TC Ord. No. 1981-02ORDINANCE NO. 81-2 AN ORDINANCE PROVIDING REGULATIONS FOR MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF AVON, COLORADO, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF. SECTION 1. Existing Parks. Subsequent to the effective date of this Ordinance, all existing mobile home parks shall be inspected by the Building Administrator, who shall utilize the services of the Eagle County Environmental Health Officer and any Special District Officers to determine if the same conform to the provisions of this Ordinance. Any non-conformance shall be reported to the park owner and a reasonable time period shall be established to cause the park to conform to the provisions of this Ordinance. Failure on the part of a park owner to cause conformance within the established time shall be deemed a violation of this Ordinance. SECTION 2. New Park or Addition to Existing Park. Each new park or addition to an existing park shall conform to all provisions of this Ordinance. SECTION 3. Park Site; General Requirements. 1. Mobile Home Space: Each mobile home space shall contain at least 3,000 square feet of area for a single-wide unit, and 4,200 square feet for a double-wide unit. The minimum space between any two mobile homes or habitable appurtenances thereto shall be 20 feet. The area of placement for the mobile home shall be graded for drainage and improved to prevent shifting or settling of the mobile home. Each mobile home space shall provide paved parking spaces for at least two automobiles, either on the space adjacent to it or within the park, or by any combination of these locations. 2. Driveways and Walkways: All mobile home spaces shall abut upon a driveway graded for drainage and maintained in a rut and dust-free condition and which provides unobstructed access to a public street or highway. The minimum unobstructed width of such driveways shall be 16 feet. An additional 8 feet bf width shall be constructed for each parallel parking space adjacent thereto, or 20 feet for perpendicular or angle parking space adjacent thereto, or 28 feet for double-loaded perpendicular parking spaces. All driveways and walkways within the park shall be illuminated to insure safety for park residents. 3. Paving of Parking and Driving Areas: All mobile home parks shall have paving in the parking and driving areas thereof. 4. Maintenance of Mobile Home Lots: All mobile home lots and stands shall be maintained in a clean and sanitary condition, free from hazardous or noxious materials, weeds, refuse and motor vehicles having-no current license plate. SECTION 4. Individual Mobile Homes; Requirements. 1. No person, firm or corporation shall place a mobile home within the Town of Avon, Colorado, without first obtaining a permit therefor from the Building Administrator. 2. No permit for a mobile home or any alteration or addition thereto shall be issued unless the, same complies with all requirements of the Building Codes (including electrical, plumbing, and mechanical) which were in effect in the Town of Avon, Colorado, at the time such mobile home was placed in the Town of Avon, Colorado. 3. This Section 4 shall not apply to alterations or additions to a mobile home of less than 50 square feet in area. 4. Section 4, subparagraph 1 above, shall not apply to a mobile home located within the Town of Avon, Colorado, on the effective date of this Ordinance. 2. • SECTION 5. Water Supply and Distribution; General Requirements. 1. A domestic water supply that is in compliance with the drinking water standards of the Colorado Department of Health shall be provided in each mobile home. Where a public supply of water of satisfactory quantity, quality and pressure is available, connection shall be made thereto and its supply used exclusively. 2. Every well or section line of the water supply system shall be located and constructed in such manner that neither under- ground or surface contamination will reach the water supply from any source. 3. The treatment of a private water supply shall be in accordance with applicable laws and regulations. 4. Water Distribution System for a New Park or an Addition to an Existing Park: (a) the water supply system of the park shall be connected by pipes to all mobile homes, buildings and other facilities requiring water; (b) all water piping, fixtures and other equipment shall be constructed and maintained in accordance with state and local regulations and requirements and shall be of a type and in locations as reasonably acceptable to the Building Administrator; (c) the system shall be so designed and maintained as to provide a pressure of not less than 20 nor more than 80 pounds per square inch under normal operating conditions at service buildings and other locations requiring potable water supply; (d) a minimum horizontal separation of 10 feet shall be maintained between all domestic water lines and sewer lines; (e) underground "stop and waste" valves shall not be installed on any water service; and 3. (f) all fire hydrant locations and specifications shall be approved by the Avon/Eagle-Vail Fire Chief, or his designated representative in the Fire Department. 5. Source of Supply for New Parks or Additions to Existing Parks: The water supply shall be capable of supplying a minimum of 450 gallons per day per mobile home. 6. Individual Water Riser Pipes and Connections for New Parks or Additions to Existing Parks: (a) Water riser pipes shall extend at least four inches above the ground elevation, unless recessed in a box-or a sleeve. The pipes shall be at least 3/4-inch. The water outlet shall be capped when a mobile home does not occupy the lot. (b) Adequate provision shall be made to prevent freezing of main service lines, valves and riser pipes and to protect risers from heaving and thawing actions of ground in freezing weather. Surface drainage shall be diverted from the location of the riser pipe. (c) A shut-off valve shall be provided near the water riser pipe on each mobile home lot. 7. Existing Mobile Home Parks: Existing mobile home parks shall not be required to conform to subparagraphs 4, 5 and 6 of Section 5, except that all water supply and distribution systems shall be maintained in accordance with the state and local regulations and requirements. SECTION 6. Fire Protection; General Requirements. It shall be the responsibility of the duly authorized attendant or caretaker to inform all tenants about means for summoning fire apparatus, police department and the park employees. 