Re: Amendment to Temporary Certificate of Occupancy ("TCO") provisions
in the Avon Municipal Code, Sections 15.08.090 C and D - First
Reading of Ordinance No. 01-05
Summary: Staff is recommending revisions to the TCO provisions to
accomplish clarification of several issues. Currently, the language of the
Cleanup, Landscaping and General Construction Deposit ("Deposit") does not
clearly explain that all conditions/items (including building requirements) that
remain outstanding must have collateral provided. The Deposit has historically
been used to provide collateral for landscaping and paving requirements. The
proposed Amendment will allow staff to obtain a deposit for all remaining
planning, building, engineering and public works related items.
In addition, the Amendment will shorten the time between a TCO and a
Certificate of Occupancy ("CO"). Staff is recommending three (3) months for all
TCOs with one three (3) month extension for a maximum period of six (6)
months. The six months is necessary to allow a project, which obtains a TCO in
the winter to complete all of the irrigation, landscaping, and paving by spring.
The extension may only be issued by the Chief Building Official and must be in
writing; there is no automatic extension.
Thus, the proposed Amendment will streamline the TCO and Deposit process for
the Town and enable staff to consistently enforce the regulations for each
construction project.
Recommendation: Staff recommends approval of the First Reading of
Ordinance No. 01-05, An Ordinance Repealing and Reenacting Sections
15.08.090 C and D of the Avon Municipal Code Concerning Temporary
Certificates of Occupancy.

AN ORDINANCE REPEALING AND RE-
ENACTING SECTIONS 15.08.090 C and
15.08.090 D OF THE AVON MUNICIPAL
CODE CONCERNING TEMPORARY
CERTIFICATES OF OCCUPANCY
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN
COUNCIL OF THE TOWN OF AVON, COLORADO, that Sections 15.08.090 C
and 15.08.090 D of the Avon Municipal Code are repealed and re-enacted to provide
as follows:
15.08.090 C. Section 109.1.2 -- Cleanup, Landscaping and General
Construction Deposit. A Cleanup, Landscaping and General Construction Deposit
("Deposit") is designed to provide security for all conditions contained in the Temporary
Certificate of Occupancy ("TCO"). The Deposit shall be paid in cash and shall be paid to the
Town of Avon. In lieu of cash, and upon a showing to the Town that adequate security will be
provided thereby, the deposit may be by a letter of credit. The letter of credit must be valid for
one (1) year and renewable upon the Town's request. The amount of the deposit required
shall be based upon a current bid by a reputable contractor, plus 25% of the bid, good for
sufficient time to allow completion of the work, or upon some other basis deemed acceptable
by the Town. The bid shall be based upon completion of all remaining work indicated on the
approved building permit plans, and any subsequent conditions of approval. If the cleanup,
landscaping and general construction, as defined in this chapter, is not completed within three
(3) months of the date the TCO is issued, the Town may, but shall not be obligated to,
complete such cleanup, landscaping, and general construction, the cost of doing so, together
with a fee in the amount of twenty percent (20%) of such costs, to be charged to the permit
holder and deducted from the cash or other security deposited. If the cost for completion by
the Town, plus the fee, exceeds the amount of the deposit, the excess, together with interest at
twelve percent annum, shall be a lien against the property and may be collected by civil suit,
or may be certified to the Treasurer of Eagle County to be collected in the same manner as
delinquent ad valorem taxes levied against such property.
15.08.090 D. Section 109.4.1 -- Conditions of Temporary Certificate of
Occupancy
(1) A Temporary Certificate of Occupancy ("TCO") shall be valid for three (3)
months. The Chief Building Official may grant one (1) TCO extension for up
to three (3) months. Such extension shall be granted in writing.
(2) The following shall be completed prior to the issuance of a Temporary
Certificate of Occupancy for Commercial or Multi-Family, (A, B, E, F, H, I,
M, S and R-1 occupancies):
a. The exterior of the building is complete, including painted
vents, meters, and light fixtures.
b. The interior shell building is complete with all required
final inspections approved, including building, fire
sprinkler (if required), electrical, plumbing and mechanical
smoke detectors, fire alarms and sprinklers.
C. Two operative bathrooms on each floor being occupied in
other than R occupancies.
d. Entrance and other work within the public right of way
must be approved.
e. All required parking paved and marked.
f. All utility tap fees paid.
g. Positive drainage away from the building in all directions at
2% for a minimum of 5 feet.
h. Where the required cleanup, landscaping, or construction
required for a Certificate of Occupancy is not complete, a
Temporary Certificate of Occupancy (TCO) may be issued
upon submittal and approval of a Cleanup, Landscaping,
and Construction Deposit in accordance with Section
15.08.090 C. The surety will be returned to the permittee
upon issuance of the Final Certificate of Occupancy.
(3) The following shall be completed prior to the issuance of a Temporary
Certificate of Occupancy for one and two family dwellings:
a. The exterior of the building is complete, including painted
vents, meters, and light fixtures.
b. The interior shell building is complete with all required
final inspections approved, including building, fire
sprinkler (if required), electrical, plumbing and mechanical.
C. One bathroom operative as per the approved plans.
d. Entrance and other work within the public right of way
must be approved.
e. Positive drainage away from the building in all directions at
2% for a minimum of 5 feet.
f. Sufficient roadway access for emergency vehicles and
minimum parking requirements must be met.
g. All utility tap fees paid.
h. Where the required cleanup, paving, landscaping, or
construction required for a Certificate of Occupancy is not
complete, a Temporary Certificate of Occupancy (TCO)
may be issued upon submittal and approval of a Cleanup,

