ORDINANCE NO.- 80-29
SERIES OF 1980
AN ORDINANCE AMENDING ORDINANCE NO. 78-7 TO PROVIDE THAT
THE TOWN'S SALES TAX REMAIN AT THE RATE OF 3% FOR CAL-
ENDAR YEAR 1981 AND SUBSEQUENT YEARS.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON AS FOLLOWS:
Section 1. Amendment.
Paragraph 5 of Section 5, Ordinance No. 78-7 is
amended to read as follows:
"a. There is hereby imposed on all sales of tan-
gible personal property at retail and the furnishing of
services,°as herein*provided,.a tax equal to-for the cal-
endar year 1978, one percent (1%), for the calendar year
1979, two percent (2%), and for the calendar year 1980
and all subsequent year thereafter, three percent (3%)
of,gross receipts derived from such sales of tangible
personal property and the furnishing of services. The
tangible personal property and services taxable pursuant
to this Ordinance shall be the same as the tangible personal
property and services taxable pursuant to Section 39-26-104,
Colorado Revised Statutes 1978, as amended. The imposition
of the--tax on individual sales shall be in accordance
with schedules set forth in rules and regulations promul-
gated by the Department of Revenue of the State of Colorado
or by separate ordinance of the Town of Avon. If any
vendor, during any reporting period, shall collect as a
tax an amount in excess of the current tax on his total
taxable sales, he shall remit to the Director of Revenue
the full amount of the tax herein imposed and also such
excess."
Section'2. Saving Clause.
If any part,'section, subsection, sentence, clause
or phrase of this Ordinance is for any reason held to be
invalid, such decision shall .not affect the validity of
the remaining sections of this ordinance; the Town'"Council
hereby declares that it would have passed this Ordinance
in each part, section, subsection, sentence, clause or

phrase thereof, irrespective of the fact that any one
or more parts, sections, subsections, sentences, clauses
or phrases be declared to be invalid.

NOTICE IS HEREBY GIVEN OF A PUBLIC HEARING BEFORE THE TOWN COUNCIL
OF THE TOWN OF AVON, COLORADO, AT 7:30 P.M. ON THE 13th DAY OF
JANUARY, 1981 AT THE TOWN HALL FOR THE PURPOSE OF CONSIDERING THE
ADOPTION OF ORDINANCE N0.#80-29, SERIES OF 1980:
AN ORDINANCE AMENDING ORDINANCE NO.#78-7 TO PROVIDE THAT THE
TOWN'S SALES TAX REMAIN AT THE RATE OF 3% FOR CALENDAR YEAR 1981
AND SUBSEQUENT YEARS.
A copy of said Ordinance is attached hereto and is also on file
at the office of the Town Clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
This notice given and published by order of the Town Council of
the Town of Avon, Colorado.