1. Portable fire appliances: 4. 0. 0, (a) Each mobile home owner or tenant shall be required to install an approved fire extinguisher inside each mobile home.- Proof of the required installation must be furnished to.the fire department and shall.be the responsibility of the mobile home owner.. SECTION 7. Sewage disposal; General Requirements. An adequate sewage system shall be provided in each mobile home park for the-purpose of conveying and disposing of all sewage. Such system shall be designated, constructed and maintained in accordance with state and local laws. 1. Sewer Lines: All sewer lines shall be located in trenches of sufficient depth to be free of breakage from traffic or other movements and shall maintain a minimum horizontal separation of 10 feet from all domestic water lines. Sewers shall be at a grade which insure a velocity.of two feet per second when flowing full. All sewer lines shall be constructed of materials accepted by state or local laws and shall meet design criteria of the'Colorado State Department of Health. 2. Individual Sewer Connections: Each mobile home stand shall be provided with at least a four-inch diameter sewer riser pipe. The sewer riser pipe shall be located on each stand that the sewer connection to the mobile home system outlet will approximate a vertical position. (a) The sewer connection shall have a nominal inside diameter-of at least three inches and the slope of any portion thereof shall be at least 1/8-inch per foot. The sewer -5 y ~ • connection shall consist of one pipe line only, with no more than one stand served by one individual sewer connection. Underground branch fittings of four-inch lines shall not be permitted. All joints shall be watertight. (b) All materials used for sewer connections shall be rigid or semi-rigid, corrosive resistant, nonabsorbent and durable. The inner surface shall be smooth. (c) Provisions shall be made for plugging the sewer riser pipe when a mobile home does not occupy the lot. The rim of the riser pipe shall extend at least four inches above ground elevation unless such riser pipe is protected two inches within a recessed box or sleeve. 3. This Section 7 shall only apply to new parks or to additions to existing park`s": Notwithstanding this subparagraph 3, however, all mobile home parks shall be maintained in accordance with state and local laws, shall comply with subparagraph (b) above and shall make provision for plugging the sewer riser pipe when a mobile home does not occupy the lot. SECTION 8. Electrical Distribution and Communication Wiring. Each mobile home park shall contain an electrical distribution system to each lot or site consisting of wiring, fixtures, equipment and appurtenances thereto which shall be installed in accordance with the electrical code and maintained in accordance with the electrical code in effect in the Town of Avon, Colorado at the time of such installation. SECTION 9. Mobile Home Park Gas Distribution Systems. 1. Underground piping shall be buried a suffio.ient depth or covered in a manner so as to protect the piping from physical damage. Consideration should be given to protect the piping from physical damage when it passes through flower beds, shrub beds and other cultivated areas. 6. S i • 2. Gas piping in new mobile home parks or in additions to existing mobile home parks shall not be installed underground beneath a mobile home stand unless it is installed in an_ approved gas tight conduit and, if installed underground within the mobile home park, shall otherwise comply with the provisions of the National Fuel Gas Code (NFPA No. 54-1974; ANSI Z223.1-1974). 3. A readily accessible and identified shut-off.valve controlling the flow of gas to the entire gas piping system shall be installed near to the point of connection to the service piping or supply connection of the liquified petroleum gas container. 4. Each mobile home lot shall have an accessible gas shut-off valve installed. Such valve shall not be located under a mobile home. Whenever the mobile home lot outlet is not in use, the shut-off valve shall be plugged to prevent accidental discharge. 5. Each mobile home utilizing gas shall be connected to the mobile home lot outlet by a listed flexible mobile home connector of sufficient capacity to supply gas to the connected lead. Approved rigid pipe and fittings shall be used between the flexible connector and the mobile home lot gas outlet when the distance between the mobile.home lot gas outlet and the mobile home gas service connection exceeds six feet. This paragraph 5 shall be the responsibility of the mobile home owner. 6. Protection From Physical Damage: All gas outlet risers, regulators, meters, valves or other exposed equipment shall be protected from physical damage by vehicles or other causes. 7. Maximum Pressure Permitted - Natural Gas: Gas supplied into the mobile shall not exceed one-half pound per square inch gage or 14 inches water-column. 7. 8. Maximum Pressure Permitted - Propane: 1. Propane supplied into, the mobile home shall not exceed 6 oz. square inch at the meter head. SECTION 10. Service Building; General Requirements. 1. The requirements for this Section shall apply to service buildings, recreation buildings and other cummunity service facilities in new parks or in additions to existing parks, such as: (a) management offices, repair shops and storage areas; (b) sanitary facilities; (c) laundry facilities; (d) indoor recreation areas; and (e) commercial uses supplying essential goods or services for the exclusive use of park occupants. 