Landscaping, and Construction Deposit in accordance with
Section 15.08.090 C. The surety will be returned to the
permittee upon issuance of the Final Certificate of
Occupancy.

Re: Ordinance 01-06 Adopting the updated Official Zone District Map
Summary:
Staff has prepared an updated Zoning Map for adoption by Town Council.
Sections 17.16.030 and 17.28.100 of the Zoning Code require that if changes are
made to the zoning of property, such changes shall be entered on the Zoning
Map.
This map update reflects all ordinances, resolutions, rezonings, and annexations
that changed the zoning of property in the Town since 1999 as well as technical
corrections that were identified since the last update.
On July 17, 2001 the Planning and Zoning Commission unanimously approved
Planning and Zoning Commission Resolution 01-05 recommending approval of
the Official Zone District Map.
The draft map is displayed in the Council Chambers and in the Community
Development Department. If you would like a copy please contact staff.
Recommendation:
Staff recommends the Town Council approve Ordinance 01-06, approving the
updated Zoning Map on first reading.

Amendment - Appendix A - Water Service Rules Regulations
Resolution No. 01-16, Series of 2001
Summary: Eagle River Water and Sanitation District as managing
operators for Upper Eagle Regional Water Authority has requested approval of a
Modification of Appendix A to Water Service Rules and Regulations. The proposed
modification clarifies the current Appendix A of the Rules and Regulations by adding:
2. Expansion or Remodel of Existing Residential Units
Any additions to an existing residential unit will be assessed a tap fee for the
additional square footage.
This does not change the current practices, fee structure or service charges. The proposed
Amendment would be approved by the attached Resolution No. 01-16, Series of 2001. A
copy of a Memo from Joyce Wood, Manager Customer Services for Eagle River Water
and Sanitation District, requesting approval of the Modification of Appendix A to Rules &
Regulations is attached along with supplemental information from the Authority and other

SCHEDULE OF FEES AND CHARGES
EFFECTIVE: JANUARY 1, 2001
1. Residential Water Tap Fee
Residential Unit:
Town of Avon Water Tap Fee is $4,000 per unit up to 3,000 square feet, plus $2.00 per
square foot thereafter, plus $2.00 per square foot for a private swimming pool. Area is
calculated on the gross square foot measurement to include the outside walls, unfinished
areas and concrete basements, excluding garages, attics, and multi-unit common spaces.
Property owner shall be required to obtain a letter from an Architect or Engineer
certifying the size of the building using the District's definition of square footage.
(Minimum $4,000)
Efficiency Unit:
Town of Avon Water Tap Fee is $2,000 per Efficiency Unit. An Efficiency Unit is a
single room with a bathroom and a kitchen facility. A kitchen facility is a cooking area
that includes a cooktop having more than two burners and a conventional oven or range.
Accommodation Unit:
Town of Avon Water Tap Fee is $1,400 per Accommodation Unit. An Accommodation
Unit is a room with or without a bathroom, but without a kitchen facility with private
access to a central corridor or the outside.

