MINUTES OF A SPECIAL MEETING OF THE TOWN COUNCIL
HELD JUNE 18, 1991 - 4:00 P.M.
The Special Meeting of the Avon Town Council of the Town of Avon,
Colorado, was held in the municipal Building, 400 Benchmark Road,
Avon, Colorado, in the Council Chambers.
The meeting was called to order by Mayor Jerry Davis at 4:13 p.m.
A roll call was taken with Albert Reynolds, Mike Bennett, Gloria
McRory, Jim Stovall and Tom Ptach present. Councilman Garton was
absent. Also present were Town Attorney John Dunn, Town Manager
Bill James, Director of Community Development Rick Pylman, Director
of Engineering Norm Wood, Director of Municipal Services Larry
Brooks, Public Relations Officer Teresa Albertson, Town Clerk Patricia
J. Doyle, as well as members of the public.
The first item under unfinished business was Resolution NO. 91-16,
Series of 1991, A RESOLUTION APPROVING THE FINAL PLAT OF THE CLAIVIN
PROJECT, A RESUBDIVISION OF LOT 2, BLOCK 1, WILDRIDGE SUBDIVISION, TOWN
OF AVON, EAGLE COUNTY, COLORADO.
Rick Pylman stated that David Marshall had submitted an application
requesting Town Council approval of the final plat of the Claivin
Project. He stated that if the final plat was approved the plat
would create six townhouse lots and three common area tracts on the
property. Utility easements necessary for the proper functioning of the
project have been created and would be shown on the plat. He
stated that the plat had been reviewed by Town staff and was found to
be in general conformance with Town of Avon Subdivision Regulations
for a final plat.
Staff recommended approval of Resolution No. 91-16, Series of 1991
subject to:
1. The completion of technical corrections as identified by the
Town Engineer and Town Attorney.
Mr. Pylman stated that the Association would maintain the common
area of the project.
After some discussion, Councilman Bennett moved approval of Resolution
No. 91-16, Series of 1991. The motion was seconded by Councilman
Reynolds and was unanimously carried.

Next on the agenda was an update of the Wildwood Townhomes.
Mr. James stated that he had received a letter from Bolduc Realty
and Management, Inc. The Homeowners Association of the Gosshawk
Townhouses had concerns of the Wildwood Townhomes Project. They had
concerns that the staff did not inform neighboring property owners in
advance of the undertaking. That the Town was using tax monies to
acquire properties and may have to use general funds to finish the
project (See letter attached to these mintues).
It was stated that staff followed all the guidelines as far as notices
sent to all adjacent property owners.
The Council agreed that Mr. James call Mr. Bolduc and discuss the
Council's comments.
The letter of Mendel-Allison was discussed. They were one of the bidders
for the Wildwood Townhome Project.
Mr. James reviewed the"schedule of the post-closing conditions to
disbursements from the Constructiot'Fund. He stated that staff would
be sending letters to the sixty five applicants that qualified for the
units and inform them of what the Town was doing.
Mr. James recommended Colorado First Construction to proceed with the
Affordable Housing project.
Discussion followed.
Councilman Stovall stated that all the bids were rejected, and he would
not accept any bid that was $400,000 over budget. Secondly, he asked
why the architect was not re-designing the project to meet the Town's
criteria.
Rick Pylman stated that when you get down to this degree you are not
in the architect's area of expertise. The contractor would have a
better feel of where they could re-design and save money.
E.J. Albright with Colorado First Construction approached the Council.
He stated that they have built an access of one hundred twenty million
dollars worth of projects. He stated that they have built more
western slope employee housing projects than any other contractor in
the state. They have been building in Aspen and in Summit County.
Further discussion followed.
The consensus of the Council seemed to be in agreement with Colorado
First Construction with some changes in the Letter of Intent.
The Town-Attorney recommended that wordage be placed in the Letter
of Intent such as, "The decision of whether to proceed with the project
shall be made by the Town in its sole and absolute discretion".

Councilman Bennett moved to authorize the Town Manager and the Town
Attorney to proceed with the Letter of Intent with the changes
outlined by John Dunn. The motion was seconded by Councilman
Reynolds and was unanimously carried.
The Council directed the Town Manager to call Mendel-Allison to inform
them of what---the Town was doing.
In regard to informing property owners of future projects or
revisions of the Code, the Mayor suggested that staff needed to make
a extra effort to notify major land owners.
Mr. James reported on the Brittany Summit Entertainment. He stated
that Brittany-Summit Entertainment was not interested in putting on
the concert in Nottingham Park after staff had discussed the concerns
of the Council. Mr. Cupo decided to move the concert to a different
location.

There being no further business to come before the Council, Councilman
Bennett moved to adjourn. The motion was seconded by Councilman Ptach.
The mseting was adjourned by Mayor Davis at 5:45 p.m.

The Homeowners Association of Gosshawk Townhouses are contacting
you and your fellow members, of the Avon Town Council with some
concerns regarding the proposed Wild Wood Townhouses.
Owners are very upset that the staff of the town has not found it
necessary to inform neighboring property, owners in advance of this
undertaking. We are of the opinion'that it is legally required
under local, state and federal regulations to consult and inform
adjoining property owners whenever a project is planned. This is
definitely the case whenever a public. agency is undertaking a
project.
Owners are very concerned that no staff of the Town of Avon found
it necessary to submit outlines of the project and the impact on
existing townhomes. Gosshawk Homeowners have been taxpayers for
.many years and should be considered as citizens of Avon.
We are also concerned that the town is using tax monies to acquire
properties and may have to use general funds to finish this
project. What are the guarantees for any cost overruns?
The owner's of Gosshawk Townhouses are requesting in writing where
the Town of Avon has the authority.
We would also like to point out that under HUD regulations,- a
environmental impact statement has to be prepared 'and that the
adjoining property owner-needs to be consulted. How can the town
even obtain bids when this requirement has not been fulfilled.
The cost factor of the environmental effect on us has to be
included in the Invitation for Bids in order for the bidders to
submit a valid bid.
Please be assured that we will do everything possible to assert our
rights in this matter.
