• MINUTES OF THE REGULAR MEETIT
OF THE TOWN OF AVON, COLORADO
OF THE TOWN COUNCILMEMBERS
HELD JULY 10, 1979
The regular meeting of the Town Councilmembers of the Town of Avon, Colorado was
held in the Town Office, second floor, Benchmark Center, Avon, Colorado.
The meeting was called to order at 7:40 P.M. by Mayor Angelo Alpi. A roll call
was taken with all Councilmembers in attendance. Also present were Town Attorney
John Blish, Town Building Administrator Ken Richards, Pacific Heritage Represen-
tative Larry Kumpost, Benchmark Chairman Ron Allred, Benchmark Planner Mike Blair,
Benchmark Attorney George Rosenberg, Claycomb Engineer Bryan Duff, as well as
members of the press.
The minutes of June 19, 21, and 26 were presented to Council. After discussion,
Carol Richards moved that the minutes be approved with the following correction
on June 26 change the word "during" to "of" in the first line of paragraph
five, page one. Bill Doyle seconded the motion and it was unanimously carried.
Bi-monthly financial reports were presented to the Council. After review, Jim Wells
moved that the accounts payable to approved as presented; Richard Casserley seconded
the motion and it was unanimously carried.
Under unfinished business, the second reading of Ordinance 79-15, concerning fire
safety was held. After discussion, Jim Wells moved to adopt Ordinance 79-15,
"AN ORDINANCE CONCERNING FIRE SAFETY; PROVIDING FOR FIRE SAFETY INSPECTIONS BY
FIRE DEPARTMENT PERSONNEL; PROVIDING PENALTIES FOR CERTAIN ACTS AND OMISSIONS
WHICH CONSTITUTE FIRE HAZARDS; CONTAINING PROVISIONS RELATING TO THE AUTHORITY
UNDER WHICH THE ORDINANCE IS ENACTED AND PROVIDING FOR OTHER DETAILS IN RELATION
THERETO," as presented on second reading. Richard Casserley seconded the motion
and a roll call vote was taken with all Councilmembers voting yes.
Also under unfinished business, the second reading of Ordinance 79-9, subdivision
regulations was held. One typographical error on page three, the word "more"
was pointed out. Steve Erickson then moved that Ordinance 79-9, "AN ORDINANCE
ADOPTING SUBDIVISION REGULATIONS FOR THE TOWN OF AVON, COLORADO; PROVIDING DEFINI-
TIONS OF CERTAIN TERMS AND SETTING OUT CERTAIN PROVISIONS, PROCEDURES, REQUIREMENTS
AND STANDARDS; PROVIDING FOR VARIANCES AND EXEMPTIONS; AND SETTING FORTH DETAILS
RELATING THERETO," be adopted on second reading as corrected. Bill Doyle seconded
the motion and a roll call vote was taken with all Councilmembers voting yes.
Submittal of final approval on the Wildridge and Wildwood Subdivisions was the
next agenda item addressed by the Council. Following comments by Town Consulting
Engineer Bryan Duff, Ron Allred explained changes to the Subdivider's Agreement.
Allred stated that the changes were derived from suggestions by Town Attorney
John Blish. Blish also discussed the specific changes for benefit of the Council.
Richard Casserley moved that the Council approve the Wildridge Subdivision as presented.
Bill Doyle seconded the mot_Lon and a roll call vote was taken with all Council-
members voting yes, except Jim Wells and Allan Nottingham who abstained.

Carol Richards seconded the motion and a roll call vote was taken with all
Councilmembers voting yes, except Jim Wells and Allan Nottingham who abstained.
Concluding discussion Ron Allred thanked everyone involved for their hard work
in approving the subdivisions.
Ordinance No. 79-14, amending Ordinance 79-2 on the Uniform Building Code was
the first item of new business addressed by the Council. A lengthy discussion
was held by Council, Ken Richards and Larry Kumpost.

