MINUTES OF THE REGULAR MEETING
OF THE TOWN OF AVON, COUNCILMEMBERS
HELD NOVEMBER 10, 1981 - 7:30 P.M.
The regular meeting of the Town Councilmembers of the Town of Avon, Colorado was held in
the Municipal Building in the Council Chambers.
The meeting was called to order by Mayor Alpi at 7:40 p.m. A roll call was taken with the
Councilmembers in attendance with the exception of Allan Nottingham who was absent. Also
present were Town Attorney John Dunn as well as members of the press and public.
The Mayor stated that both Judge Rosenberg and Deputy Judge Blish had to disqualify them-
selves from a future trail because of conflict and they have asked the Council to appoint
another Deputy Judge to hear the case. Steve Erickson moved approval to appoint Buck Allen
as Deputy Judge, seconded by Sheila Davis and was unanimously carried.
The Council selected two Councilmembers to be appointed to the Zoning Advisory Committee.
They are Larry Kumpost and A.J. Wells. Sheila Davis so moved, seconded by Bill Doyle and
was unanimously carried.
Second reading of Ordinance No.#81-30, Series of 1981, AN ORDINANCE CONCERNED WITH AMENDING
THE MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES, 1977 EDITION, ADOPTED BY ORDINANCE
NUMBER 2, SERIES OF 1978, AS AMENDED, TO PROVIDE FOR A PROCEDURE FOR THE IMPOUNDMENT AND
DISPOSAL OF MOTOR VEHICLES PARKED OR ABANDONED IN VIOLATION OF THE PROVISIONS OF SAID CODE.
After some discussion Sheila Davis moved approval of Ordinance No.#81-30, Series of 1981
on second reading. The motion was seconded by Larry Kumpost. A roll call was taken with
all the Councilmembers voting yes.
Second reading of Ordinance No.#81-33, Series of 1981, AN ORDINANCE PROVIDING FOR THE
AMENDMENT OF THE ZONING DISTRICT MAP OF THE TOWN OF AVON BY THE INCLUSION OF CERTAIN DESCRIBED
LAND IN THE SPECIALLY PLANNED AREA ZONE DISTRICT.
Larry Kumpost moved approval of Ordinance No.#81-33, Series of 1981 on second reading. The
motion was seconded by Sheila Davis. A roll call was taken with the Councilmembers voting
yes. A.J. Wells abstained.
Second reading of Ordinance No.#81-34, Series of 1981, AN ORDINANCE ANNEXING TO THE TOWN OF
AVON, COUNTY OF EAGLE, STATE OF COLORADO.
Parcel A - The N1/2 El/2 E1/2 of Section 2 and the N1/2 Sl/2 El/2 El/2 of Section 2, and the
N1/2 of Section 1, and the N1/2 SW1/4 of Section 1, and the El/2 SEl/4 of Section 1 and the
N1/2 NE1/4 NEl/4 of Section 12. All the Township 5 South, Range 82 West of the 6th Principal
Meridian, Eagle County, Colorado, containing 626.93 acres more or less.
Parcel B - A portion of the W1/2 of Section 2 and a portion of the E1/2 El/2 of Section 3 in
Township 5 Sough, Range 82 West of the 6th Principal Meridian and the El/2 El/2 EI/2 of
Section 34 in Township 4 South, Range 82 West of the 6th Principal Meridian, and a portion
of Ni/2 NW1/4 of Section 11, Township 5 South, Range 82 West of the 6th Principal Meridian,
Eagle County, Colorado, containing 633.5 acres more or less.
After some discussion Steve Erickson moved approval of Ordinance No.#81-34, Series of 1981
on second reading and post June Creek Road stating that travelers on that road would be
traveling at their own risk and to direct the Town Attorney to draft a Ordinance regarding
the zoning of these parcels for the next regular meeting, seconded by A.J. Wells. A roll
call was taken with all the Councilmembers voting yes.

Second reading of Ordinance No.#81-35, Series of 1981, AN ORDINANCE PROVIDING FOR THE
AMENDMENT OF THE ZONING DISTRICT MAP OF THE TOWN OF AVON BY THE INCLUSION OF CERTAIN DESCRIBED
LAND IN THE SPECALLY PLANNED AREA ZONE DISTRICT.

motion was seconded by Sheila Davis. A roll call was taken with the Councilmembers voting
yes. A.J. Wells qbstained.
First reading of Ordinance No.#81-36, Series of 1981, AN ORDINANCE IMOSING AN EXCISE TAX IN THE
AMOUNT OF ONE PER CENT (1%) ON THE PRICE PAID FOR THE LEASING OR RENTAL OF ANY HOTEL ROOM,
CONDOMINIUM UNIT OR SIMILAR ACCOMODATION LOCATED IN THE TOWN; EFFECTIVE DATE OF SAID TAX
TO BE DECEMBER 1, 1981; DEFINITIONS OF WORDS USED; EXEMPTIONS FROM SAID TAX; REPORTING
PROCEDURE; INTEREST PENALTIES; AND SETTING FORTH DETAILS IN RELATION THERETO; AND ESTABLISHING
PENALTIES FOR VIOLATION THEREOF.
After some discussion Sheila Davis moved approval of Ordinance No.#81-36, Series of 1981 on
first reading contingent upon changing the 3% to 1% and changing the penalty interest to 1 1/2%.
The motion was seconded by A.J. Wells, A roll call was taken with the Councilmembers voting
yes. Steve Erickson opposed.
The heating system in the new Municipal Building in regards to the non-function of the system
was discussed. It was requested that the Town Manager draft a letter to Roche Constructors,
Inc. to notify them that if the problem was not solved, the the Town would bring in another
Electrical Contractor and back charge Roche Constructors, Inc.

A Executive meeting was set for November 19, 1981 for the Town Council at 2:00 P.M.
There being no further business Bill Doyle moved to adjourn and Steve Erickson seconded the
motion. The meeting was adjourned by Mayor Alpi at 10:55 p.m.
