COLORADO; AND SETTING FORTH FINDINGS AND CONCLUSIONS AND OTHER DETAILS THERETO. WHEREAS, a petition for annexation to the Town of Avon of a certain parcel of real property, being two parcels of land located in the E:~ NW4 and the Sh NE4 Section 11, T. 5 S., R. 82 W., of the 6th P.M., Eagle County, Colorado, more particularly de- scribed on Exhibit "A", attached hereto and made a part hereof, has been submitted to the Town Cerk of the Town of Avon and refer red therefrom to the Town Council; and WHEREAS, the owners of one hundred percent of the real property proposed for annexation, exclusive of the streets and alleys, are S. G. MEYER and KELTON/GARTON/VAUGHN, a General Partnership; and t WHEREAS, in accordance with Section 31-12-107 (1) (g), C.R.S. 1973, as amended, the Town Council may by ordiance annex the above specified property without notice, hearing or election inasmuch as the petition was signed by one hundred percent of the, owners of the area proposed to be annexed; and s WHEREAS, the Town Council is of the opinion that the petition should be granted and that the subject real property t should be annexed to the Town of Avon; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF s THE TOWN OF AVON, COLORADO, THAT: Section 1. Findings. i The Town Clerk of the Town of Avon has referred to the Town Council a petition for annexation of a certain parcel of real property (hereinafter referred to as the "subject property," I i and as more specifically described in Exhibit "A" attached hereto; t 0 • and incorporated herein by this reference) being two parcels of land located in the Ek NW34, and the S35 NE4 Section 11, T. 5 S., R. 82 W. of the 6th P.M., Eagle County, Colorado, and the Town Council specifically finds upon review of said petition: (A) The petition is in substantial compliance with the requirements of Section 31-12-107 (1) (g), C.R.S. 1973, as amended. (B) The petition was signed by the owners of one hundred percent of the area proposed to be annexed, exclusive of streets and alleys. (C) The subject property is eligible for annexation to the Town of Avon in that at least one-sixth of its boundaries are contiguous with the Town of Avon, and there is a community of interest between the Town of Avon and the subject property, and the subject property will be urbanized in the near future, and it is capable of being integrated into the Town of Avon. (D) There are no limitations to the annexation of the subject property to the Town of Avon in that no land held in identical ownership has been divided without the written consent of the landowners thereof, and no land held in identical ownership comprising twenty acres or more with an assessed valua- tion in excess of $200,000 for ad valorem tax purposes has been included without the written consent of the owner, and no other annexation proceedings have been commenced by another municipalit3 with relation to the subject property, and no area will be detach- ed from a school district by this annexation. (E) No additional terms or conditions are to be imposed upon this annexation. (F) The subject property may be annexed by ordinance without notice, hearing or election in accordance with Section 31- 12-107 (1)(g), C.R.S. 1973, as amended. Section 2. Annexation. The real property described as two parcels of land located in the E;I NW-34 and the S3~ NE4 Section 11, T. 5 S., R. 82 W. of the 6th P.M., Eagle County, Colorado, and more particularly -2- 0 0 described in Exhibit "A" attached hereto is hereby annexed to the Town of Avon, Colorado. Section 3. Effective Date,. The annexation and this ordinance shall take effect in accordance with the Charter of the Town of Avon and the Town Clerk is directed-to file for recording two certified copies of this ordinance and map of the area annexed containing a legal description of such- area with the County. Clerk- and Recorder of the County of Eagle, Colorado. G. MEYER and KELTON/ GARTON/VAUGHAN Venture, a General Partnership (hereinafter collectively the "Developers"): R E C I T A L S: 1. The Town is a political subdivision of the State of Colorado governed by the Home Rule Charter of the Town of Avon and the Statutes of the State of Colorado, and in such capacity the Town has the right and responsibility to provide for the zoning of areas within the corporate limits of the Town; 2. The Developers own property recently annexed to the.Town and have requested that the subject property, described on "Exhibit A" be placed in the Residential High Density Commercial (RHDC) zone district. 3. The parties have agreed that certain uses otherwise allowed in the RHDC zone district may be undesir- able for the subject property due to irregular terrain and proximity to geographical.features and other land uses adjacent to the subject property, but that generally the RHDC zoning is most appropriate for the subject property: NOW, THEREFORE, IT IS AGREED by the parties: 1. That the Town shall take appropriate action by ordinance to amend the zone district map of the Town of Avon, Colorado, to provide for the inclusion of the subject property in the RHDC zone district, which Ordinance shall provide that the inclusion of the subject property in the RHDC zoned district shall be subject to certain specific limitations set forth herein; 2. That the Developers agree that the property shall be subject to the following limitations affecting the right to use the property for purposes otherwise arguably allowed within the RHDC zone district: A. That use of the property shall be limited to-140 residential units, commercial uses limited to 9,000 square feet, (of which not more than 4,000 square feet shall be a restaurant unit, and not more than 5,000_ square feet shall be other types of commercial units),, and such non- commercial,.recreational and open-space•uses as may be specifically approved by the Design Review Board of the Town of Avon. B. That improvements constructed on that property shall not be divided on a time-share basis. C. That no structure exceeding 60 feet of height shall.be constructed on the subject property, except within that. 'area described'in "Exhibit B" hereto, within which area structures may be erected up'to but not exceeding the maximum height otherwise allowable in the RHDC zone district as more specifically defined and limited on "Exhibit B". -1- 0 9 D. That the foregoing limitations shall be incorporated into the covenants running with the subject property upon the development thereof, which limitations shall be subject to the approval of the Town and shall not be amended without the consent of the Town. E.