Steve Erickson then moved approval on first reading of Ordinance 79-14,
"AN ORDINANCE AMENDING ORDINANCE NO. 2, SERIES OF 1979, ALSO KNOWN AS
ORDINANCE 79-2; PROVIDING FOR CERTAIN CONSTRUCTION STANDARDS IN REGARD TO THE
FIRE RATING OF PARTY WALLS AND SEPARATION WALLS" with the following stipulations:
I._)._the second reading of the Ordinance shall not be held until a review is received
from the regional International Conference of Building Officials' office; 2.). on page
2, the fourth paragraph be divided into two paragraphs; and 3.) the section "De-
finitions be numbered Section 3, with all following sections lettered a-d and
the remainder of the sections numbered 4-6. (A COPY OF ORDINANCE NO. 79-14 is
ATTACHED TO THESE MINUTES.)
Resolution No. 79-14, expressing appreciation to the Election Judges and Clerks
was presented to the Council by John Blish. After explanation, Allan Nottingham
moved that the Council adopt the Resolution, seconded by Bill Doyle and unanimously
carried. (A COPY OF RESOLUTION NO. 79-14 IS ATTACHED TO THESE MINUTES.)
A NWCCOG A-95 project, Skyline Six Area Agency on Aging, was reviewed by the
Council. Council action taken was to mark the report "favorable."
Resolution No. 79-15, creating a Board of Appeals under the Uniform Building
Code was presented to the Council by John Blish. After explanation, Jim Wells
moved to adopt the Resolution, Steve Erickson seconded the motion and it was
unanimously carried.(A COPY OF RESOLUTION NO. 79-15 IS ATTACHED TO THESE MINUTES.)
A, "letter of intent to participate in the federal aid bridge inspection program,
from the State Department of Highways was discussed by Mayor Alpi and the Council.
A decision was made to request more information on the program before completing
the required forms.
Also under mayor items, Mayor Alpi asked Chief Sortland to update the Council
on his progress towards hiring two additional police officers. Sortland explained
the status of the interview process to date. He also requested that the Council
authorize permission for him to pay the new officers time and half for any hours
over the forty-hour work week, as he determined.
So authorizing, Carol Richards moved that Ken Sortland could pay overtime wages
to his new officers, at his discretion. Steve Erickson seconded the motion and
it was unanimously carried.
There being no further business before the Council, Steve Erickson moved that
the meeting be adjourned, seconded by Richard Casserley and adjourned by the
Mayor at 11:10 P.M.

CITIZENS WHO HAVE SERVED AS JUDGES AND CLERKS AT THE SPECIAL MUNI-
CIPAL ELECTION ON JULY 10, 1979 AND AUTHORIZING PAYMENT FOR THEIR
SERVICES.
WHEREAS, the Town of Avon, Colorado held a Special Muni-
cipal Election on July 10, 1979; and

The Town is grateful for the services ren-
dered by the Judges and Clerks at the Special
Municipal Election and hereby offers its sin-
cere thanks and congratulations to them. Further,
the Town hereby approves the payment of compen-
sation to the Clerks and Judges at the rate
previously recommended by the Town Clerk.

TOWN OF AVON
SERIES OF 1979
A RESOLUTION CREATING A BOARD OF APPEALS UNDER THE UNIFORM
BUILDING CODE; APPOINTING AND NAMING CERTAIN PEOPLE TO
MEMBERSHIP ON THE BOARD: REQUIRING THE TOWN ATTORNEY TO
PROVIDE PROPOSED RULES AND REGULATIONS FOR ADOPTION BY THE
BOARD AND PROVIDING FOR OTHER DETAILS IN RELATION THERETO.
WHEREAS, the Town has, by ordinance, adopted the
Unifrom Building Code, 1976 edition, published by the
International Conference of Building Officials, 6530 South
Workman Mill Road, Whittier, California; and
WHEREAS, Section 204 of the Uniform Building Code,
titled "Board of Appeals," provides for the creation of a
Board of Appeals; and
WHEREAS, a notice of appeal of building permit
has been filed by George Rosenberg, Attorney at Law, in
relation to Lot 13, Block 1, Benchmark at Beaver Creek
Subdivision, and it is apparently necessary for the Building
Board of Appeals to meet in order to consider the issues
raised by this notice of appeal;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE TOWN
COUNCIL OF THE TOWN OF AVON, COLORADO, THAT:
The entire Town Council is hereby
appointed as the complete membership
of the Building Board of Appeals which
is hereby created by this Resolution.
The Board shall meet on Wednesday, July
11, 1979 and at such other times as it
may determine. It shall select a Chair-
person and adopt such Rules and Reg-
ulations concerning procedure as it may
deem proper. The Town Attorney shall
offer proposed Rules and Regulations.
The Board of Appeals shall hear the
matter raised by Attorney George
Rosenberg at the meeting on July 11,
1979. Town Attorney, John Blish,
shall serve as Legal Advisor to the
Board of Appeals and the membership
of the Board shall and hereby is
authorized to provide for rules and
and other details concerning its own
existence. The Building Official
shall be an Ex Officio Member and
shall act as Secretary to the Board.
The Board of Appeals shall serve at the
pleasure of the Town Council. The
Board is further authorized to employ
such consultants, experts and others
as it may determine to be needed in order
to carry out its mission, which is hereby
stated to be the Fair Resolution of such
matters as may from time to time be
properly presented to it under the Uniform
Building Code or the Rules and Regulations
of the Board of Appeals.