2. Structural Requirements for Buildings: (a) All buildings shall comply with all requirements of the Building Codes (including electrical, plumbing and mechanical) in effect in the Town of Avon, Colorado at such time as such buildings were erected, and no building shall be erected, altered or repaired unless a permit therefor has first been obtained from the Building Administrator. (b) All portions of the structure shall be properly protected from damage by ordinary uses and by decay, corrosion, termites and destructive elements. Exterior portions shall be of such materials and so constructed and protected as to prevent entrance or'penetration of moisture and weather. (c) All rooms containing sanitary and laundry facilities shall: (i) Have sound-resistant walls extending to the ceiling between male and female sanitary facilities. 8. Walls and partitions around showers, bathrubs, lava- tories and other plumbing fixtures shall be constructed of dense, non-absorbent waterproof material or covered with moisture resistent material. (ii), have at least one window or skylight facing directly to the outdoors. The minimum aggregate gross area of windows for each required room shall be not less than 10 percent of the floor area served by them; and shall have at least one window which can be easily opened, or a mechanical device which will adequately ventilate the room. (iii) Toilets shall be locked in separate compart- ments equipped with self-closing doors; shower stalls shall be of the individual type. The rooms shall be screened to prevent direct view of the interior when the exterior doors are open. (iv) Illumination levels shall be maintained as follows: (1) general seeing tasks - five foot candles; (2) laundry room work area - 40 foot candles; (3) toilet room in front of mirrors - 40 foot candles. (v) Hot and cold water shall be furnished to every lavatory, sink, bathrub, shower and laundry fixture, and cold water shall be furnished to every closet and urinal. SECTION 11. Supervision; General Requirements. 1. The duly authorized attendant or caretaker shall be in charge at all times to keep the park facilities and equipment in a clean, orderly, safe and sanitary condition. There shall, at all reasonable times, be a person on the premises designated to handle emergencies. The name and phone number of such person shall be conspicuously posted at all times. 9. 2. The owner shall be answerable for the violation of any provision of this Ordinance, unless otherwise designated as a mobile home owner's responsibility. 3. The storage, collection and disposal of refuse in mobile home parks shall be so arranged so as to create no health hazards, rodent harborage, insect breeding areas, accident or fire hazards, or air pollution. All refuse shall be disposed of at either a municipal or county designated landfill site. 4. Grounds, buildings and structures shall be maintained free of insect and rodent harborage and rodent infestation. Ex- termination methods and other measures to control insects and rodents shall conform with the requirements of the Colorado State Department of Health. 5. All owners and managers of a mobile home park or all owners or persons in charge of any dog, cat or other pet animal shall have such animal on a leash not exceeding 10 feet, or shall confine such animals within the space or designated areas within the park and shall not permit such "animal to commit any nuisance and shall at all times comply with the ordinances of the Town pertaining to animal control. Nothing contained in this subparagraph 5, however, shall restrict the mobile home park owner from adopting rules and regulations more restrictive than this subparagraph 5. SECTION 12. Mobile Home Park Operating License. Each mobile home park covered by this Ordinance shall be required to apply for and obtain an operating license from the Building Administrator. Said license shall be issued on an annual basis, with a 90-day grace period for renewals. The amount of the fee shall be $100.00, plus $3.00 per space. SECTION 13. Inspections. Whenever necessary to make an inspection to enforce this Ordinance, or whenever there is reasonable cause to believe there exists in any building or upon 10. any premises within the jurisdiction of the Town a violation of this Ordinance, any authorized official of the Town or the Fire Department may, upon presentation of proper credentials, enter such building or premises at any and all reasonable times to inspect the same or to perform any duty imposed upon him by Ordinance; provided that, except in emergency situations, he shall give the occupant, or the owner if there is no occupant, if he can be located after reasonable effort, 24 hours' written notice of the authorized official's intention to inspect. In the evert the occupant, or the owner if there is no occupant, refuses entry, said official is empowered to seek assistance from any court of competent jurisdiction in obtaining such entry. SECTION 14. Variances. Any owner of a mobile home park may make application to the Design Review Board for a variance from the provision of this Ordinance. Such application may be granted upon a showing that compliance with the provision would be a hardship and that non-compliance will not cause any hazard to the health, safety or welfare of the inhabitants of the mobile home park. SECTION 15. Conflicting Provisions. Nothing contained herein shall be construed so as to relieve compliance with all other applicable ordinances of the Town of Avon and statutes of the-State of Colorado. Whenever any provision of this Ordinance conflicts with any provision of any other ordinance of the Town or statute of the State of Colorado, the more restrictive provision shall control. SECTION 16. Penalties. Any person, firm-or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a violation of this Ordinance, and any such person, firm or corporation shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation is committed, continued or permitted and upon conviction of any such violation, such person, firm or corporation shall be punished by a fine of not more than $300.00 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. 11. SECTION 17. Saving Clause. If any part, section, sub- section, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining sections of this Ordinance. The Town Council hereby delcares that it would have passed this Ordinance in each part, section, subsection,.,sentence, clause or phrase thereof, irrespective of the fact that any one or more parts, sections, subsections, sentences, clauses or phrases be declared to be invalid.
