AN ORDINANCE ADOPTING BY REFERENCE THE COLORADO MODEL ENERGY
EFFICIENCY CONSTRUCTION AND RENOVATION STANDARDS FOR NON-RESIDENTIAL
BUILDINGS OF THE STATE OF COLORADO AND THE COLORADO RECOMMENDED
ENERGY CONSERVATION "PERFORMANCE" CODE FOR NEW CONSTRUCTION AND
RENOVATION OF RESIDENTIAL BUILDINGS, AND PROVIDING A PENALTY FOR
VIOLATION THEREOF.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN
OF AVON AS FOLLOWS:
Section 1. Adoption.
Codes Adopted by Reference: Pursuant to Title 31, Article 16,
Part 2, C.R.S. 197j, as amended, there is hereby adopted as the
energy efficiency construction and renovation standards for non-
residential buildings of the Town, by reference thereto, the Colorado
Model Energy Efficiency Construction and Renovation Standards for
Non=residential Buildings, Adopted November 1977, and published March,
1978, by the State of Colorado, Office of Energy Conservation, 1600
Downing, Second Floor, Denver, Colorado; 80218, and as the energy
efficiency construction and renovation---standards for residential
buildings of the Town, by reference thereto, the Colorado Recommended
Energy Conservation "Performance" Code for New Construction.and
Renovation of Residential Buildings adopted November, 1977, and
published March, 1978, and amended in 1979 by the State.of Colorado,
Division of'Housing State Housing Board, 1313 Sherman Street, Denver,
Colorado, 80203, both to have the same force and effect as'if set forth
herein in every particular. The subject matter of the adopted standards
include comprehensive provisions and standards regulating energy
efficiency in the design, construction, renovation, erection,-enlarge-
ment, alteration, repair, conversion, occupancy, equipment and main-
tenance of certain non-residential and residential buildings and
structures for the purpose of protecting the public health-,-safety and
general welfare. Three (3) copies of each publication are now filed
in-.the office of the Clerk of the Town and may be inspected during
regular business hours. The above publications are being adopted as
if set out at length.
__:.:Section 2. Additions and Modifications: The Colorado Model
Energy Efficiency Construction and Renovation Standards for Non-
residential Building is hereby amended as follows:
1. Section 101.1 is deleted in its entirety.
2. Section 302.1 is amended by the inclusion of the following
temperatures:

3. Section 502.2(a). Table 5-1 is amended by the addition of
the following specific values:
"Walls, 3 stories or less. Heating U not exceeding .22.
"Walls, 3 stories or less, Cooling, OTTV not exceeding 33.4.
"Walls:--over 3 stories Heating U not exceeding .28.
"Walls over 3 stories Cooling OTTV not exceeding 33.4.
"Roof/Ceiling. Heating or Cooling U not exceeding .06.
4. Delete all of 510.0 through Table 510-C and add:
"510.0: Lighting. The building lighting shall be designed
in accordance with the following methods:
"(a)Lighting Power Budget. For purposes of establishing a
budget, a Room Cavity Ratio (RCR) shall be calculated for each
rectangular area of identical use within ceiling height
boundaries-,-by the following formula:
RCR = 5 H (L + W)

Where L = Length of space (ft.)
W = Width of space (ft.)
H = Vertical distance (ft.) from the work
plane to the lighting fixture plane.
"A value of watts per square foot shall be selected from
Table 510A based on the applicable area category and Room
Cavity Ratio, and this value shall be multiplied by the floor
area in square feet to obtain watts. This calculation shall
be made for all areas of the building and these values shall
be summed to yield a total allowable lighting voltage. This
total.allowable lighting wattage is the maximum amount of
lighting power for the building, which may then be allocated,
as desired provided this value is not exceeded.
"NOTE: Irregular areas should be approximated by a minimum,number
of rectangles and the corresponding Room Cavity Ratios used
for each rectangular area.
"EXCEPTIONS: The following area of classes of lighting equipment
maybe exempt from the criteria of (a) of this section:
"1. Local task lighting fixtures applied to an indi-
vidual location with switching under the user's immediate
control, such as, but not limited to, a desk lamp, a work
light on a machine,.,-or a dental examination light.