TOWN OF AVON
SERIES OF 1979
AN ORDIINANCE AMENDING ORDINANCE NO.2, SERIES OF 1979, ALSO KNOWN
AS ORDINANCE 79-2; PROVIDING FOR CERTAIN CONSTRUCTION STANDARDS
IN REGARD TO THE FIRE RATING OF PARTY WALLS AND SEPARATION WALLS.
WHEREAS, the Town of Avon is presently experiencing
increased construction activity; and,
WHEREAS, the Town Council is concerned with the public
health, safety and welfare of the citizens of the Town of Avon;
and,
WHEREAS, the Design Review Board of the Town of Avon
has reviewed and recommended the following Amendments;
NOW THEREFORE be it ordained by the Town Council of the
Town of Avon, Colorado, that:
Ordinance number 2 of the Series of 1979 shall be and is
hereby amended as follows:
Section 1. Intent of this Ordinance.
To set minimum requirements for construction and con-
struction methods, of walls, partitions, and floor-ceiling assemblies
that separate individual dwellings and/or dwelling units, to retard
the spread of fire between dwellings and/or dwelling units.
Section 2. Scope.
The requirements of this Ordinance shall be in addition
to those requirements of the Uniform Building Code adopted by the
Town of Avon and shall not be construed to reduce, nullify, or
otherwise modify and portion thereof except as specifically
described herein. In the event that any Code duly adopted by the
Town of Avon requires construction assemblies or methods
superior to the requirements of this Ordinance, the more stringent
requirements shall take precedence.
Section 3. Definitions.
Section A. Common Construction Assemblies.
Construction assemblies that are shared by, or that
separate, two or more adjacent dwellings and/or dwelling
units, or between other types of occupanies, tenant spaces,
businesses, offices, or other uses.
Section B. Common Walls or Partitions (Party Walls.)
Those walls and or partitions that separate two or
more individual adjacent dwellings and/or dwelling units, or
between other types of occupanices, tenant spaces, offices, or
other uses.
Section C. Common Floor-Ceiling Assemblies.
Floor-Ceiling construction systems that separate
two or more individual and adjacent dwellings and/or dwelling
units, or other types of occupancies, tenant spaces, offices,
or other uses.
Section D. Corridors.
Corridors shall refer to all entryways, passage-
ways, and exits, when two or more dwelling units are served
by said "corridors", regardless of size, enclosures, or length.
Section 4. Additions by this Ordinance.
Common walls and%or partitions (party walls) shall
be of not less than 1-hour fire resistive construction, and
shall extend from floor to ceiling and exterior wall to
exterior wall or other common wall. Common walls shall be
extended up into attic spaces by use of draft stops or may
terminate at roof-ceiling construction systems if the ceiling
is not less than 1-hour fire resistive construction.
Common walls, of not less than 1-hour fire resistive
construction shall be extended through decks, balconies, or
other projecting elements unless those elements are separated
by a distance equal to or greater than the distance of the
longest projection but not less than five feet.
Common floor-ceiling assemblies shall have
ceilings of not less than 1-hour fire resistive construction.
All exterior corridors shall have 1-hour fire
resistive walls. Openings to such corridors shall have not
less than 3/4 hour fire rating with automatic closures, and
all walls shall be 1-hour fire resistive to the roof, or
ceiling, whichever is applicable.
Fire alarm systems shall be provided for every
building which contains 15 or more dwelling units, regardless
of separation walls which are required, and in any size
building which has a common entryway serving three or more
dwelling units. Wiring for alarm systems shall be in metal
conduits.
Section 5. Saving Clause.
If any part, section, subsection, sentence, clause
or phrase of this Ordinance or any of the Codes or Standards
adopted hereby are for any reason held to be invalid, such
decisions shall not affect the validity of the remaining
sections of the Ordinance or any of the Codes or Standards
adopted hereby; the Town Council hereby declares that it would
have passed this Ordinance and adopted the Codes and Standards
named in the title hereto in each part, section, subsection,
sentence, clause or phrase thereof, irrespective of the fact
that any one or more parts, sections, subsections, sentences,
clauses or phrases be declared to be invalid.
Section 6. Repeal.
Any or all ordinances or parts of Ordinances of the
Town of Avon, in conflict or inconsistent herewith, are hereby
repealed; provided, however, that such repeal shall not affect
any offense committed or act done, any penalty or forfeiture
incurred or any contract,. right or obligation established
prior to the time of such repeal.
