MINUTES OF THE REGULAR MEETING OF THE TOWN COUNCIL
HELD SEPTEMBER 9, 1997 - 5:30 P.M.
A regular meeting of the Town Council of the Town of Avon,
Colorado was held in the Municipal Building, 400 Benchmark Road,
Avon, Colorado, in the Council Chambers.
The meeting was called to order by Mayor Jack Fawcett at 5:45 PM.
A roll call was taken with Councilors Jim Benson, Richard Carnes,
Buz Reynolds, Sr., Buz Reynolds, Jr., and Mayor Protem Judy Yoder
present. Councilor Bob McIlveen was absent. Also present were
Town Manager Bill Efting, Town Clerk Patty Lambert, Town Attorney
John Dunn, Police Chief Gary Thomas, Fire Chief Charlie Moore,
Town Engineer Norm Wood, and Administrative Assistant Jacquie
Halburnt, as well as members of the press and public.
Citizen Input:
Michael Corral's Concerns
Mr. Corral, a Wildridge citizen, voiced several concerns. Mr.
Corral's first concern regarded the odor ordinance. Mr. Corral
thought that if the Town imposed fines on the water and sewer
district, the district would pass along the fines to the
consumers with increased fees. Mr. Corral requested the real
estate transfer tax $80,000 exemption be raised. Mr. Corral
requested open space be zoned or dedicated accordingly so that it
would take an election for any change. Mr. Corral voiced
concerns about home based businesses and requested they be
clarified. Mr. Corral requested P & Z prefer xeroscaping, to
conserve water. Mr. Corral informed he is counting the months
until the 1998 candidate election.
Ordinances:
First Reading of Ordinance No. 97-10, Series of 1997, AN
ORDINANCE AMENDING TITLE 5 OF THE TOWN OF AVON MUNICIPAL CODE TO
PROVIDE FOR THE REGULATION OF PAWNBROKERS
Councilor Yoder motioned to table Ordinance No. 97-10, Series of
1997 until the next meeting. Councilor Benson seconded the
motion.
Mayor Fawcett called for a roll call vote.
The motion carried unanimously.
Ordinances:
First Reading of Ordinance No. 97-11, Series of 1997, AN
ORDINANCE AMENDING TITLE 8 OF THE MUNICIPAL CODE OF THE TOWN OF
AVON; DECLARING ODOR POLLUTION TO BE A PUBLIC NUISANCE; PROVIDING
REGULATIONS WITH RESPECT THERETO; AND PROVIDING PENALTIES FOR THE
VIOLATION HEREOF
Town Attorney John Dunn reviewed Ordinance No. 97-11. Attorney
Dunn suggested the following amendments;
1.) on page 2, correct the error on the first line by deleting
the capital F;

2.) on page 2, in section 8.31.030 Al, the third line where it
reads, "been diluted with 7 or more volumes of", that for purpose
of first reading, the 7 be stricken and a blank put in. Staff
will investigate that further as to what may be a more
appropriate standard;
3.) in sub-paragraph 3 of that same paragraph A, the second line,
that 10 be changed to 3;
4.) on page 3, section 8.31.030 B1, the third line from the end
of that paragraph 1, change notification to plan;
5.) at the end of that paragraph, add the line, "and the work
concluded within the time established in the plan";
6.) page 4, section 8.31.040 A, the third line, delete building
division of, so that it just reads "the Town's Community
Development Department";
7.) page 5, section 8.31.040 F, paragraph 3 will be deleted
Councilor Benson motioned to approve Ordinance No. 97-11, Series
of 1997, as amended by Town Attorney John Dunn. Councilor Yoder
seconded the motion.
Mayor Fawcett called for a roll call vote.
The motion carried unanimously.
Mayor Report:
Mayor Fawcett announced that Council's Tuesday, September 23rd
meeting will not be held and will be moved to Tuesday, September
30th. There will be a work session on Wednesday, September 24th,
as opposed to September 23rd.
Consent Agenda:
a.) Approval of the August 26, 1997 Council Meeting Minutes
b.) Financial Matters
Councilor Yoder motioned to approve the consent agenda.
Councilor Benson seconded the motion and the motion carried
unanimously.
There being no further business to come before Council, Mayor
Fawcett called for a motion to adjourn. Councilor Benson moved
to adjourn. The motion was seconded by Councilor Reynolds, Jr.
The meeting was adjourned by Mayor Fawcett at 6:35 PM.
