AN ORDINANCE AMENDING THE SUBDIVISION
REGULATIONS OF THE-TOWN OF AVON TO
INCREASE FEES FOR SUBDIVISION APPLI-
CATION REVIEW AND FURTHER AMENDING
SAID REGULATIONS WITH RESPECT TO
CERTIFICATES FOR AMENDED PLATS AND
CONDOMINIUM PLATS
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF.AVON;
FOLLOWS:°
_ Section 1.- Amendment. Section 2.07, Ordinance No. 9,1
Series of-1979, is amended to read as follows:
"2.07 -FEES '
At the time of submitting an Application, a fee shall
be paid in accordance with the following schedule:
2.07.01 Exemption . . . . . . . . . . . . . . . $ 50.00
2.07.02 Variance . . . . . . . . . . . . . . . $ 56.00''
2.07.03 Sketch Plan
(a) for plans with 3 or fewer lots $ 50.00
(b) for plans with more than 3 lots. $ 50.00
Plus $3.00 per.lot
2.07.04 Preliminary Plan
(a) for plans with 3 or fewer lots $ 50.00/lot
(b) for plans with more than 3 lots. $200.00
Plus $10.00 per lot
2.07.05 Final Plat (Subdivision)
(a) all plats . . . . . . . . . $ 50.00
Plus $10.00 per lot
(b) fees required herein do not include those
required by the County Clerk and Recorder
or other agencies for filing.
2.07.06 Condominium (including Townhouse).Plats

2.07.07 Any-of the above fees may be increased, waived, reduced
or adjusted by the Town Council upon specific request
and for good cause shown.
2.07.08 Additional Fees::
The Town:may also assess and collect such additional
fees as it may deem appropriate; provided that, when
operating pursuant to the authority granted by this
provision,'the Town shall base such additional fees
upon the,actual cost of performing review and inspec-
tioh'and'related services. Such additional fees may
be charged on a per unit basis, such as per foot or
per mile, and the Town may also include in'such
additional fees a factor for overhead or other
indirect expenses."
Section 2. Amendment. Item C of the Appendices to
Ordinance No. 9, Series of 1979, is amended to read as follows:
"C. Town Certificate:
This Plat, uses, densities, standards and
definitions are approved by'the Town Council of
the Town of Avon, County of Eagle,, State of
Colorado this . . . . . day of . . . . • . . .
A,.D., 19. . . for filing with the Clerk and
Recorder of the County of Eagle and for con
veyance to the Town of Avon of the public
dedications shown hereon subject to the pro-
vision that approval in no way obligates the
Town of Avon for financing or constructing of
improvements on lands, streets, or easements
dedicated except as specifically agreed to by
the Town Council and further that said approval
shall in no way obligate the Town of Avon for
maintenance of streets until construction of
improvements thereon shall have been completed
to the satisfaction of the Town Council. This
plat is hereby adopted as Amendment No... . to
the official Plat for the Town of Avon. Approval
of this plat by the Town is a consent only and is
not to be construed as an approval of the techni-
cal correctness of this plat or any documentation
relating thereto.

Section 3. Amendment. Item C-1 of the Appendices
to Ordinance No. 9, Series of 1979, as amended'by"Ordinance No. 8,
Series of 1980, is amended to read as follows:
"C-1 Town Certificate (Amended Plat):
This Plat, including vacation of any lot .
lines, easements and rights of way, previously
dedicated and not dedicated hereon, is approved
by the Town Council of the Town-of Avon, County
of Eagle, Colorado this . . day of . . . .
A.D., for filing with the Clerk and
Recorder of the County of Eagle and for convey-
ance to the town of the public dedications shown
hereon, the same to supercede the prior Plat; -
subject to the provision that approval in no way
obligates the Town of Avon for financing or con-
struction of improvements on lands, streets or
easements on lands, streets or easements dedicated
except as specifically agreed-to by the Town
Council and further that said,approval shall in
no way obligate the Town of,Avon for maintenance
of streets until construction of improvements
thereon shall have been completed to the satis-
faction of the Town Council. This plat is hereby
adopted as Amendment No. to the Official Plat,
for the Town of Avon. Approval of this plat by

Section 5. Saving Clause. If any part, section,
subsection, sentence, clause or phrase of this Ordinance is for
any reason held to be invalid, such decision shall not-affect
the validity of the remaining sections of this Ordinance; the
Town Council hereby declares that it would have passed this
Ordinance in each part, section, subsection, sentence, clause
or phrase,thereof,.irrespective'of the fact-that any one or more,
parts,'sections, subsections, sentences, clauses or phrases be
declared-to be invalid.

NOTICE IS HEREBY GIVEN OF A PUBLIC HEARING BEFORE THE TOWN COUNCIL
OF THE TOWN OF AVON, COLORADO, AT 7:30 P.M. ON THE 9th DAY OF
DECEMBER, 1980 AT THE TOWN HALL FOR THE PURPOSE OF CONSIDERING THE
ADOPTION OF ORDINANCE N0.#80-27, SERIES OF 1980:
AN ORDINANCE AMENDING THE SUBDIVISION REGULATIONS OF THE TOWN OF
AVON TO INCREASE FEES FOR SUBDIVISION APPLICATION REVIEW AND FURTHER
AMENDING SAID REGULATIONS WITH RESPECT TO CERTIFICATES FOR AMENDED
PLATS AND CONDOMINIUM PLATS.
A copy of said Ordinance is attached hereto and is also on file
at the office of the Town Clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
This notice given and published by order of the Town Council of
the Town of Avon, Colorado.