'2'. Lighting for special applications where the
lighting is an essential technical element for the
function performed, such as theatrical performances,
spectator sports, surgery, and emergency and exit
lighting.
"(b) Illumination Budget. If the total allowable lighting wattage
value determined by the calculations outlined in (1) above is
exceeded, then the illumination shall be determined by a method
acceptable to the Building Official.
"510.1. LightingSwitching and Control. Each area-e nclosed by
ceiling height partitions shall have independent control of the
lighting in that area through localized switching devices located
within the area.
"NOTE: It is recommended that switching, circuiting or dimming be
provided for lighting in task areas larger than 150 square
feet to reduce the lighting level by at least one-half when
.the task i.§_not_being performed or is relocated."

5. Residential Buildings: The following provisions shall apply to
all R-1 and R-3 Buildings:
Insulation and thermal performance standards and energy conserving
alternatives.
(1)(a) The following design parameters shall be used for
calculations required under this section. Computations
submitted by a licensed architect or engineer, contractors,
builders and owners shall be considered as acceptable when
calculated by acceptable engineering procedures.

(2)(4) Any separate envelope component of a residential building
that is heated shall not exceed the combined thermal transmittance
value (Uo) derived from equation 1 using values in Table 2.,
Equation 1 shall be used to determine acceptable combinations
to meet the required Uo values.

(b) If all exposed concrete walls average less than two feet-
above grade, those walls are exempt from the calculations for UW
and insulation.
(c) Heating equipment shall be sized using climate data from.
Table 1 in subsection (1) of this section.
(d) The design of a subterranean building may take into
consideration the insulating values of undisturbed earth or fill
as approved by the building official.
(3) (a) If any segment (wall, floor, roof) of the exterior envelope
does not comply with the standards prescribed in subsection (`2)
of this section, the thermal transmittance value (Uo) of any other
segment (wall, floor, roof) may be decreased so that the resulting,
thermal transmittance value (uo) of the envelope complies as if the
building had been designed in compliance with subsection (2)-of
this section. For this purpose, reduction of the thermal trans-
mittance value of any of the other exterior components of the
envelopes- , may be used to achieve compliance.

(b) bse of the equation provided in paragraph (a), of this-
subsection (3)3equire't two sets of calculations. The first
calculation utilizes the Uo values obtained from subsection
(2) of this section and the actual areas of the proposed
residential design. The second calculation utilizes the actual
U values, and the actual areas of the proposed residential design.
(4) Computations submitted indicating that the total fossil fuel energy
required ina residential building, through design or otherwise,
equals or is less than the total fossil fuel energy used if the
dwelling is built or renovated according to standards contained in
subsections (1) and (2) of this section shall be considered an
acceptable alternative. The total fossil fuel energy required shall
be computed'as the annual estimated Btu's necessary for the proposed
residential building.
(5) Residential biildings may also show compliance with this code by
demonstration using Chapters 4, 5 or 6 of the non-residential
portion of the State Code, using the appropriate tables for
residential construction.

Section 3. Violations and Penalties.
a-.- Violations. The following clause concerning violations is herby
set forth in full and adopted with reference to all of the Codes and
Standards named in the,title of this Ordinance:
It 'shall be'unlawful for'any person, firm or corporation to
erect, construct, enlarge, alter, repair, move, improve, remove,
convert or demolish, equip, use, occupy _or maintain any building
or structure in the Town of Avon or cause or permit the same to.be
,done-,.contrary to or-.in violation of any of the provisions of any of
-the Codes or Standards named in the title of-this Ordinance.
b. Penalties. Any person, firm or corporation violating any of the
provisions of any of the Codes or Standards named in the title-of this
ordinance shall be deemed-guilty of a misdemeanor, and any, such person,
firm or corporation shall be deemed guilty of a separate offense for each
and every-day or'portion thereof during which any violation of any of the
provisions of any of the Codes or Standards named in the title of this
Ordinance is committed, continued or permitted, and-upon conviction of
any such violation, such person, firm or corporation shall.be punished
by a fine of not more than $300.00 or by imprisonment for not more than
90 days, or by both such fine and imprisonment.
Section A.' Saving Clause. If any part, section, subsection, sentence,
clause,or phrase of this Ordinance or any of the Codes or Standards
adopted hereby are for.any reason held to be invalid, such decisions
shall not affect the validity of the remaining sections of this
Ordinance or any of the Codes or Standards adopted hereby; the Town
council hereby declares that it would have passed this Ordinance and
adopted the Codes and Standards named in the title hereto in each-
part, section, subsection, sentence, clause or phrase thereof,
irrespective of the fact.that nay one or more parts, sections, subsections
sentences, clauses or phrases be declared to be invalid.
