TOWN OF AVON
ORDINANCE NO. 19
SERIES OF 1980
AN ORDINANCE AMENDING ORDINANCE NO. 17, SERIES OF 1979,
TO DEFINE THE OFFENSES OF "FOREIGN MATTER ON HIGHWAY" AND
"SPILLING LOADS ON HIGHWAYS"; AND PROVIDING PENALTIES
FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
AVON, COLORADO AS FOLLOWS:
Section 1. Amendment
Paragragh 6, Section H., "Text," of Ordinance No. 17,
Series of 1979, is amended to read as follows:
6. Title 8, Chapter 8.24 is hereby adopted in its
entirety including the footnotes, except as follows:
Section 8.24.030 shall be amended to include
the words, "Provided that firing or the dis-
charging of such weapons was reasonable in
light of all the attendant circumstances."
following the words "person or property."
in the eighth line of the text and the period
at the end of that line shall be changed to
a comma.
Further, that Section 8.24.140 which sets out
the penalties for violations of the preceeding
sections, which penalties are also set out generally
elsewhere in this Ordinance.

Further, that a Section 8.24.051 is added as
follows:
8.24.051. Foreign matter on highway prohibited.
(1) No person shall throw or deposit upon any
highway, street, or alleyway any glass bottle,
glass, stones, nails, tacks, wire, cans, or
other substance likely to injure any person,
animal, or vehicle upon such highway, street,
or alleyway.
(2) Any person who drops, or permits to be dropped
or thrown, upon any highway, street, or alleyway
any destructive or injurious material or lighted
or burning substance shall immediately remove the
same or cause it to be removed.
(3) Any person removing a wrecked or damaged
vehicle from a highway, street, or alleyway
shall remove any glass or other injurious substance
dropped upon the highway, street, or alleyway,
from such vehicle.
Further, that a section 8.24.052 is added as
follows:
8.24.052. Spilling loads on highways prohibited.
No vehicle shall be driven or moved on any highway,
street, or alleyway unless such vehicle is constructed
or loaded or the load thereof securely covered to
prevent any of its load from dropping, sifting,
leaking, or otherwise escaping therefrom; except
that sand may be dropped for the purpose of securing
traction, or water or other substance may be
sprinkled on a roadway in cleaning or maintaining
such roadway.

Section 2. Violations and Penalties.
It is unlawful for any person to violate any provision
hereof. Any person who violates any provisions of this ordinance
shall be punished by a fine of not more than three hundred
dollars or by imprisonment for a period of not more than ninety
days or by both such fine and imprisonment: provided, no
person under the age of eighteen years shall be punished by
imprisonment. Any such person shall be guilty of a separate
offense for each and every day during any portion of which a
violation of any provision of this code is committed, continued,
or permitted by such person and shall be punished accordingly.
Section 3. Severability
If any provision, clause, phrase of section of this
Ordinance or the application thereof to any person or circumstance
is held invalid, such invalidity shall not affect other provisions,
clauses, phrases or sections or applications of the Ordinance
which can be given effect without the invalid provisions or
applications and to this end the provisions or applications of
this ordinance are declared to be severable.

regular meeting of the Town Council of the Town of Avon,
Colorado, on the day of 1980, at
7:30 p.m. in the Municipal Offices Qf the Town.

NOTICE IS HEREBY GIVEN OF A PUBLIC HEARING BEFORE THE TOWN COUNCIL
OF THE TOWN OF AVON, COLORADO, AT 7:30 P.M. ON THE 12th DAY OF
AUGUST, 1980 AT THE TOWN HALL FOR THE PURPOSE OF CONSIDERING THE
ADOPTION OF ORDINANCE N0.#80-19, SERIES OF 1980:
AN ORDINANCE AMENDING ORDINANCE NO.17, SERIES OF 1979, TO DEFINE
THE OFFENSES OF "FOREIGN MATTER ON HIGHWAY" AND "SPILLING LOADS
ON HIGHWAYS"; AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
A copy of said ordinance is attached hereto and is also on file
at the office of the Town Clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.