3. Commercial and Irrigation Uses
Commercial and irrigation uses may be on a separate master meter or, for mixed uses,
may be on the same meter as the Residential/Hotel units, if the property owner provides
the District with an Engineer's or Architect's assessment of the meter size necessary to
serve the commercial and irrigation fixtures involved. The Arrowhead Metropolitan
District will consider this assessment in the District's determination of appropriate meter
size. The meter size is determined by the fixture count assessment according to the
Uniform Plumbing Code.

4. Water Service Charges
Water service charges are billed monthly, in arrears. For metered accounts see
Appendix A - Upper Eagle Regional Water Authority for rates. For accounts with broken
meters or unmetered accounts, the rate charged shall be $77.25 per Single Family
Equivalent unit per month.

UPPER EAGLE REGIONAL WATER AUTHORITY
SCHEDULE OF FEES AND CHARGES
EFFECTIVE: JANUARY 1, 2001
1. Participating Districts
Arrowhead Metropolitan District, Bachelor Gulch/Smith Creek Metropolitan District,
Beaver Creek Metropolitan District, Berry Creek Metropolitan District, Eagle-Vail
Metropolitan District, Edwards Metropolitan District, Cordillera/Squaw Creek
Metropolitan District, and the Town of Avon.
Please refer to Appendix Al through A5 for Upper Eagle Regional Water Authority's
rules and regulations on water meters and fire hydrant meters administered by Eagle
River Water & Sanitation District.
2. Incremental Plant Investment Fee
An incremental fee to help fund capital projects and building of new Drinking Water
Facilities.
Residential Uses:
Area is calculated on the gross square foot measurement to include the outside walls,
excluding garages and attics, but including unfinished areas, concrete basements, and
multi-unit common spaces. Property owner shall be required to obtain a letter from an
Architect or Engineer certifying the size of the building using the District's definition of
square footage.
• $0.56 per square foot for 0 to 2,500 square feet (minimum $582)
• $0.82 per square foot for 2,501 to 3,500 square feet
• $1.09 per square foot for 3,501 to 5,000 square feet
• $1.37 per square foot for 5,001 and up
Commercial and Irrigation Uses:
Commercial and irrigation uses may be on a separate master meter or, for mixed uses,
may be on the same meter as Residential/Hotel units, if the property owner provides the
Authority with an Engineer's or Architect's assessment of the meter size necessary to
serve the commercial and irrigation fixtures involved. Upper Eagle Regional Water
Authority will consider this assessment in the District's determination of appropriate
meter size. The meter size is determined by the fixture count assessment according to the
Uniform Plumbing Code.

3. Monthly Service Charges For Metered Accounts
Upper Eagle Regional Water Authority shall bill monthly, in arrears, the metered
accounts of the participating Districts, for service charges in accordance with the
following Base Charges and Usage Rates.
Single Family Equivalent Unit for Service Billing:
Residential Unit:
A residential unit with a kitchen facility, up to 3,000 square feet 1.0 SFE
Efficiency Unit:
A single room with a bathroom and a kitchen facility 0.50 SFE
Accommodation Unit:
A room with or without a bathroom, but without a kitchen facility,
with private access to a central corridor or the outside 0.35 SFE
a. Base Charge:
$12.30 per month, per Single Family Equivalent unit.
b. Usage Rate:
$2.61 per thousand gallons of water.
C. Usage Surcharge:
In addition to the Base Charge, a usage surcharge per month, per Single Family
Equivalent unit, will be collected and paid to the appropriate District listed below:

Attached are revised Appendix A's for each district/town for your review and approval.
The added shaded area on all Appendix A's which reads "2. Expansion or Remodel of
Existing Residential Units - Any additions to an existing residential unit will be assessed
a tap fee for the additional square feet" has been added for clarity. This procedure has
always been implemented but was recently questioned since it was not noted on the
Appendix A's.
In addition, for Arrowhead, the recent Board action of additional tap fees for Mountain
Road which reads "Mountain Road is $8,250 per unit up to 600 square feet, plus $3.00
per square foot thereafter, effective June 27, 2001", has also been added.

