-Re: 2001 Locker room remodel
Summary:
After 5 years of heavy use, the locker rooms at the Avon Recreation Center are in need of
repair. The locker rooms have served the public well; however, the inherent design of the
space has presented a variety of problems to our patrons and staff. These problems range
from issues of functionality to inadequacy of many of the components to support a long
lifespan. This memo will highlight the objectives that staff recommends be accomplished
with the 2001 remodel. I realize this list has grown from the original request to simply
replace lockers; however the locker renovation affords the opportunity to address
additional concerns as well.
Floors
• Additional drainage to be added due to improper slope of original floor.
• Different flooring options should be considered due to difficulty in keeping the
existing epoxy surfaces clean and sanitized.
• Carpeted area leading to locker rooms should be patterned concrete or similar
product.
Lockers and changing areas
• Locker configuration must be re-designed to incorporate a soffit, a more efficient
seatingarrangement and higher base pedestal. Dust, rust and lack of seating and
locker capacity are the problems of the existing configuration.
Vanities
• Current problems with cleaning and maintenance of the sink area, i.e. wearing
fixtures, valves and inadequate electrical power. A combined sink/counter top system
of non-porous material would be desirable. Replacement of fixtures and necessary
-plumbing-and electrical improvements should be done at this time.
Showers
• All shower valves have become outdated and can no longer be purchased. New
valves need to be installed. Stainless shower partitions should be considered over
current design.
• Cinderblock walls are not impervious to water and require constant repair and
maintenance. Alternate wall coverings should be considered.
Urinals/stalls
• Self-flushing valves and stainless partitions recommended. Lighting solution should
be determined.
Storage
• - Existing custodial and janitorial storage is inadequate.- Additional space needs to be
developed.
Hot Water
• Inefficient hot water supply at times. Solutions to be considered with assistance of
hydronics engineer.
Budget Implications:
$250,000 has been allocated in the Capital Improvements budget for the year 2001.
Recommendation:
Authorize staff to proceed with the planning and implementation of the above mentioned
improvements for the 2001 budget year.

Re: Waiver of Town Fees for Deed Restricted Housing
Summary
James G. Tylich, the developer of Grandview, a 12-unit employee housing complex on
Nottingham Road, is requesting reimbursement for building permit fees and a waiver of the
Town's portion of both sewer and water tap fees.
Discussion
Staff surveyed five jurisdictions in the region to determine their policies on waiving fees for
deed-restricted housing. A summary of the responses follows:

Breckenridge is the only jurisdiction surveyed to waive building permit and water tap fees,
approximately $6,000 per unit, and has done so only once. Total cost to the Town for this 97
unit project was approximately $600,000. Town of Vail waived a $200 planning fee on one
project.
Conclusion:
Since future employee housing developers will reasonably expect waivers similar to any
granted to this -applicant, realistically evaluating the financial impacts to the Town must
incorporate the 500 deed-restricted employee housing units required by the Village at Avon
PUD approval, as well as redevelopment in the town core.

We are in the process of building a 12-unit employee housing complex on
Knothingham Road in Avon.
We respectfully request at the next town meeting that the town reduce the
building permit cost and the city portion of water and sewer tap fees cost in
order to make it practical as an employee housing project.
We have paid the building permit fees of about $28,000.00, but would
certainly appreciate a rebate do to the limiting factors that employee housing
imposes.
We bought the unfinished project with the understanding that this is what the
town needed, and as future investment for us.
These units are not for sale, but_are_considered to be employee housing.
Please consider our request and reduce the fees.

Re: Confluence Land Use Approvals
Introduction
To help prepare for the Council site tour scheduled for November 21, following is a short
overview of land use approvals for the Confluence site.
Land Use approvals
The Confluence site was formerly known as Avon Station, a mobile home park. Vail
Associates, Inc. (VAT) purchased the site in March 1994. The mobile homes were removed in
1995 and 1996.
June 11, 1996: Eagle County approved a minor PUD, limited to three years, which allowed:
• Up to 200 employee parking spaces;
• A construction laydown area (for one year only, starting on June 1, 1996)
• Snow storage.
June 3, 1997: Eagle County approved a PUD Amendment allowing 800 spaces of "surface
parking in support of Beaver Creek Resort" (copy attached). No other uses were approved.
August 25,1998: Town Council approved Ordinance No. 98-18, annexing the Confluence
property into the Town of Avon.
October 27, 1998: Town Council approved Ordinance 98-20, establishing PUD Zoning and
Development Standards for the Confluence (copy attached).
Current status
The annexation and zoning of the Confluence supersede any County zoning approvals.
Ordinance 98-20 requires that, before any development can occur on the site, the owner (VAl)
must submit and obtain approval for a PUD Development Plan. The process includes hearings
before P&Z and Town Council, and action by ordinance (Section 17.20.110 of the Zoning
Code).
Ordinance 98-20 also limits the Hurd Lane access to one way, right-in only traffic, and
requires that the bridge connecting to Hwy 6 be completed before any certificate of occupancy
is issued on the site.
Earlier this year VAI began using the Confluence site for staging for the Ritz Carlton project
in Bachelor Gulch. In an attempt to be cooperative, staff subsequently granted approval for
temporary use of the site (copy attached).
Conclusion
Before VAI is allowed to conduct any use on theConfluence site, they-must first submitand
obtain approval for a PUD Development Plan. Moreover, the current land use approval limits
access from Avon Road to one-way right-in traffic only, and requires that a bridge connection
with Hwy 6 be complete prior to a Certificate of Occupancy.

