MINUTES OF THE REGULAR MEETING OF THE TOWN COUNCIL
HELD AUGUST 10, 1999
A regular meeting of the Town of Avon, Colorado was held in the Municipal Building,
400 Benchmark Road, Avon, Colorado in the Council Chambers.
The meeting was called to order by Mayor Judy Yoder at 5:30 PM. A roll call was taken
with Councilors Jim Benson, Debbie Buckley, Rick Cuny, Mac McDevitt, Buz Reynolds,
and Mayor Protem Bob McIlveen present. Also present were Assistant Town Manager
Larry Brooks, Town Attorney Burt Levin, Town Clerk Kris Nash, Special Events
Coordinator Dana Maurer, Recreation Director Meryl Jacobs, Town Planner Karen
Griffith, Director of Community Development Mike Matzko, Town Engineer Norm
Wood as well as members of the press and public.
Citizen Input
C.J. Cheneir Concert Update
Special Events Coordinator Dana Maurer updated Council on the C.J. Cheneir concert to
be held in Nottingham Park on Wednesday, August 11 from 5:30 to 9:30 PM. The
concert is the second in the Avon Summer Concert Series. The Harry Baxter Band will
open for C.J. Cheneir. There will be a beer garden sponsored by the Vail Valley Tourism
and Convention Bureau as well as some food vendors. It is a free concert.
Also, the BobSummerFest will be held August 21 in Nottingham Park. The Bob-b-que
is scheduled from 12:00 - 2:30 PM. There will be entertainment by Airborne, and the
food will be catered by Shirkie's Rolling BBQ. The concert begins at 4:00 PM featuring
Trish Murphy, Julian Lennon, and Soul Asylum. There will be a beer garden, food
vendors, and arts and craft vendors.
The final concert in the Avon Summer Concert Series is September 8. The Flood Plain
Gang plays at 5:30 PM and the John Cowan Band follows. This event will also have a
beer garden, food vendors, and arts and craft vendors.
Ordinances
Second Reading of Ordinance No. 99-17, Series of 1999, An Ordinance Approving the
Lot 5, Nottingham Station PUD and Development Standards, Lot 5, Nottingham Station,
Town of Avon, Eagle County, Colorado
Mayor Yoder stated this is a public hearing.
Town Planner Karen Griffith stated this ordinance is to establish a PUD on Lot 5,
Nottingham Station. There is only one residence currently on the property, and the
Nottingham's want to establish a second lot. The Town recommends approval.
There being no comment from the public, Mayor Yoder closed the public hearing.
Councilor Benson motioned approval of Ordinance No. 99-17, Series of 1999 on second
reading. Councilor Buckley seconded the motion.
Mayor Yoder asked for a roll call.
The motion carried unanimously.
Ordinances
First Reading of Ordinance No. 99-18, Series of 1999, An Ordinance Amending Chapter
10.04 of the Avon Municipal Code Relating to Traffic Violations Committed in Specified
Residential Areas; and Providing Penalties for the Violation Thereof
Town Attorney Burt Levin stated the ordinance specifies residential areas in the town
where the Municipal Judge could double the fines for traffic violations. The areas are the
Wildridge Subdivision, Hurd Lane east of Avon Road, Stonebridge Drive, Eaglebend
Drive and W. Beaver Creek Blvd. between Highway 6 and Benchmark Road. Moving
violations in those areas will be subject to fines doubled.
Councilor Benson asked if there had to be signage stating fines doubled. Mr. Levin
stated yes. Councilor Benson asked if the signs could be a different color. Mr. Levin
stated Public Works Superintendent Bob Reed will be responsible for the signs. Mr.
Levin was not sure if the signs had a uniform requirement in terms of color. Assistant
Town Manager Brooks stated staff will look into signage color requirements.
Mr. Levin stated individuals can only be subject to the increased penalties after
appropriate signage has been posted.
Councilor Cuny asked if the amount of the fine was discretionary of the judge. Mr. Levin
stated Judge Buck Allen has a schedule for fines for speeding violations. This ordinance
will allow him to double the monetary fine. The ordinance is modeled after an ordinance
the Town has for doubling fines in school zones.
Mayor Protein McIlveen motioned approval of Ordinance No. 99-18, Series of 1999 on
first reading. Councilor McDevitt seconded the motion.
Mayor Yoder asked for a roll call.
The motion carried unanimously.

d.) Financial Matters
Councilor Cuny motioned approval of the Consent Agenda. Councilor McDevitt
seconded the motion. The motion carried unanimously.
There being no further business to come before the Council, Councilor Cuny motioned to
adjourn the meeting. Councilor McDevitt seconded the motion. The motion carried
unanimously. The meeting was adjourned at 5:39 PM.