MINUTES OF THE REGULAR MEETING OF THE TOWN COUNCIL
HELD JULY 10, 2001
A regular meeting of the Town of Avon, Colorado was held in the Municipal Building,
400 Benchmark Road, Avon, Colorado in the Council Chambers.
The meeting was called to order by Mayor Judy Yoder at 5:30 PM. A roll call was taken
with Councilors Michael Brown, Debbie Buckley, Peter Buckley, Mac McDevitt, and
Mayor Protem Buz Reynolds present. Councilor Rick Cuny was absent. Also present
were Town Attorney Burt Levin, Assistant Town Manager Larry Brooks, Town Clerk
Kris Nash, Human Resource Director Jacquie Halburnt, Town Engineer Norm Wood,
Public Works Director Bob Reed, Asst. Director of Community Development Ruth
Borne, Special Events Coordinator Sarah Lai as well as members of the public.
Citizen Input
Triple Bypass and Thunderbird Arts Festival Updates
Ms. Lai stated that the Thunderbird Artists will be in Avon July 13 -15. They will be
located at Chapel Square.
Ms. Lai stated that the Triple Bypass bicycle tour will be on Saturday, July 14. The tour
starts in Evergreen and ends in Nottingham Park.
Citizen Input:
Human Resources Director Halburnt stated that the Town picnic will take place Tuesday,
July 17 at noon in Nottingham Park. She encouraged everyone to come out for a free
lunch.
Town Manager Report:
Assistant Town Manger Brooks stated that he, Town Attorney Levin, and Finance
Director Wright will be attending a meeting in Denver on Friday regarding the November
ballot issue.
Mayor Report:
Mayor Yoder urged everyone to attend the picnic on July 17th
Other Business:

Service that they will not discontinue Saturday delivery service.
Mr. Buckley also stated that the Postal Service should name a new permanent Postmaster

Summary: Peak Land Consultants, Inc. has submitted the attached Cost
Proposal for design and construction related engineering and surveying for Phase II of the

shared equally with Eagle River Water and Sanitation District. We recommend approval of the
attached Cost Proposal from Peak Land Consultants, Inc. in an amount not to exceed $66,970
for design and construction-related surveying and engineering services contingent upon receipt
of written agreement from Eagle River Water and Sanitation District to pay 50% of the costs.

Change Order Number One - Modifications to West Beaver Creek Blvd
Summary: This change order is for modifications to the Street Repair and Improvements
project. A section of West Beaver Creek Boulevard to the West of the construction area needs to
be widened to allow for traffic to be directed to the lanes in the widened section of road in front
Sheraton Mountain Vista. The net effect of this Change Order is to increase the Total Contract
amount by $15,300.00 from $46,131.65 to $61,431.65 and to increase the contract time by 35
days. This increase is within the current Street Repair and Improvements Project Budget.
Discussion: Work in the 2001 Street Repair and Improvements Contract with corresponding
Contract Amounts and changes per Change Order Number One, are summarized as follows:
CO Number One - This change order is for widening a section of West Beaver Creek
Boulevard to allow for proper traffic flow. The modifications being proposed are to
increase the roadway by four feet. The costs included in the Change Order include traffic
control, asphalt, roadbase, removal and replacement of curb and gutter and removal of
the guardrail. The net impact of the changes is to increase the Contract Amount by
$15,300.00 from $46,131.65 to $61,431.65. This increase is within the Capitol
Improvement Budget. This will also increase the Contract Time by 35 days.
Financial Implications: This Change Order increases the Total Contract amount by
$15,300.00 from $46,131.65 to $61,431.65. All of the work is within the original budget for Street
Repair and Improvements.
Recommendations: It is recommended that Change Order Number One, to Contract for
2001 Street Repair and Improvements with Grand River Construction, Inc. be approved,
increasing the Contract Amount by $15,300.00 from $46,131.65 to $61,431.65 and increase the
contract time by 35 days.