AN ORDINANCE ESTABLISHING PUD ZONING AND DEVELOPMENT
STANDARDS FOR THE CONFLUENCE, TOWN OF AVON EAGLE COUNTY,
COLORADO
WHEREAS, Vail Associates Investments, Inc. has filed an application for PUD
Zoning including establishment of Development Standards; and
WHEREAS, the Town has annexed the property pursuant to the provisions of the
Town of Avon Ordinance Number 98-18 (the "Annexation Ordinance'l; and
WHEREAS, the Town has agreed to establish zoning for the Property in
accordance with the Development Agreement; and
WHEREAS, the proper posting, publication and public notices for the hearings
before the Planning & Zoning Commission of the Town of Avon were provided as
required by law; and
WHEREAS, the Planning & Zoning Commission of the Town of Avon held a
public hearing, at which time the applicant and the public were given an opportunity to
express their opinions and present certain information and reports regarding the proposed
amendment; and
WHEREAS, following such public hearing, the Planning & Zoning Commission
forwarded its report and recommendation on the proposed PUD Zoning and Development
Standards to the Town Council of the Town of Avon; and
WHEREAS, after notices provided by law, this Council held a public hearing on
the 27th day of October, 1998, at which time the public was given an opportunity to
express their opinions regarding the proposed amendment; and
WHEREAS, based upon the evidence, testimony, and exhibits, and a study of the
Comprehensive Plan of the Town of Avon, Town Council of the Town of Avon finds as
follows:
1. That the hearings before the Planning & Zoning Commission and the Town
Council were both extensive and complete and that all'pertinent facts, matters and
issues were submitted at those hearings.
2. The PUD Zoning and Development Standards are consistent with the Town's
Comprehensive Plan.
3. Adequate facilities are available to serve development for the project's type and
scope.

NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF
THE TOWN OF AVON, COLORADO, that:
The PUD Zoning and Development Standards and Development Agreement are hereby
approved subject to the following conditions:
1. Development may occur on this site only in conformance with a site-specific
Development Plan (referred to herein as a PUD Development Plan), reviewed and
approved by the Town through a separate application and review process pursuant to
Section 17.20.110 of the Avon Municipal Code.
2. The 100-year flood plain and wetland boundaries shall be indicated on the PUD map.
3. Deed restricted affordable housing units shall be provided with the amount of units
equal to ten percent of the dwelling touts proposed (45). The units shall "be subject to _
the standard master deed restriction provisions including the Town's applicable
appreciation cap.
4. Buildings shall be stepped down to the riverfront or otherwise protect the integrity of
the river corridor in conformance with the Comprehensive Plan.
5. No building or portion thereof may extend above a plane 10 feet below that projected
horizontally from the top of the Avon Center building, and in no case shall any
building be taller than 120 feet, measuring said height as defined in Title 17 of the
Avon Municipal Code.
6. Land dedication for schools shall conform to the Town's requirements in Title 16 of
the Avon Municipal Code.
7. Building setbacks shall be 20 feet from the eastern property (Avon Road), 10 feet
from the northern property line, and 75 feet from the river corridor. Any -
modifications can be reviewed in conjunction with the PUD Development Plan
approval process. m._
8. Consistent -witltthe-1,996 Transportation-Plan-UpdW; public right-of-way will be
dedicated through the project to connect Hurd Lane with the western boundary of the
property, to accommodate a future connection with Millie's Lane.
9. The Hurd Lane entrance at Avon Road will be limited to a one-way, right-in
movement. Vehicles will not be permitted to exit the site via this route.
10. The bridge connecting the site with Route 6 will be completed prior to issuance of
any Certificates of Occupancy on the site.

Construction Staging and Parking for Bachelor Gulch Ritz
Dear Ruth,
The purpose of this correspondence is to clarify our intended near term use of portions of the
Confluence Parcel. As discussed on site Tuesday July 25, 2000, Jacobsen Construction will be
using the fenced in compound for general construction storage, i.e. subcontractor van trailers,
bulk materials, and pre-fabrication of gang forms. Potentially, the compound will also be used as
a receiving/staging area for items such as pre cast concrete members and structural steel.
Vail Resorts Development Company Construction Department (VRDC-Const.) has requested
that Jacobsen keep this department and your office informed of any changes in the use of the
area outlined on the attached site plan fax dated July 25, 2000. It should be further noted on the
subject drawing that areas both east and west of the compound will be used for construction
worker parking. The intent is to have all workers park their personal vehicle at the Confluence
and ride a shuttle to and from the project site.
VRDC-Const expects that Jacobsen take reasonable steps to maintain the compound and parking
areas during the construction of the Ritz, which has a 24-26 month schedule. In the event that
proposed VRDC development plans are approved for the Confluence during the Ritz
construction process, the site will be abandon by Jacobsen, to allow the development to proceed.
Senior Management within VRDC has also made some preliminary commitments to allow
parking of construction workers from the Snow Cloud project, on the Confluence Parcel.

It is understood that the Town of Avon Community Development Department is expecting that
the Confluence Parcel be organized and cleaned up, as part of the intended usage noted above-
Reasonable steps will be made to organize and dispose of unwanted or unneeded equipment and
materials currently on site. During our site meeting, it was noted that there are some concerns
regarding the condition of the containment area for the above grade fuel storage tanks. T have
been informed by Beaver Creek Operations personal that the tanks are slated to be removed from
the site in the very near future.
A representative from VRDC-Const._will follow up with you in person to fill out any necessary
permits associated with the intended usage of the Confluence Parcel.
