TC Minutes 04-26-2011MINUTES OF THE REGULAR MEETING OF THE AVON TOWN COUNCIL
HELD APRIL 26, 2011
A regular meeting of the Town of Avon, Colorado was held at the Avon Town Hall, One Lake Street,
Avon, Colorado in the Council Chambers.
Mayor Rich Carroll called the meeting to order at 5:35 PM. A roll call was taken and Council members
present were, Dave Dantas, Chris Evans, Kristi Ferraro, Todd Goulding, Amy Phillips, and Buz Reynolds.
Also present were Town Attorney Eric Heil, Town Manager Larry Brooks, Assistant Town Manager Patty
McKenny, Assistant Town Manager Community Development Sally Vecchio, Assistant Town Manager
Finance Scott Wright, Town Engineer Justin Hildreth, Director PW &T Jenny Strehler, Community
Relations Officer Jaime Walker and Deputy Town Clerk Catherine Mythen, as well as other staff
members and the public.
AGENDA APPROVAL & DISCLOSURE OF POTENTIAL CONFLICT OF INTEREST
Town Attorney Eric Heil noted that there was no conflict of interest for the meeting.
COMMUNITY & CITIZEN INPUT
a. Chad Donnelly & Scott Stoughton, gave a brief follow up report update on the Snowball Music
Festival Event. They highlighted the following:
➢ 9,500 people were in attendance
➢ Demographic info
➢ Impact on economy
➢ Potential for growth
b. Community Input regarding the Snowball Music Festival Event
• Steven Wood, President of Beaver Bench Condo Owners Association (letter and response only)
which requested payments on costs of their service related to the event
• Carol Warren spoke about the festival and the negative impacts on the community related to
drug and alcohol use
• Jake Wolfe, music teacher from Avon Elementary School, commented on the positive effect on
participating in the event had on the kids that performed, supported more events that would
embrace young kids
• Phil Struve commends the town for the great work but disliked the event and would prefer to
focus on family events in the town
• Ricardo Aregon, Manager Fiesta Jalisco, commented on the great impact it had on his
restaurant and that these were the three busiest days of the winter season
• Michael Cappico commented that the town needs events like this and commends the staff,
promoters and Avon police for the incredible job that was done on this weekend
• Brian Colzo, Vail Mountain Taxi, commented that this was a great event and his business was
busy all 3 days and had little problems during those 3 days
CONSENT AGENDA
Mayor Carroll asked for a motion on the consent agenda. Mayor Pro Tern Ferraro moved to approve
the consent agenda; Councilor Dantas seconded the motion and it passed unanimously.

NEW BUSINESS
The votes for the Planning and Zoning members were taken and compiled by Patty McKenny, Assistant
Town Manager- Management Services. The results indicated that Chris Green, Paul Anderson, John
Minirvini and Jim Clancy were selected as Avon's New Planning and Zoning Commissioners. The votes
were as follows:
✓ In Favor of Paul Anderson: Carroll, Dantas, Evans, Ferraro, Goulding, Phillips ,Reynolds
✓ In Favor of Jim Clancy: Carroll, Evans, Ferraro, Goulding, Phillips, Reynolds
✓ In Favor of Chris Green: Carroll, Dantas, Evans, Ferraro, Goulding, Phillips, Reynolds
✓ In Favor of John Minirvinni: Carroll, Evans, Dantas, Ferraro, Goulding, Reynolds
✓ In Favor of Paul Siemonsma: Phillips, Dantas
It was noted that John Minirvini would serve the 1 year term.
ORDINANCES
Eric Heil, Town Attorney presented Ordinance No. 11 -05, Series of 2011, First Reading on this
Ordinance Adopting the 2010 Model Traffic Code by Reference and Repealing and Reenacting Sections
of the Title 10 of the Municipal Code. This Ordinance No. 11 -05 repeals, reorders, replaces and updates
all of the Article III Amendments in Avon Municipal Code sections 10.04.060 through 10.04.130. Many
changes are simply to update cross - references and citations to follow the 2010. Councilor Goulding
moved to approve Ordinance No. 11 -05, Series of 2011, First Reading, Ordinance Adopting the 2010
Model Traffic Code by Reference and Repealing and Reenacting Sections of the Title 10 of the
Municipal Code. Councilor Phillips seconded and it passed unanimously.
MAYORS REPORT
Mayor Carroll mentioned that the Town Council had been invited to a luncheon with the town of Vail
on May 3`d. Topics for discussion are as follows:
• US Pro Cycling Event
• Rushworks A/V Equipment, Town of Vail, Avon, and Channel 5
• Potential Affordable Housing Efforts
• Regional/Three Mile Land Use Planning Update
• Regional Water Quality Programs Update
• 2015 Championships: possibly a topic for a future luncheon
EXECUTIVE SESSION
Council Phillips moved to meet in Executive Session at 6:50 PM Councilor Evans seconded the motion
and it passed unanimously. The following reason was noted for the discussion:
a. For the purpose of receiving legal advice to specific legal questions pursuant to Colorado
Revised Statute §24- 6- 402(4)(b) related to pending litigation regarding Town of Avon v Traer
Creek Metropolitan District, 2008 CV 0385 and Traer Creek, LLC, et.aL v Town of Avon 2010 CV

The Executive Session adjourned at 7:25 PM and convened to the regular meeting.

There being no further business to come before the Council, the meeting adjourned at 7:25 pm.