Re: Amendment to Temporary Certificate of Occupancy ("TCO") provisions
in the Avon Municipal Code, Sections 15.08.090 C and D - First
Reading of Ordinance No. 01-05
Summary: Staff is recommending revisions to the TCO provisions to
accomplish clarification of several issues. Currently, the language of the
Cleanup, Landscaping and General Construction Deposit ("Deposit") does not
clearly explain that all conditions/items (including building requirements) that
remain outstanding must have collateral provided. The Deposit has historically
been used to provide collateral for landscaping and paving requirements. The
proposed Amendment will allow staff to obtain a deposit for all remaining
planning, building, engineering and public works related items.
In addition, the Amendment will shorten the time between a TCO and a
Certificate of Occupancy ("CO"). Staff is recommending three (3) months for all
TCOs with one three (3) month extension for a maximum period of six (6)
months. The six months is necessary to allow a project, which obtains a TCO in
the winter to complete all of the irrigation, landscaping, and paving by spring.
The extension may only be issued by the Chief Building Official and must be in
writing; there is no automatic extension.
Thus, the proposed Amendment will streamline the TCO and Deposit process for
the Town and enable staff to consistently enforce the regulations for each
construction project.
Recommendation: Staff recommends approval of the First Reading of
Ordinance No. 01-05, An Ordinance Repealing and Reenacting Sections
15.08.090 C and D of the Avon Municipal Code Concerning Temporary
Certificates of Occupancy.

AN ORDINANCE REPEALING AND RE-
ENACTING SECTIONS 15.08.090 C and
15.08.090 D OF THE AVON MUNICIPAL
CODE CONCERNING TEMPORARY
CERTIFICATES OF OCCUPANCY
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN
COUNCIL OF THE TOWN OF AVON, COLORADO, that Sections 15.08.090 C
and 15.08.090 D of the Avon Municipal Code are repealed and re-enacted to provide
as follows:
15.08.090 C. Section 109.1.2 -- Cleanup, Landscaping and General
Construction Deposit. A Cleanup, Landscaping and General Construction Deposit
("Deposit") is designed to provide security for all conditions contained in the Temporary
Certificate of Occupancy ("TCO"). The Deposit shall be paid in cash and shall be paid to the
Town of Avon. In lieu of cash, and upon a showing to the Town that adequate security will be
provided thereby, the deposit may be by a letter of credit. The letter of credit must be valid for
one (1) year and renewable upon the Town's request. The amount of the deposit required
shall be based upon a current bid by a reputable contractor, plus 25% of the bid, good for
sufficient time to allow completion of the work, or upon some other basis deemed acceptable
by the Town. The bid shall be based upon completion of all remaining work indicated on the
approved building permit plans, and any subsequent conditions of approval. If the cleanup,
landscaping and general construction, as defined in this chapter, is not completed within three
(3) months of the date the TCO is issued, the Town may, but shall not be obligated to,
complete such cleanup, landscaping, and general construction, the cost of doing so, together
with a fee in the amount of twenty percent (20%) of such costs, to be charged to the permit
holder and deducted from the cash or other security deposited. If the cost for completion by
the Town, plus the fee, exceeds the amount of the deposit, the excess, together with interest at
twelve percent annum, shall be a lien against the property and may be collected by civil suit,
or may be certified to the Treasurer of Eagle County to be collected in the same manner as
delinquent ad valorem taxes levied against such property.
15.08.090 D. Section 109.4.1 -- Conditions of Temporary Certificate of
Occupancy
(1) A Temporary Certificate of Occupancy ("TCO") shall be valid for three (3)
months. The Chief Building Official may grant one (1) TCO extension for up
to three (3) months. Such extension shall be granted in writing.
Landscaping, and Construction Deposit in accordance with
Section 15.08.090 C. The surety will be returned to the
permittee upon issuance of the Final Certificate of
Occupancy.

