ORDINANCE NO. 14
SERIES OF 1980
AN ORDINANCE AMENDING THE ZONING CODE FOR THE TOWN OF AVON,
ORDINANCE NO. 79-12, TO DEFINE "TIME-SHARING UNIT;" TO CHANGE
THE DEFINITIONS OF "MULTIPLE-FAMILY DWELLING" AND "HOTEL, MOTEL
AND LODGE;" TO MAKE TIME-SHARING UNITS A SPECIAL REVIEW USE.
1. Amendment.
Subsection (c), paragraph (21), Section 3.1, Article
III, Ordinance No. 79-12, is amended to read as follows:
(c) Multiple-family Dwellin : A dwelling containing
three (3) or more dwelling units, not including
hotels, lodges, or dwellings containing time-
sharing units, but including townhouses, con-
dominiums and apartments with accessory use
facilities limited to an office, laundry, re-
creation facilities and off-street parking used
,by the occupants."
2. Amendment.
Paragraph (30), Section 3.1, Article III, Ordinance 79-12,
is amended to read as follows:
(30) Hotel, Motel, and Lodge: A building containing
three (3) or more accommodation units, not in-
cluding time-sharing units, intended for temporary
occupancy of guests. Accessory use facilities
may consist of an office, laundry facilities used

by the occupants, recreation facilities,
a lobby or lounge, kitchen and dining fac-
ilities and similar accessory uses commonly
found in association with a commercial hotel or
lodge operation and meeting requirements of the
particular zone district in which the building
is located."
3. Amendment.
Section 3.1, Article III, Ordinance No. 79-12, is
amended by the addition of a paragraph (60) to read as follows:
"(60) Time-Sharing Unit: Any parcel or lot of land or
condominium unit, whether fee interest, leasehold
or contractual right, whereby more than four per-
sons (ownership of an interest in joint tenancy by
two Persons being considered one person for the
purpose of this section) are entitled to the use,
occupancy or possession of such lot, parcel or unit
according to a fixed or floating time schedule
occuring periodically over any period of time
(the use, occupancy or possession of each person
being exclusive of that of the others). The meaning
of "time-sharing unit" shall include, but not be
limited to a time-share estate.as defined in Section
38-33-110, Colorado Revised Statutes (1973), as
amended."
4. Amendment.
"Special Review Uses, "paragraph (5). "RHDC," Section
3.2, "Chart of District Intent Allowed and Special Review Uses,"
Article III, Ordinance No. 79-12, is amended to read as follows:

"Open use recreation; No horses allowed;
Indoor recreation; Motorized vehicles
showrooms; signs as per sign code; pub-
lic uses, time-sharing units"
Section 4. Saving Clause.
If any part, section, subsection, sentence, clause or
phrase of this Ordinance is for any reason held to be invalid, such
decision shall not affect the validity of the remaining sections
of this Ordinance; the Town Council hereby declares that it would
have passed this Ordinance in each part, section, subsection, sen-
tence, clause or phrase thereof, irrespective of the fact that any
one or more parts, sections, subsections, sentences, clauses or
phrases be declared to be invalid.

BLISHED ONCE IN FULL, this 9-T4-day o , 1980 and a public
hearing on this Ordinance shall be held t t regular meeting of the
Town Council of the Town of Avon, Colorado, on the ? day of
1980, at 7:30 P.M. in the Municipal Offices of the Town.

NOTICE IS HEREBY GIVEN OF A PUBLIC HEARING BEFORE THE TOWN COUNCIL
OF THE TOWN OF AVON, COLORADO, AT 7:30 P.M. ON THE 22nd DAY OF
JULY, 1980 AT THE TOWN HALL FOR THE PURPOSE OF CONSIDERING THE
ADOPTION OF ORDINANCE N0.#80-14, SERIES OF 1980:
AN ORDINANCE AMENDING THE ZONING CODE FOR THE TOWN OF AVON,
ORDINANCE NO.#79-12, TO DEFINE "TIME-SHARING UNIT;" TO CHANGE
THE DEFINITIONS OF "MULTIPLE-FAMILY DWELLING" AND "HOTEL, MOTEL
AND LODGE;" TO 14AKE TIME-SHARING UNITS A SPECIAL REVIEW USE.
A copy of said Ordinance is attached hereto and it also on file
at the office of the Town Clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage of
this Ordinance.

the Town of Avon, Colorado.
