SERIES OF 1979
AN ORDIINANCE AMENDING ORDINANCE NO.2, SERIES OF 1979, ALSO KNOWN
AS ORDINANCE 79-2; PROVIDING FOR CERTAIN CONSTRUCTION STANDARDS
IN REGARD TO THE FIRE RATING OF PARTY WALLS AND SEPARATION WALLS.
WHEREAS, the Town of Avon is presently experiencing
increased construction activity; and,
WHEREAS, the Town Council is concerned with the public
health, safety and welfare of the citizens of the Town of Avon;
and,
WHEREAS, the Design Review Board of the Town of Avon
has reviewed and recommended the following Amendments;
NOW THEREFORE be it ordained by the Town Council of the
Town of Avon, Colorado, that:
Ordinance number 2 of the Series of 1979 shall be and is
hereby amended as follows:
Section 1. Intent of this Ordinance.
To set minimum requirements for construction and con-
struction methods, of walls, partitions, and floor-ceiling assemblies
that separate individual dwellings and/or dwelling units, to retard
the spread of fire between dwellings and/or dwelling units.
Section 2. Scope.
The requirements of this Ordinance shall be in addition
to those requirements of the Uniform Building Code adopted by the
Town of Avon and shall not be construed to reduce, nullify, or
otherwise modify and portion thereof except as specifically
described herein. In the event that any Code duly adopted by the
Town of Avon requires construction assemblies or methods
superior to the requirements of this Ordinance, the more stringent
requirements shall take precedence.
Section 3. Definitions.
A. Common Construction Assemblies.
Construc on assemblies that are shared by, or that
separate, two or more adjacent dwellings and/or dwelling
units, or between other types of occupanies, tenant spaces,
businesses, offices, or other uses.
B. Common Walls or Partitions (Party Walls.)
Those walls and or partitions that separate two or
more individual adjacent dwellings and/or dwelling units, or
between other types of occupanices, tenant spaces, offices, or
other uses.
C. Common Floor-Ceiling Assemblies.
Floor-Ceiling construction systems that separate
two or more individual and adjacent dwellings and/or dwelling
units, or other types of occupancies, tenant spaces, offices,
or other uses.
D. Corridors.
Corridors shall refer to all entryways, passage-
ways, and exits, when two or more dwelling units are served
by said "corridors", regardless of size, enclosures, or length.
Section 4. Additions b this ordinance.
Common walls andr partitions (party walls) shall
be of not less than 1-hour fire resistive construction, and
shall extend from floor to ceiling and exterior wall to
exterior wall or other common wall. Common walls shall be
extended up into attic spaces by use of draft stops or may
terminate at roof-ceiling construction systems if the ceiling
is not less than 1-hour fire resistive construction.
Common walls, of not less than 1-hour fire resistive
construction shall be extended through decks, balconies, or
other projecting elements unless those elements are separated
by a distance equal to or greater than the distance of the
longest projection but not less than five feet.
Common floor-ceiling assemblies shall have
ceilings of not less than 1-hour fire resistive construction.
All exterior corridors shall have 1-hour fire
resistive walls. Openings to such corridors shall have not
less than 3/4 hour fire rating with automatic closures, and
all walls shall be 1-hour fire resistive to the roof, or
ceiling, whichever is applicable.
Fire alarm systems shall be provided for every
building which contains 15 or more dwelling units, regardless
of separation walls which are required, and in any size
building which has a common entryway serving three or more
dwelling units. Wiring for alarm systems shall be in metal
conduits.
Section 5. Saving Clause.
If any part, sermon, subsection, sentence, clause
or phrase of this Ordinance or any of the Codes or Standards
adopted hereby are for any reason held to be invalid, such
decisions shall not affect the validity of the remaining
sections of the ordinance or any of the Codes or Standards
adopted hereby; the Town Council hereby declares that it would
have passed this Ordinance and adopted the Codes and Standards
named in the title hereto in each part, section, subsection,
sentence, clause or phrase thereof, irrespective of the fact
that any one or more parts, sections, subsections, sentences,
clauses or phrases be declared to be invalid.
Section 6. Repeal.
Any or all ordinances or parts of ordinances of the
Town of Avon, in conflict or inconsistent herewith, are hereby
repealed; provided, however, that such repeal shall not affect
any offense committed or act done, any penalty or forfeiture
incurred or any contract, right or obligation established
prior to the time of such repeal.

NOTICE IS HEREBY GIVEN of a public hearing before the Town Council
of the Town of Avon, Colorado,aat 7:30 P.M. on the day of July
at the Town Hall for the purpose of considering the adoption and
AN ORDINANCE NO. 2, SERIES OF 1979, ALSO KNOWN AS ORDINANCE 79-2; PRO-
VIDING FOR CERTAIN CONSTRUCTION STANDARDS IN REGARD TO THE FIRE
RATING OF PARTY WALLS AND SEPARATION WALLS.
A copy of said Ordinance is attached hereto and is also on file
at the office of the Town Clerk and may be inspected during regular
business hours.
Following this hearing, the Council may consider final passage
of this Ordinance.
This meeting is open to the general public.
This notice given and published by order of the Town Council of
the Town of Avon.