Re: Ordinance 01-06 Adopting the updated Official Zone District Map
Summary:
Staff has prepared an updated Zoning Map for adoption by Town Council.
Sections 17.16.030 and 17.28.100 of the Zoning Code require that if changes are
made to the zoning of property, such changes shall be entered on the Zoning
Map.
This map update reflects all ordinances, resolutions, rezonings, and annexations
that changed the zoning of property in the Town since 1999 as well as technical
corrections that were identified since the last update.
On July 17, 2001 the Planning and Zoning Commission unanimously approved
Planning and Zoning Commission Resolution 01-05 recommending approval of
the Official Zone District Map.
The draft map is displayed in the Council Chambers and in the Community
Development Department. If you would like a copy please contact staff.
Recommendation:
Staff recommends the Town Council approve Ordinance 01-06, approving the
updated Zoning Map on first reading.

Summary: Eagle River Water and Sanitation District as managing
operators for Upper Eagle Regional Water Authority has requested approval of a
Modification of Appendix A to Water Service Rules and Regulations. The proposed
modification clarifies the current Appendix A of the Rules and Regulations by adding:

Any additions to an existing residential unit will be assessed a tap fee for the
additional square footage.
This does not change the current practices, fee structure or service charges. The proposed
Amendment would be approved by the attached Resolution No. 01-16, Series of 2001. A

and Sanitation District, requesting approval of the Modification of Appendix A to Rules &

SCHEDULE OF FEES AND CHARGES
EFFECTIVE: JANUARY 1, 2001
1. Residential Water Tap Fee
Residential Unit:
Town of Avon Water Tap Fee is $4,000 per unit up to 3,000 square feet, plus $2.00 per
square foot thereafter, plus $2.00 per square foot for a private swimming pool. Area is
calculated on the gross square foot measurement to include the outside walls, unfinished
areas and concrete basements, excluding garages, attics, and multi-unit common spaces.
Property owner shall be required to obtain a letter from an Architect or Engineer
certifying the size of the building using the District's definition of square footage.
(Minimum $4,000)
Efficiency Unit:
Town of Avon Water Tap Fee is $2,000 per Efficiency Unit. An Efficiency Unit is a
single room with a bathroom and a kitchen facility. A kitchen facility is a cooking area
that includes a cooktop having more than two burners and a conventional oven or range.
Accommodation Unit:
Town of Avon Water Tap Fee is $1,400 per Accommodation Unit. An Accommodation
Unit is a room with or without a bathroom, but without a kitchen facility with private
access to a central corridor or the outside.
3. Commercial and Irrigation Uses
Commercial and irrigation uses may be on a separate master meter or, for mixed uses,
may be on the same meter as the Residential/Hotel units, if the property owner provides
the District with an Engineer's or Architect's assessment of the meter size necessary to
serve the commercial and irrigation fixtures involved. The Arrowhead Metropolitan
District will consider this assessment in the District's determination of appropriate meter
size. The meter size is determined by the fixture count assessment according to the
Uniform Plumbing Code.

The added shaded area on all Appendix A's which reads "2. Expansion or Remodel of

always been implemented but was recently questioned since it was not noted on the
Appendix A's.
In addition, for Arrowhead, the recent Board action of additional tap fees for Mountain
Road which reads "Mountain Road is $8,250 per unit up to 600 square feet, plus $3.00
per square foot thereafter, effective June 27, 2001", has also been added.

1. Residential Water Tap Fee
Residential Unit:
Beaver Creek Metropolitan District Water Tap Fee is $5,000 per unit up to 600 square
feet, plus $1.75 per square foot thereafter. Area is calculated on the gross square foot
measurement to include the outside walls, unfinished areas, and concrete basements,
excluding garages, attics, and multi-unit common spaces. Property owner shall be
required to obtain a letter from an Architect or the Engineer certifying the size of the
building using the District's definition of square footage. (Minimum $5,000)

MINUTES OF THE REGULAR MEETING OF THE TOWN COUNCIL
HELD JULY 10, 2001
A regular meeting of the Town of Avon, Colorado was held in the Municipal Building,
400 Benchmark Road, Avon, Colorado in the Council Chambers.
The meeting was called to order by Mayor Judy Yoder at 5:30 PM. A roll call was taken
with Councilors Michael Brown, Debbie Buckley, Peter Buckley, Mac McDevitt, and
Mayor Protem Buz Reynolds present. Councilor Rick Cuny was absent. Also present
were Town Attorney Burt Levin, Assistant Town Manager Larry Brooks, Town Clerk
Kris Nash, Human Resource Director Jacquie Halburnt, Town Engineer Norm Wood,
Public Works Director Bob Reed, Asst. Director of Community Development Ruth
Borne, Special Events Coordinator Sarah Lai as well as members of the public.
Citizen Input
Triple Bypass and Thunderbird Arts Festival Updates
Ms. Lai stated that the Thunderbird Artists will be in Avon July 13 -15. They will be
located at Chapel Square.
Ms. Lai stated that the Triple Bypass bicycle tour will be on Saturday, July 14. The tour
starts in Evergreen and ends in Nottingham Park.
Citizen Input:
Human Resources Director Halburnt stated that the Town picnic will take place Tuesday,
July 17 at noon in Nottingham Park. She encouraged everyone to come out for a free
lunch.
Town Manager Report:
Assistant Town Manger Brooks stated that he, Town Attorney Levin, and Finance
Director Wright will be attending a meeting in Denver on Friday regarding the November
ballot issue.
Mayor Report:
Mayor Yoder urged everyone to attend the picnic on July 17tH

Design Services Proposal for Phase II
summary: Peak Land Consultants, Inc. has submitted the attached Cost
Proposal for design and construction related engineering and surveying for Phase II of the
Eagle River Bikepath from West Beaver Creek Boulevard to the existing Confluence path.

This proposal appears to be quite reasonable with the inclusion of soils analysis, floodplain
analysis, wetland review and permitting and structural wall design. The proposed fee is within
the 2001 project budget and based on an earlier agreement we anticipate these costs being
shared equally with Eagle River Water and Sanitation District. We recommend approval of the
attached Cost Proposal from Peak Land Consultants, Inc. in an amount not to exceed $66,970
for design and construction-related surveying and engineering services contingent upon receipt
of written agreement from Eagle River Water and Sanitation District to pay 50% of the costs.

Re: 2001 Street Repair and Improvements
Change Order Number One - Modifications to West Beaver Creek Blvd
Summary: This change order is for modifications to the Street Repair and Improvements
project. A section of West Beaver Creek Boulevard to the West of the construction area needs to
be widened to allow for traffic to be directed to the lanes in the widened section of road in front
Sheraton Mountain Vista. The net effect of this Change Order is to increase the Total Contract
amount by $15,300.00 from $46,131.65 to $61,431.65 and to increase the contract time by 35
days. This increase is within the current Street Repair and Improvements Project Budget.
Discussion: Work in the 2001 Street Repair and Improvements Contract with corresponding
Contract Amounts and changes per Change Order Number One, are summarized as follows:
CO Number One - This change order is for widening a section of West Beaver Creek
Boulevard to allow for proper traffic flow. The modifications being proposed are to
increase the roadway by four feet. The costs included in the Change Order include traffic
control, asphalt, roadbase, removal and replacement of curb and gutter and removal of
the guardrail. The net impact of the changes is to increase the Contract Amount by
$15,300.00 from $46,131.65 to $61,431.65. This increase is within the Capitol
Improvement Budget. This will also increase the Contract Time by 35 days.
Financial Implications: This Change Order increases the Total Contract amount by
$15,300.00 from $46,131.65 to $61,431.65. All of the work is within the original budget for Street
Repair and Improvements.
Recommendations: It is recommended that Change Order Number One, to Contract for
2001 Street Repair and Improvements with Grand River Construction, Inc. be approved,
increasing the Contract Amount by $15,300.00 from $46,131.65 to $61,431.65 and increase the
contract time by 35 days.
